Non-implementation of the Court’s judgments: our shared responsibility

Strasbourg, 23 August 2016 – “In December last year, the Council of Europe’s Steering Committee on Human Rights (CDDH) published a report on the longer-term future of the system of the European Convention on Human Rights (“the Convention”). There were two challenges which particularly struck me: firstly, prolonged non-implementation of a number of judgments of the European Court of Human Rights and secondly, direct attacks on the Court’s authority.

It is difficult to overstate the extraordinary contribution of the Court to the protection of human rights in Europe. This has been acknowledged in each High Level conference declaration along the Interlaken-Izmir-Brighton-Brussels reform process. The fact that so many Europeans turn to the Strasbourg Court for redress reflects the high level of trust that they place in the Convention system. Yet states must make sure that the system works.

Prolonged non-implementation of the judgments of the Court is a challenge to the Court’s authority and thus to the Convention system as a whole.” says Nils Muižnieks, Council of Europe Commissioner of Human Rights, in his latest Human rights Comment published today. (continue reading)

Strasbourg, 23 août 2016 – « En décembre 2015, le Comité directeur pour les droits de l'homme (CDDH) du Conseil de l'Europe a publié un rapport sur l’avenir à plus long terme du système de la Convention européenne des droits de l'homme (« la Convention »). Deux défis présentés dans ce rapport m’ont particulièrement frappé : la non-exécution prolongée d’un certain nombre d’arrêts de la Cour européenne des droits de l'homme et les menaces directes pour l’autorité de la Cour.

L’on n’insistera jamais assez sur la contribution extraordinaire de la Cour à la protection des droits de l'homme en Europe. Elle a été reconnue dans la déclaration de chacune des conférences de haut niveau organisées dans le cadre du processus de réforme d’Interlaken-Izmir-Brighton-Bruxelles. Le grand nombre d’Européens qui introduisent une requête devant la Cour de Strasbourg témoigne d’ailleurs de leur confiance à l’égard du système de la Convention. Les Etats doivent cependant veiller à ce que le système fonctionne.
