Resolution CM/Res(2014)4
amending the Statute of the Administrative Tribunal (Appendix XI to the Staff Regulations)

at the 1202nd meeting of the Ministers’ Deputies)

The Committee of Ministers, in accordance with Article 16 of the Council of Europe Statute,

Having regard to Articles 59, 60 and 61 of the Staff Regulations;

Having regard to the Statute of the Administrative Tribunal (Appendix XI to the Staff Regulations);

At the proposal of the Secretary General, the Staff Committee having been consulted in accordance with Article 6, paragraph 1, of the Regulations on Staff Participation (Appendix I to the Staff Regulations),

Decides as follows:

Article 1

The title and the text of Article 15 of the Statute of the Administrative Tribunal (Appendix XI to the Staff Regulations) shall henceforth be worded:

“Article 15 – Bodies attached to the Council of Europe and other international governmental organisations

1. The jurisdiction of the Tribunal may be extended to cover disputes between bodies attached to the Council of Europe and other international governmental organisations and their respective officials, should the appropriate authorities of such bodies or international governmental organisations so request.

2. In such cases, an agreement governing administrative procedure and arrangements shall be concluded between the Secretary General and the body or the international governmental organisation concerned. The agreement shall expressly provide that the latter body or international governmental organisation shall bear the cost of compensation awarded by the Tribunal to any of its officials and the cost occasioned by such disputes.”

Article 2

The Secretary General shall submit to the Committee for authorisation any agreement which he/she may contemplate signing with international governmental organisations.

Article 3

This resolution shall come into force on the date of its adoption.
