    Action

    To approve the annual adjustment of remuneration of staff as set out in decisions A 1 to 11 below.

    To unblock the relevant parts of the provisions for current year salary adjustments in the 2004 budgets (decisions A 12 to 17 and B to J).

    The GR-AB has examined the Secretary General's proposals (document GR-AB(2004)3) on three occasions (see GR-AB(2004)CB2, CB3 and CB4). In application of the salary adjustment method the CCR has recommended an increase of 3.2% for staff based in France. The 2004 budgetary provisions - based on an increase of 2.5% - would allow at this stage for the CCR recommendation to be put into effect from 16 March 2004. In this context the GR-AB recommended that the increase be given effect on 16 March 2004 and the question of awarding an increase at a date earlier than that date be considered at a later stage in the light of priorities agreed by the Deputies and on the basis of the 2004 budgetary situation during or after the close of the 2004 financial year. Summing up the discussions, the Chair of the GR-AB noted that there was agreement within the Group to recommend the draft decisions as set out below.

    Decisions

    A. The Deputies

    1. approved the recommendations set out in paragraph 4 of the 152nd report of the Co-ordinating Committee on Remuneration (CCR) (CM(2004)3), concerning the adjustment of remuneration of the staff of the Co-ordinated Organisations, in so far as they concern the Council of Europe; and accordingly,

    2. approved the salary scales at 1 January 2004 resulting from the application of the adjustment indices set out in Annex 2 of the 152nd report, as shown in the tables by country attached to
    that report, with the exception of the salary scales for B and C grade staff members for Belgium, France and Germany, which are replaced by the salary scales set out in document CM(2004)3 Addendum;

    3. agreed to suspend the negative effect of the adjustment of the scales for Hungary and Switzerland, in order to maintain the salary scales at their current level until a later adjustment allows a scale increase superior to the current frozen level;

    4. noted that, in pursuance of Article 36 of the 132nd Report, pensions payable under Appendix V of the Staff Regulations will be adjusted in the same proportions and at the same date as the salary of staff in relation to which they are calculated;

    5. noted that in pursuance of Article 33 of the New Pension Scheme, pensions payable over
    the year in accordance with Appendix V bis of the Staff Regulations will be paid on the basis of the salary scales approved in 2 above.

    6. noted that, in accordance with the interpretation given to paragraph 3 of the 34th Report by the CCG [CCG(65)5] dated 25 October 1965, at its 77th Session on 29 June 1966 [cf. CCG/M(66)6], the salary of auxiliary staff serving in the Council of Europe will be adjusted in the same proportions as that of permanent staff;

    7. approved, with effect at 1 January 2004, the amounts of allowances and indemnities fixed in absolute value, adjusted in accordance with the procedure, set out in Annex 6 to 152nd report of the CCR and its Corrigendum;

    8. decided that the decisions under 1,2, 4, 5 and 6 above would be given effect no later than 16 March 2004;

    9. decided to consider the affordability of granting effect to the decisions under 1, 2, 4, 5 and 6 at a date between 1 January and 15 March 2004, in the light of priorities agreed by the Deputies and proposals to be made by the Secretary General on the basis of the 2004 budgetary situation, during or after the end of the financial year as necessary;.

    10. adopted Resolution Res (2004)… on updating of the Regulations governing Staff Salaries and Allowances. as it appears at Appendix … to the present volume of Decisions; <see Appendix 1 to these Notes>

    11. adopted Resolution Res (2004)… on the Remuneration of Specially Appointed Officials. as it appears at Appendix … to the present volume of Decisions; <see Appendix 2 to these Notes>

    12. unblocked the relevant part of the provision entered under Chapter 0702, sub-head 0000012 of the 2004 Ordinary Budget, that is to say € 2 468 900;

    13. unblocked the relevant part of the provision entered under sub-head 0000012 of the 2004 Service Budget “translation”, that is to say € 166 800;

    14. unblocked the relevant part of the provision entered under sub-head 0000012 of the 2004 Service Budget “interpretation”, that is to say € 190 000;

    15. unblocked the relevant part of the provision entered under Chapter 2002, sub-head 0000012 of the 2004 Service Budget “documents”, that is to say € 16 000; 

    16. unblocked the relevant part of the provision entered under sub-head 0000012 of the 2004 Subsidiary Budget for publications, that is to say € 250;

    17. unblocked the relevant part of the provision entered under Chapter 2163, sub-head 0000027 of the 2004 Pensions Budget, that is to say € 578 200.

    B. The Deputies, in their composition restricted to the Representatives of the States members of the Partial Agreement in the Social and Public Health Field1, unblocked the relevant part of the provision entered under sub-head 0000012 of the budget of the Partial Agreement for 2004, that is to say € 22 400.

    C. The Deputies, in their composition restricted to the Representatives of the States Parties to
    the Convention on the Elaboration of a European Pharmacopoeia2, unblocked the relevant part of
    the provisions entered under sub-head 0000012 of the budget of the Partial Agreement for 2004, 0000012 of the Subsidiary budget of the Biological Standardisation Programme and sub-heads 2341-0000012, 2351-0000012 and 2371-0000012 of the Subsidiary Budget: Publications, Development, Certification and Conferences, that is to say respectively € 148 200, € 11 900, € 18 600, € 22 200 and € 900.

    D. The Deputies, in their composition restricted to the Representatives of the States members of
    the Council of Europe Development Bank3, unblocked the relevant part of the provision entered under sub-head 0000012 of the budget of the Partial Agreement for 2004, that is to say € 18 200.

    E. The Deputies, in their composition restricted to the Representatives of the States members of
    the Partial Agreement on the Co-operation Group to combat drug abuse and illicit trafficking in drugs (Pompidou Group)4, unblocked the relevant part of the provision entered under sub-head 0000012 of the budget of the Partial Agreement for 2004, that is to say € 24 600.

    F. The Deputies, in their composition restricted to the Representatives of the States members of
    the Partial Agreement on the Co-operation Group for the prevention of, protection against, and organisation of relief in major natural and technological disasters5, unblocked the relevant part of the provision entered under sub-head 0000012 of the budget of the Partial Agreement for 2004, that is to say € 9 800.

    G. The Deputies, in their composition restricted to the Representatives of the States members of
    the Partial Agreement on the European Support Fund for the co-production and distribution of creative cinematographic and audio-visual works “Eurimages”6, unblocked the relevant part of the provision entered under sub-head 0000012 of the budget of the Partial Agreement for 2004, that is to say € 23 000.

    H. The Deputies unblocked the relevant part of the provision entered under sub-head 0000012 of
    the budget of the Enlarged Agreement on the European Commission for Democracy through Law for 2004, that is to say € 35 900.

    I. The Deputies, in their composition restricted to the Representatives of the States members of
    the Partial Agreement establishing the Partial Agreement on the Youth Card7, unblocked the relevant part of the provision entered under sub-head 0000012 of the budget of the Partial Agreement for 2004, that is to say € 1 100.

    J. The Deputies, in their composition restricted to the Representatives of the States members of
    the Enlarged Partial Agreement establishing the European Centre for Modern Languages (Graz)8, unblocked the relevant part of the provision entered under sub-head 0000012 of the budget of the Partial Agreement for 2004, that is to say € 8 800.

    Appendix 1

    Draft Resolution Res(2004)...
    on revision of the Regulations governing staff salaries and allowances

    The Committee of Ministers, under the terms of Article 16 of the Statute of the Council of Europe,

    Having regard to Resolution (81) 18 on the Regulations governing staff salaries and allowances, and to Resolution (81) 20 on the Council of Europe's Staff Regulations incorporating the Regulations governing salaries and allowances as Appendix IV to the said Regulations;

    Having regard to the 152nd report of the Co-ordinating Committee on Remuneration (CM(2004)3, CM(2004)3 Addendum and Corrigendum) and the recommendations contained therein, approved by the Committee of Ministers at the …th meeting of the Deputies

    Whereas, as a result of that approval, the Regulations governing salaries and allowances of Council of Europe staff need to be revised;

    Having regard to the Decisions taken at the …th meeting of the Deputies,

    On the proposal of the Secretary General,

    Resolves as follows:

    1. The relevant tables appended to the Regulations governing staff salaries and allowances, setting out the basic salary scales and other elements of remuneration, are replaced, as at 1 January 2004, by the tables applicable to Council of Europe Secretariat staff which are appended to the 152nd report of the Co-ordinating Committee on Remuneration (CM(2004)3 and Corrigendum), with the exception of the salary scales for B and C grade staff members for Belgium, France and Germany which are replaced by the salary scales set out in document CM(2004)3 Addendum.

    2. The adjustments in salaries and pensions arising from the adoption of the said tables shall be effective as from 16 March 2004.

    3. The affordability of adjusting salaries and pensions in line with the said tables (or Appendix V bis) for the period 1 January to 15 March 2004, or for a part thereof, shall be reviewed, in the light of priorities agreed by the Deputies and proposals to be made by the Secretary General on the basis of the 2004 budgetary situation, during or after the end of the financial year as necessary.

    5. The negative effect of the adjustment of scales for Hungary and Switzerland shall be suspended in order to maintain the salary scales at their current level for 2004.

    6. The adjustments in amounts of allowances fixed in absolute value shall be effective as from 1 January 2004.

    Appendix 2

    The Committee of Ministers, under the terms of Article 16 of the Statute of the Council of Europe,

    Having regard to Resolution (71) 8 on the remuneration of specially appointed officials of the Council of Europe, as last amended by Resolution (2002) 2;

    Having regard to the decisions taken at the …th meeting of the Ministers' Deputies approving the 152nd report of the Co-ordinating Committee on Remuneration on the new salary scales for members of the permanent staff as at 1 January 2004 (CM(2004)3, CM(2004)3 Addendum and Corrigendum);

    Whereas, as a result of that decision, and in accordance with Article 2 of Resolution (71) 8 referred to above, new basic salary scales for the specially appointed officials of the Council of Europe need to be established,

    Resolves as follows:

    Single article:

    The basic annual salaries laid down in Article 1, paragraph (a), of Resolution (71) 8, as last amended by Resolution (2003)2, shall be adjusted as follows with effect from 16 March 2004:

    - Secretary General € 164 847,64,
    - Deputy Secretary General and Secretary General of the Assembly having the rank of Deputy Secretary General € 156 016,52.
