EXPLANATORY MEMORANDUM

Introduction

The Conference held in Rovinj, Croatia, on 22 and 23 March 2001 was a highlight in the work of the Congress’ Committee on Culture and Education in 2001. The subject of the Conference was “linguistic diversity: a challenge for European cities and regions”, representing the CLRAE’s main contribution to European Year of Languages 2001. Organised by the Congress, the Croatian Ministry of European Integration and the Committee of the Regions of the European Union, the conference was also assisted by the Council of Europe’s Directorate General of Culture and Education. The event was an indubitable success in terms of both the variety of themes addressed and the quality of the speakers and contributors.

We the Rapporteurs would like to thank the following Croatian authorities for their hospitality: Mr Ivan Jakovcic, Croatian Minister for European Integration and former member of the Congress (since becoming President of the Istria Region), Mr Vladimir Strugar, Croatian Minister for Education and Sports, and Mr Lido Sosic, Mayor of Rovinj. Their enthusiasm and the warm welcome they extended to participants unquestionably contributed to the success of this conference.

The Congress Committee on Culture and Education had considered the preliminary draft programme of the conference at its meeting in Strasbourg on 28 October 2000.

Participants

The Rovinj Conference was attended by over 150 representatives of local and regional authorities, national governments, international organisations and academic bodies closely involved in cultural and language policies.

Following the welcoming addresses by the three aforementioned political figures, a welcome message from Walter Schwimmer, Secretary General of the Council of Europe, was read out by a representative of the Croatian Ministry of European Integration.

The opening speeches of the conference were delivered by:

Lord Russell-Johnston, President of the Parliamentary Assembly of the Council of Europe,

Mrs Irma Peioponen, Fist Vice-President of the Committee of the Regions of the European Union, member of the Varkaus City Council (Finland), and

Mr Llibert Cuatrecasas, President of the Congress of Local and Regional Authorities of Europe (CLRAE).

A wealth of themes

The various contributions presented at the conference will be published in a separate document, to which we would refer the reader¹.

As can be seen from the programme (see Appendix 2), the Rovinj Conference addressed a large number of themes relating to linguistic diversity using a wide variety of angles and approaches. The Final Declaration, adopted on 23 March 2001 (see Appendix 1) comprises a summary of the various pronouncements, though it is insufficient on its own to reflect the whole wealth of the statements made and questions raised.

We have therefore decided, at the risk of incompleteness, that this report should only include a few of the statements and items which we consider particularly significant.

We would like to present the statements delivered by the following participants:

- Mr Ivan Jakovcic, Croatian Minister for European Integration, pointed out that the conference was important to Croatia because of its recent history. He said that knowledge of other languages and cultures contributed to peace and friendship among different nations. Through this conference, a small town, Rovinj, in a small country, Croatia, was sending out a message of peace to the whole of Europe, and particularly to the Balkans.

- Lord Russell-Johnston, President of the Parliamentary Assembly of the Council of Europe, described linguistic purity as a myth. Linguistic diversity, on the other hand was as natural and inevitable as the diversity of human nature. He considered that a command of foreign languages was a decisive factor for mutual understanding and peace among the nations.

- Mrs Irma Peiponen, Vice-President of Commission 7 of the Committee of the Regions of the European Union, stressed the importance of these issues to the Committee of the Regions, pointing out that real regional development was based on the particular region’s cultural identity, of which language was a key element. Support for cultural diversity was a precondition for sustainable development.

- Mr Llibert Cuatrecasas, President of the Congress, welcomed the fact that Croatia had chosen to launch European Year of Languages at the Rovinj Conference. He stressed that the Congress set great store by the European Charter for Regional or Minority Languages, which had only been ratified by eleven countries, including Croatia, to date (March 2001). He said that languages were a political issue, and pointed to the risk of some languages being sidelined or even wiped out by the economic and cultural domination of other more powerful and prestigious languages. He added that learning a language other than one’s one was a right and a necessity for social integration and for the realisation of genuine democratic citizenship. He referred to the Innsbruck Declaration (December 2000), which stressed that “all languages, whether national, regional or local, are equal in dignity. The preservation of Europe’s linguistic diversity is essential for the harmonious development of our societies”.

- Mrs Helene Lund, Chair of the Committee on Culture and Education of the CLRAE Chamber of Local Authorities and member of the Committee of the Regions, said that the Rovinj Conference was but the beginning. The Congress, like the Committee of the Regions, would continue its work with follow-up action on the questions raised during the event.

The proceedings of the conference were based on the following main themes:

SOME CONCLUSIONS FROM THE MODE OF ORGANISATION OF THE CONFERENCE

1. Co-operation between the Congress and Directorate General IV of the Council of Europe (Education, Culture, Youth and Sport, Environment)

As in the case of previous CLRAE conferences, including the one in Innsbruck (November 2000), the programme for the Rovinj Conference was drawn up in close co-operation with the relevant Council of Europe department, which in this case was the Division of Modern Languages, Directorate General IV. This co-operation proved particularly beneficial with the department responsible for organising European Year of Languages 2001. Several of the experts who spoke at the Rovinj Conference are regularly involved in co-operation with the Council of Europe’s Directorate General IV.

We welcome this highly productive co-operation between the Congress and the experts and hope that it can continue in the coming years, particularly under the transverse projects currently being initiated by the Council for Cultural Co-operation (CDCC).

The Congress might, for instance, propose continuing joint activities with the experts from this sector in such matters as helping migrants learn the language of their host country, knowledge of immigrant languages in the host countries and, obviously, the role of local and regional authorities in promoting linguistic diversity.

2. Co-operation between the Congress and the Committee of the Regions of the European Union

The Rovinj Conference was one of the first Congress activities organised in co-operation with the Committee of the Regions, specifically its Commission 7 on “Education, Vocational Training, Culture, Youth, Sport and Citizens’ Rights”. This co-operation was facilitated by the fact that several of the Congress members attending the Rovinj event are also members of the Committee of the Regions. It was a matter of great satisfaction that such co-operation proved possible on the occasion of European Year of Languages 2001, an activity jointly conducted by the Council of Europe and the European Union.

We would like to refer to the opinion adopted by the Committee of the Regions on 23 June 2001 on promoting and protecting regional or minority languages in Europe (see Doc. CG/CULT (8) 4). This opinion, adopted three months after the Rovinj Conference, makes several references to the European Charter for Regional or Minority Languages.

This co-operation established in Rovinj should, in our view, continue in the future not only in the cultural and educational field but also in other sectors of common interest to the Congress and the Committee of the Regions.

3. Co-operation with the Parlimanetary Assembly

In such a field as languages, which concerns all the component bodies of the Council of Europe, the Congress is particularly grateful that the President of the Parliamentary Assembly of the Council of Europe agreed to speak at the Rovinj Conference. The CLRAE welcomes this co-operation and stresses the importance of the report on European Year of Languages presented by Mr Jacques Legendre, Rapporteur for the Committee on Culture, Science and Education, at the Assembly Session in September 2001 (Doc. 9194 of 10 September 2001), which duly mentions the Rovinj Conference.

The Congress will obviously take account in its future work of Recommendation 1539 (2001) on European Year of Languages, adopted by the Parliamentary Assembly on 28 September 2001.

EUROPEAN YEAR OF LANGUAGES 2001

The Congress welcomes the proclamation of European Year of Languages 2001, a Council of Europe initiative backed by the European Union. One of the objectives of this Year is to develop multilingualism and enhance the European linguistic heritage. The objectives and aims of the Year were presented at the beginning of the conference by Mrs Alida Matkovic of the Council of Europe’s Division of Modern Languages.

The Rovinj Declaration, which reflects the local and regional authorities’ viewpoint, acknowledges the major potential contribution of language skills to effective cross-border, inter-regional and inter-municipal co-operation. Paraphrasing the Innsbruck Declaration (December 2000) - a previous initiative by the Congress in the cultural sector - the Rovinj Declaration acknowledges that “all languages, whether national, regional, local, minority or linked to migration, are equal in dignity”.

All European citizens should be able, throughout their lives, to acquire an ability to communicate in, if not a perfect command of, several languages. The Congress, as well as the Parliamentary Assembly, acknowledges the great importance of the new instrument introduced by the Council of Europe, namely the “European Language Portfolio”, which was presented in detail at the Rovinj Conference.

The Congress might recommend, on the basis of the proposals set out in the Rovinj Declaration, that governments and local and regional authorities in Europe introduce language policies geared to:

- encouraging cultural and linguistic diversity
- protecting and promoting Europe’s rich linguistic heritage
- supporting social and inter-ethnic cohesion
- ensuring protection for regional or minority languages
- promoting the learning of the languages of neighbouring countries
- recognising, in a spirit of openness and tolerance, the value of all the languages and cultures practiced in the European cities and regions by immigrants and foreign residents from all over the world.

These issues were intensively discussed at the Rovinj Conference, and they should, in our view, be the subject of future work by the Congress.

One of the key aims of European Year of Languages is to promote multilingualism, ie to develop the ability of European citizens to communicate in several languages, without necessarily having a perfect command of them. The Year also provides an opportunity to emphasise that everyone in Europe can and must be entitled to engage in lifelong language learning.

The Rovinj Conference acknowledged that continuation of the globalisation process was presenting major challenges to regional, minority and lesser-used languages. The Conference recommended that Council of Europe member states use the new information technologies to teach not only foreign but also regional or minority languages.

The Rovinj Declaration recommends educational policies facilitating the learning of at least two foreign languages at school, and advocates teaching specified subjects in various foreign languages as well as curricula for teaching the languages of neighbouring countries in order to foster cross-border co-operation. In view of the importance of the media, the Declaration also encourages television networks to broadcast programmes in the original languages with sub-titles in order to familiarise viewers, particularly younger ones, with the sound of foreign languages, and also to improve children’s mother-tongue reading skills.

The choice of language to be learnt should not be dictated solely by economic and geopolitical reasons. The Rovinj Declaration acknowledges that knowledge of languages improves job and travel opportunities, but at the same time it asks local and regional authorities to introduce language and cultural policies geared to developing multilingualism. It stresses that language learning serves the cause of peace and encourages mutual understanding, tolerance and respect for different identities.

We would like to stress that on 26 September 2001 all 45 European states having ratified the Council of Europe’s European Cultural Convention celebrated “European Day of Languages”. Thousands of activities took place throughout the continent to celebrate linguistic diversity and promote language learning. Many events were organised (“language streets”, “language buses”, etc).

In a difficult international context, the Council of Europe seized on the Day to reiterate the message of peace, which holds that multilingualism and language learning are powerful vehicles for mutual respect and tolerance among the peoples.

THE EUROPEAN CHARTER FOR REGIONAL OR MINORITY LANGUAGES

The problems of regional and minority languages were also intensively discussed at the Rovinj Conference. Several rapporteurs went into the various features of the European Charter. The Declaration invites member states which have not yet done so to ratify the European Charter for Regional or Minority Languages and established the necessary legal framework and material and human resources required for protecting and promoting regional or minority languages as valuable components of the European cultural heritage.

1. Recommendation to the Committee of Experts

We would like to draw the Congress’ attention to the fact that on 20 September 2001 the Committee of Ministers adopted its first ever recommendations on the application of the Charter. These recommendations are based on the evaluation reports prepared by the Committee of Experts on the Charter in the light of information periodically submitted by the State s Parties to the Charter and the NGOs, as well as in the wake of visits which the Committee makes to the various countries. The three states covered by these first recommendations are Croatia, Finland and the Netherlands.

In connection with Croatia - which hosted the Rovinj Conference, during which several contributions were presented on the various aspects of this country’s language policy - the Committee of Ministers recommends energetic measures on the administrative, institutional, legal and legislative fronts to genuinely promote and guarantee the use of regional and minority languages.

Where Finland is concerned, the Committee of Ministers recommends immediate measures to reinforce the Sami language in education and increase its media presence. The use of Swedish, the lesser-used official language, and Sami should also be encouraged in the legal, administrative, health and social welfare sectors.

As regards the Netherlands, the Committee of Ministers recommends intensifying the teaching of the Frisian language and increasing its use in the legal and administrative fields and in the audiovisual media².

The Congress should encourage the Committee of the Charter to continue its work in this area and to extend it to other member states, and urge increasing numbers of countries to sign and ratify the Charter.

2. Opinion of the Committee of the Regions on the European Charter

We would also like to draw the Congress’ attention to the Opinion adopted by the Committee of the Regions on 13 June 2001 on the Promotion and Protection of Regional and Minority Languages, which makes several references to the Council of Europe’s European Charter for Regional or Minority Languages. This opinion requests that the European Commission use the principles and objectives of the European Charter as a yardstick for assessing the extent to which countries applying for European Union membership are honouring their commitments vis-à-vis protection of minorities.

In its opinion the Committee of the Regions urges European Union Member States to “sign and ratify (the Charter) without reservations…, in order to support the principles and objectives laid down therein and extend the level of support offered to minority and regional languages, especially as regards their use in the field of public services”. The Committee of the Regions also recommends that the European Commission establish a long-term programme to promote and protect minority (lesser-used) and regional languages of the European Union. It advises the European Commission to consult the bodies responsible for promoting European languages and associations representing language communities on matters of funding and long-term strategy vis-à-vis regional and minority languages.

The Committee of the Regions requests that the Commission support a research project on socio-linguistic change in Europe, identifying the factors contributing to the rise or fall of specific languages, to include public authority action in this field. Lastly, the Committee of the Regions advocates including the issue of minority (lesser-used) and regional languages of the European Union on the agenda of the 2004 Intergovernmental Conference in order to guarantee their proper recognition in the European Union treaties.

THE ROLE OF LOCAL AND REGIONAL AUTHORITIES IN PROMOTING LINGUISTIC DIVERSITY – Conclusions of the Final Round Table

This theme cropped up repeatedly throughout the Conference, and the proceedings ended with a Round Table on the subject before the adoption of the Final Declaration.

Drawing on a summary prepared by Mr Christophe Büchi, journalist (Switzerland), Mrs Crnic-Grotic (Croatia), Vice-Chair of the Committee of Experts on the European Charter for Regional or Minority Languages, pointed out that the European Charter was aimed not at creating minority ghettoes but at developing linguistic diversity in a positive and constructive manner. The Charter covered all traditionally spoken languages, whether territorially based or not. Nor did the Charter specify whether it applied to dialects and immigrant languages. Ms Crnic-Grotic acknowledged the great difficulty of defining an immigrant language, taking the example of Serbs in Slovenia, who had held immigrant status in that country for only ten years. While recognising that the local and regional authorities had a primordial role to play, she nevertheless considered that each State should decide on the practical measures to be taken depending on the actual needs of individual language groups.

Mr Bucci (Italy, L), Chair of the CLRAE Committee on Sustainable Development and former Congress Rapporteur on the European Charter, noted that progress was impossible without adequate funding, though some of the more urgent measures were easily affordable, the most important being to recognise the private associations and organisations working in this field. He considered that active support was needed for mother-tongue education, teacher training, folk traditions and cultural production, and that the media, particularly local television channels, and libraries should assign sufficient time and space to minority languages. He said that language research and cross- border exchanges should be supported at the regional level, adding that Internet might be used as a key tool for promoting lesser-used languages.

Mr Brezigar, President of the European Bureau for Lesser Used Languages in Dublin, observed that the concept of “lesser-used languages” was a compromise aimed at avoiding such expressions as “minority languages” or “regional languages”. The European Bureau, made up of all the European Union states except Portugal and Greece, promoted languages through networked activities. Mr Brezigar considered that there was much to be learnt from every national model, but that each country should identify its own solutions.

Mr Roppe (Belgium, L), a CLRAE member, stressed that even though most of the participants at the conference were convinced of the need to protect and promote minority languages, some countries were more reluctant to do so. He pointed out that local authorities had a frontline role to play in opening up to minority cultures, eg by means of cable TV companies.

The Round Table finished with a presentation of the linguistic situation of the German-speaking and Croatian minorities in Hungary and the Italian-speakers in the province of Istria in Croatia (approx. 220 000 individuals). Istria was shortly to be declared the first bilingual region of Croatia, and Mr Zilli, the President of the Administrative County of Istria, said that bilingualism had to be supported in this region as a sine qua non for multiethnic democracy. He stressed that schools should play a fundamental role and that bilingualism should not be confined to the private sphere but should also be given a high public profile.

CLOSING SESSION AND ADOPTION OF THE FINAL DECLARATION

The draft Final Declaration was tabled and debated during Closing Session, which was chaired by Mrs Lund, Chair of the Committee on Culture and Education, Chamber of Local Authorities and member of the European Union Committee of the Regions. The following participants addressed the meeting: Mr Demin, CLRAE member, Mrs Peioponen on behalf of the European Union Committee of the Regions, and Mr Stöckling, CLRAE member.

The Final Declaration was unanimously adopted (see Appendix 1).

The Closing Address of the Conference was delivered by Mr Jakovcic, Croatian Minister for European Integration.

FOLLOW-UP TO THE CONFERENCE

One of the main themes for potential work by the Congress in the future is undoubtedly that of local and regional authority policy on the languages used by foreign or immigrant residents. This is a highly topical theme given the current international situation and the threats to social cohesion in European cities and regions arising from the international tension generated by the 11 September 2001 attacks in the United States.

We consider that the Congress should launch fresh initiatives on this theme.

The Congress Committee on Culture and Education should also consider the invitation extended at the meeting on 10 April 2001 by Mr Demin, Mayor of Petrozavodsk (Russian Federation) to hold a follow-up conference to the Rovinj Conference in his town, at a date to be decided.

The draft Recommendation and Resolution submitted to the committee for approval at its meeting on 19 October are based on the main conclusions of this explanatory memorandum.
