Abridged report

A.   FOREWORD

The European Commission for the Efficiency of Justice (CEPEJ) held its 26th plenary meeting in Strasbourg on 6 - 7 December 2016. The meeting was chaired by Mr Georg STAWA (Austria), President of the CEPEJ.

The agenda appears in the Appendix.

B.   LIST OF ITEMS DISCUSSED AND DECISIONS TAKEN BY THE CEPEJ

The CEPEJ:

§  thanked André POTOCKI, Judge at the European Court of Human Rights in respect of France, for having, at the opening the meeting:

-          underlined the close links between the Court and the CEPEJ and the key role of the CEPEJ in facilitating the proper functioning of the Court's mechanisms by being a player as regards subsidiarity,

-          recalled the essential work of the CEPEJ in the field of judicial time management and to promote the importance of court users in judicial policies,

-          indicated that judges of the Court welcomed the recent evaluation reports on judicial systems as these were valuable tools for the Court's work,

-          highlighted the need to improve the situation within  judicial systems to ensure the right to an effective remedy as provided for by Article 13 of the European Convention on Human Rights and welcomed the forthcoming publication of the “Good practice guide to improve the functioning of justice”;

  1. Information by the President of the CEPEJ, the CEPEJ members and the Secretariat

§  thanked the French Institut des Hautes Etudes sur la Justice and the Montreal Cyberjustice Laboratory (Canada) for the organisation of the "1st Cyberjustice Conference - Europe" in Strasbourg on 5 December 2016, highlighted the quality of the work and decided to take it into account in the context of its own work to enhance the efficiency and quality of justice through the use of information technology;

§  took note of the information provided by its President, its members and its Secretariat who had participated in various fora where the work of the CEPEJ had been presented and discussed and noted with satisfaction that this concerned 57 events (including cooperation activities) in 23 members States and 3 non-European states in 2016, contributing to the promotion of public policies aimed at ensuring the efficiency and quality of judicial systems;

 

§  took note of the information provided by Azerbaijan, Bulgaria, Estonia, France, Latvia, Malta, Netherlands, Serbia, Slovenia, Spain, "the former Yugoslav Republic of Macedonia", Ukraine, United Kingdom, on recent developments in the judicial field and invited its members to forward to the Secretariat written information and useful references which could be included in the area "country profiles" of the CEPEJ web site;

  1. Evaluation of the European judicial systems

§  welcomed the setting up by the Secretariat of the CEPEJ-STAT interactive database, an innovative tool which provides public decision-makers, justice professionals, researchers and, more broadly, the public with the possibility of obtaining valuable and comparable information easily on the functioning of judicial systems; invited its members to ensure a wide communication in their countries around this tool and instructed the Secretariat to promote it inside and outside the Council of Europe, including through video-conferences with member States ;

§  noted with great satisfaction the excellent reception by the Committee of Ministers of the report “European judicial systems – Edition 2016” and the thematic report on “the use of information technology in European courts”, as well as the positive responses received as regards this work in many member States, from policy makers, justice practitioners (see the specific on the tour de table) and the media (see the press review);

 

§  invited its members to disseminate the reports widely to the competent authorities and judicial professionals of their countries, in particular by facilitating their translation (at least the translation of the overview), where appropriate, and to forward as soon as possible to the Secretariat information on the way the reports are used by the state authorities and any press articles at national level concerning this work;

§  decided to launch the next evaluation process in 2017 on the basis of data of the year 2016, with a view to publishing the results in 2018;

§  adopted for this purpose the revised Evaluation Scheme (CEPEJ(2016)9), taking into account a positive indicative vote to include in the questionnaire a series of questions relating to the use of information technology in courts, and instructed the CEPEJ-GT-EVAL to adapt the explanatory note accordingly;

§  agreed that the electronic Scheme should be opened for reply by national correspondents as from 1 June 2017 until 31 December 2017 and urged the national correspondents to comply with such a timeframe, in order for the data to be processed from January 2018;

stressed that part of the Scheme would also be used within the framework of the cooperation with the European Commission (see below), which implied that, for this part of the Scheme, the national correspondents concerned were urged to respond by 1 October 2017;  

§  decided that, in addition to the general report evaluating judicial systems based on key fact and figures, the thematic report for the 2016-2018 evaluation cycle would cover the court users and instructed the CEPEJ-GT-EVAL to prepare the draft reports on the basis of the information collected;

§  agreed that Morocco could be involved in this new evaluation cycle as an Observer to the CEPEJ;

§  welcomed the cooperation with the European Commission on the evaluation of judicial systems and noted that a new Study on judicial systems in the member states of the European Union was being prepared, based on the methodology developed by the CEPEJ, from the 2015 data, aimed at providing information allowing the European Commission to prepare its "EU Justice Scoreboard”; reiterated its full willingness to continue this cooperation in the coming years under the same modalities;

§  agreed that new peer evaluation visits on judicial statistics would take place to the Cyprus, Czech Republic and  Georgia in 2017;

  1. Quality of justice

§  adopted the document “Measuring the quality of judicial services” (CEPEJ(2016)12) prepared by the CEPEJ-GT-QUAL from the preparatory work of Fabio BARTOLOMEO (CEPEJ member, Italy), which defines the CEPEJ indicators for measuring the quality of justice;

§  adopted the” Guidelines on how to drive changes towards cyberjustice” (CEPEJ(2016)13 prepared by the CEPEJ-GT-QUAL from the preparatory work of Harold EPINEUSE (scientific expert, France);

§  adopted the “Good practice guide to improve the functioning of justice” (CEPEJ(2016)14) prepared by the CEPEJ-GT-QUAL from the preparatory work of Francesco DE SANTIS (scientific expert, Italy), regarding structural measures taken by the member States in addition to the effective remedies required by ECHR Article 13;

§  adopted the updated version of the “Handbook on conducting satisfaction surveys for court users“ (CEPEJ(2016)15) prepared by the CEPEJ-GT-QUAL from the preparatory work of Jean-Paul JEAN and Hélène JORRY (scientific experts, France) and completed by Martial PASQUIER (scientific expert, Switzerland);

§  decided to forward these four documents to the Committee of Ministers in order that it may take note of them, as well as to the relevant Committees and bodies of the Council of Europe in order that they may make use of them when appropriate;

§  reiterated its invitation to the volunteer courts in the member States to indicate to the Secretariat their candidature for organising a coaching programme aimed at organising user satisfaction surveys based on the CEPEJ Handbook and invited its members to signal this opportunity widely to the courts in their countries;

  1. Judicial time management

§   adopted the “Implementation Guide: towards European timeframes for judicial proceedings” (CEPEJ(2016)5) prepared by the Steering Group of the SATURN Centre from a preparatory work of Marco FABRI (scientific expert, Italy), containing indicators for court case flow management;

 

§   took note of the other work carried out by the Steering group of the SATURN Centre according to its strategic action plan;

§   instructed its three working groupsto continue their consultation with a view to preparing a compilation of the definitions used in the work of the CEPEJ;

§   reiterated its invitation to the volunteer courts in the member States to indicate to the Secretariat their candidature for organising a coaching programme within the court aimed at implementing the SATURN tools for judicial time management based on the CEPEJ Guide and invited its members to signal this opportunity widely to the courts in their states;

  1. CEPEJ co-operation programmes

§  welcomed the progress made in the on-going cooperation programmes, which allow the practical implementation of the methodology and tools of the CEPEJ and thus provide strong added value to the work of the Council of Europe in the beneficiary States and entities, in particular as regards the following programmes:

-          Horizontal Facility for Western Balkans – Albania and Kosovo*[1] - Joint programme with the European Union,

-          Programmatic Co-operation Framework for the countries of the Eastern partnership -  Azerbaijan and Republic of Moldova - Joint programme with the European Union,

-          Towards Strengthened Democratic Governance in the Southern Mediterranean – Tunisia,  Jordan - Joint programme with the European Union

-          Turkey - Developing mediation practices in civil disputes – Co-operation with the  Swedish International Cooperation Development Agency (Sida),

-          Programme to support the justice sector reform - improving the functioning of justice in Morocco using the tools of CEPEJ - Joint Programme with the European Union;

§  thanked the Croatian authorities for the cooperation developed in the framework of the Programme funded by the EEA/Norway Grants entitled "Improvement of the way cases are handled by the judicial system by applying tried and tested methodologies developed by the CEPEJ", which came successfully to an end on 30 June 2016;

§  agreed to develop specific cooperation for assessing the functioning of the judicial systems in Latvia and  Slovakia, as well as a specific cooperation for the development of mediation in Bulgaria, and possibly with Ukraine for court management;

§  thanked the European Union, the EEA/Norway Grants and Sida for their confidence in the CEPEJ’s specific expertise in supporting the reforms of judicial systems towards greater efficiency and quality through the practical implementation of the CEPEJ’s own methodology and tools, and reiterated its willingness to cooperate with its member States and other partner States and entities to support the development of the public service of justice in Europe and beyond;

§  recalled that the implementation of these numerous programmes by the CEPEJ requires the availability of members and experts of the CEPEJ and called upon its members and experts to inform the Secretariat of their willingness to participate in such programmes;

  1. CEPEJ Innovation Centre

§  thanked the Supreme Court of Murcia (Spain) for presenting the project "Judicial Excellency and 2015-2020 strategic programme" as a good practice aimed at improving the efficiency and quality of the public service of justice, deserving of being shared with a wider public at European level and beyond;

§  instructed the Secretariatto develop, in particular in electronic form, the CEPEJ Innovation Centre as a virtual place bringing together good practices as regards court organisation and to implement activities of research of good practices at the European level;

  1. Report by the Secretary General of the Council of Europe: “The state of democracy, human rights and the rule of law in Europe”

§   welcomed the 2016 Report by the Secretary General of the Council of Europe on the "State of democracy, human rights and the rule of law – a security imperative for Europe"; noted with satisfaction that the Secretary General had requested the relevant bodies to "develop the methodology and establish a regular in-house evaluation mechanism on the independence and impartiality of the judiciaries of the Council of Europe member states”, reiterated its readiness to be involved in the implementation of the Council of Europe Plan of Action on strengthening judicial independence and impartiality;

  1. Relations between the CEPEJ and the other bodies of the Council of Europe

§  took note of the information provided on the activities of the Consultative Council of European Judges (CCJE), the Consultative Council of European Prosecutors (CCPE), and as regards cooperation with the European Court of Human Rights;

§  took note of the information provided by the representatives of Slovakia and Malta, speaking on behalf of the outgoing and incoming presidencies of the European Union, on the recent and planned developments within the Union in the field of justice;

  1. European Day of Justice and Crystal Scales of Justice

§  thanked the authorities of Serbia for having organised the main event of the 2016 European Day of Justice in Belgrade, as well as the judicial authorities in 19 member States which organised specific events within the framework of this Day; invited its members to promote initiatives for the 2017 edition and candidatures for organising the main event;

§  invited its members to promote candidacies for the next edition of the “Crystal Scales of Justice” in 2017;

  1. Observers with the CEPEJ

§  took noteof the information provided by its Observers, and in particular the OECD, the European Union of Rechtspfleger (EUR) which introduced its White Paper, the International Union of bailiffs and judicial officers (UIHJ), the European Association of Judges (EAJ), the European Judicial Training Network (EJTN), thanked them for their concrete contribution to the CEPEJ’s activities and invitedthem to contribute further to the implementation of its Activity Programme;

§  entrusted its members and the Secretariat to update the composition of the CEPEJ Network of pilot courts and thanked the pilot court of Arnhem for its invitation to organise the 2017 plenary meeting of the Network in the Netherlands;

 

§  recalled the invitation for its member States to appoint substitute? members to the CEPEJ;

§  invited the member States, through the CEPEJ members to propose to the Secretariat by 15 January 2017 qualified experts to participate in the CPEJ Working Group on mediation (CEPEJ-GT-MED) and entrusted its Bureau to appoint members of this group, taking into account these proposals;

§  encouraged its members to join the CEPEJ on Facebook;

§  re-elected for a two year period Georg STAWA (Austria) as President of the CEPEJ, Ramin GURBANOV (Azerbaijan) as Vice-President of the CEPEJ, Ivana BORZOVA (Czech Republic) and Noel RUBOTHAM (Ireland) as members of the Bureau;

§  took note of the draft calendar for the CEPEJ meetings in 2017, including the plenary meetings which may take place on 29 - 30 June and 7 - 8 December.
