Ref. CommDH 036(2016) National human rights structures: protecting human rights while countering terrorism Strasbourg, 6 December 2016 – “A series of terrorist attacks has deeply traumatised Europe. In Brussels, Paris, Copenhagen, Ankara and beyond, shock was followed by fear of further attacks and a sense of urgency about preventing them”, says Nils Muižnieks, Council of Europe Commissioner of Human Rights, in his latest Human Rights Comment published today. “Preventing and combating terrorism is a clear duty of all states, which must respect and protect every one’s life and security. However, states’ duty to prevent and combat terrorism should in no way be fulfilled at the expense of human rights standards and the common values in which European societies are grounded. À Bruxelles, Paris, Copenhague, Ankara et au-delà, le choc a été immédiatement suivi de la peur de nouveaux attentats et d’un sens de l’urgence pour les empêcher », déclare Nils Muižnieks, Commissaire aux droits de l’homme du Conseil de l’Europe, en publiant aujourd’hui un nouvel article dans le carnet des droits de l’homme. « La prévention du terrorisme et la lutte contre celui-ci sont clairement un devoir de tous les Etats, qui doivent respecter et protéger la vie et la sécurité de tous. Cependant, l’obligation des Etats de prévenir le terrorisme et de le combattre ne devrait en aucun cas être remplie aux dépens des normes relatives aux droits de l’homme et des valeurs communes sur lesquelles se fondent les sociétés européennes. При этом обязанность государства предупреждать терроризм и бороться с ним ни в коей мере не должна выполняться в ущерб правам человека и тем общим ценностям, которые лежат в основе европейских обществ. Такой подход был бы ошибкой, поскольку законы и политика, соответствующие правам человека, сохраняют именно те ценности, которые террористы и пытаются уничтожить.
