At their 1187th meeting (11-12 December 2013) (CM/Del/Dec(2013)1187/11.5), the Deputies took note of the terms of the sale of the European Directorate for the Quality of Medicine (EDQM) building in the Meinau (CM/Inf(2013)39).

At their 1187th meeting (11-12 December 2013) (CM/Del/Dec(2013)1187/11.3), the Deputies agreed to increase the programme line “Investments” in the 2013 Ordinary Budget by €500 000, to be financed from within Pillar 4 (Governing Bodies, General Services and Other) and approved the revised investment programme for 2013.

At their 1185th (Budget) meeting (19-20 November 2013) (CM/Del/Dec(2013)1185/11.6), the Deputies adopted the amendments to the revised Financial Regulations and invited the GR-PBA to monitor the implementation of the revised Financial Regulations.

At their 1183rd meeting (6 November 2013) (CM/Del/Dec(2013)1183/11.1), the Deputies expressed their appreciation of San Marino’s offer to donate a sculpture by the artist Leonardo Blanco and decided to accept it gratefully. They took note of the report of the 35th meeting of the Committee for Works of Art (C-ART) (CM(2013)139).

At their 1175th meeting (3 July 2013) (CM/Del/Dec(2013)1175/11.6), the Deputies welcomed the continued implementation of the publications policy, which resulted in notable cost savings, and also the introduction of a common corporate design for the Organisation. They encouraged all Council of Europe entities, including Partial Agreements, to co-operate with the Committee for the Rationalisation of Publications, with due respect for their respective mandates and prerogatives. The Deputies invited the TC-INF to examine the Council of Europe publications and communication policy, with a view to increasing its added value and outreach, and invited the GR-PBA to continue to monitor this issue.

At their 1175th meeting (3 July 2013) (CM/Del/Dec(2013)1175/11.4), the Deputies agreed to the amended practical modalities governing accession to and withdrawal from Partial, Enlarged Partial and Enlarged Agreements, with effect from 1 January 2014.

At their 1173rd meeting (11-12 June 2013) (CM/Del/Dec(2013)1173/11.1), the Deputies expressed their appreciation of Armenia’s offer to donate stained glass windows of the artist Arev Petrosyan for the upper façade of the Assembly Chamber of the Palais de l'Europe and decided to accept it gratefully, subject to the conditions stated in paragraph 6 of document CM(2013)61. They then took note of the report of the 34th meeting of the Committee for Works of Art (C-ART) (CM(2013)61).

At their 1168th meeting (10 April 2013) (CM/Del/Dec(2013)1168/11.2), the Deputies took note of the Progress Review Report for 2012 (CM/Inf(2013)4 rev), encouraged further improvements to the presentation of the report and invited the relevant Rapporteur Groups to examine the Progress Review Report for 2012.

At their 1168th meeting (10 April 2013) (CM/Del/Dec(2013)1168/11.1), the Deputies adopted Resolution CM/Res(2013)7 concerning financial arrangements for the participation of non-member States in Council of Europe conventions. They invited the Secretary General to inform non-member States which became Parties to Council of Europe conventions prior to the adoption of the above-mentioned resolution about this resolution, and invite them to consider contributing to the financing of these conventions according to the modalities set out in the resolution, and to report back periodically on its implementation.

At their 1166th meeting (27 March 2013) (CM/Del/Dec(2013)1166/11.1), the Deputies adopted Resolution CM/Res(2013)4 amending Resolution CM/Res(2009)5 on the status and conditions of service of judges of the European Court of Human Rights and of the Commissioner for Human Rights. They also adopted Resolution CM/Res(2013)5 amending Resolution Res(2004)50 on the status and conditions of service of judges of the European Court of Human Rights.

At their 1162nd meeting (13-14 February 2013) (CM/Del/Dec(2013)1162/11.4), the Deputies agreed to amend Paragraph 1 of Article 7 of the Rules concerning the reimbursement of travel and subsistence expenses to government experts and other persons travelling at the charge of Council of Europe budgets as follows: “1. During the meeting, experts shall be entitled to receive an allowance at a daily rate determined annually by the Committee of Ministers (the rate in force as from 1 January 2010 is €175). This rate is the same wherever the meeting takes place. Exceptionally, specific rates may be determined for projects funded through extra-budgetary resources, in particular Council of Europe – European Union joint programmes, as agreed with the donor concerned.”

Budget matters

At their 1185th (Budget) meeting (19-20 November 2013) (CM/Del/Dec(2013)1185/11.5), the Deputies agreed to replace, with effect from 1 January 2014, the current system of administrative expenses levies on extra-budgetary resources by a system with a single fixed percentage levy of 7%, applicable to all extra-budgetary resources as from that date. The Deputies invited the Secretary General to report to them on the implementation of the fixed levy system in the framework of the annual budgetary management accounts.

At their 1185th (Budget) meeting (19-20 November 2013) (CM/Del/Dec(2013)1185/11.4), the Deputies took note of the information on the medical insurance balance account (CM(2013)121) and authorised the continuation of the medical insurance balance account included in “Other reserves” within the Organisation's consolidated equity. The Deputies took note that the purpose of this account is to serve as a clearing account for balancing the real cost of medical cover between permanent staff and retired staff; finance benefits not covered by the insurer; amortise possible increases in the cost of the medical cover of serving and retired staff.

The Deputies agreed that this account would continue to record possible differences between contributions levied on salaries and pensions and the premiums paid to the insurer, any profit-related premium refunds by the insurer and interest earned on the funds contained in the account. They fixed the ceiling of the account at three months’ employers’ and employees’ medical insurance contributions and delegated the management of this account to the Secretary General, asking him to report annually on it. The Deputies agreed to reduce the balance in the account by an amount of €2 250 000; and consequently agreed, as a one-time exception in this context to the principle that a surplus should be returned to member States in accordance with Article 68 of the Financial Regulations, with the commitment to finance the “joint programmes” account from the Ordinary Budget as from 2016, to allocate €1 500 000 representing the employer’s share to the “joint programmes” special account so as to reinforce the Organisation’s operational capacity and invited the Secretary General to report regularly on its use; and took note that €750 000, representing the staff share, would be allocated to a suspense account, with a view to its reimbursement to permanent staff and retired staff under arrangements to be determined by the Secretary General in consultation with the Staff Committee. Finally, the Deputies instructed the Secretary General to find a sustainable solution to the funding of joint programmes for the next biennium (2016-2017).

At their 1185th (Budget) meeting (19-20 November 2013) (CM/Del/Dec(2013)1185/11.1/Part1), the Deputies adopted Resolution CM/Res(2013)30 on the adjustment of the scale of contributions to the Council of Europe Ordinary Budget and Budget of the European Youth Foundation, with effect from 1 January 2014, and fixed the rates of contribution to the special accounts for cultural and sports activities for 2014 of the non-member States Parties to the European Cultural Convention.

The Deputies approved the amounts for the rates of the various retainers, honoraria and daily allowances with effect from 1 January 2014 and fixed with effect from 1 January 2014, the rates of the annual representational allowances for specially appointed officials. They also fixed, with effect from 1 January 2014, registration fees for the activities of the European Youth Centres and fixed the total appropriations for staff-related expenditure at €147 728 700, noting that in accordance with their decision adopted at their 971st meeting (12 July 2006, item 11.6), any increase in this total would require their approval.

The Deputies approved the table of posts, took note of the table of positions and approved the organisation chart, with effect from 1 January 2014.

The Deputies adopted Resolution CM/Res(2013)31 approving the Programme for 2014-2015 and the Budget for 2014, as well as the Budget for 2015 on a provisional basis. They took note of the Medium-term Investment Plan 2014-2017 (CM(2013)130) and approved the Investment Programme for 2014 for a total of €5 460 000, as well as for 2015 on a provisional basis (CM(2013)130). The Deputies also approved the terms of reference of the steering and ad hoc committees, and their subordinate groups (CM(2013)131 add final).

Having regard to Article 28 of the Financial Regulations governing transfers between programme lines within the operational pillars and between programme lines within the support pillar of the Budget, the Deputies agreed that transfers of appropriations, other than those of a technical nature, related to the charging of staff costs and the allocation of common provisions, to or from the European Court of Human Rights, the Parliamentary Assembly or the Congress of Local and Regional Authorities of the Council of Europe would require their prior authorisation. Whenever transfers between programme lines exceed 10% of the supplying or receiving programme line or €100 000, the Committee of Ministers shall be immediately informed of the transfers and their justification.

The Deputies noted that the amount of €1 430 300, resulting from the application of the 2014 salary adjustment in the Ordinary Budget and the Service Budgets, would be frozen pending their future decisions. In approving the budgetary decisions and in light of the discussions, the Deputies invited the Secretary General to prepare before 30 June 2014 a document setting out the long-term budgetary sustainability and efficiency of the Organisation as part of its continuing reform process which reinforces a wider vision for the future of the Council of Europe.

At their 1185th (Budget) meeting (19-20 November 2013) (CM/Del/Dec(2013)1185/11.1/Part2), the Deputies adopted Resolution CM/Res(2013)32 on the adjustment of the scale of contributions to the Extraordinary Budget, with effect from 1 January 2014. They approved the Extraordinary Budget for 2014, as well as for 2015 on a provisional basis, and consequently adopted Resolution CM/Res(2013)33.

At their 1185th (Budget) meeting (19-20 November 2013) (CM/Del/Dec(2013)1185/11.1/Part3A), the Deputies approved the Pensions Budget for 2014, as well as for 2015 on a provisional basis, and consequently adopted Resolution CM/Res(2013)34.

At their 1185th (Budget) meeting (19-20 November 2013) (CM/Del/Dec(2013)1185/11.1/Part3B), the Deputies adopted Resolution CM/Res(2013)35 on the adjustment of the scale of contributions to the Pension Reserve Fund, with effect from 1 January 2014. They approved the Pension Reserve Fund Budget for 2014, as well as for 2015 on a provisional basis, and consequently adopted Resolution CM/Res(2013)36 concerning the Pension Reserve Fund for 2014-2015.

At their 1185th (Budget) meeting (19-20 November 2013) (CM/Del/Dec(2013)1185/11.1/Part4), the Deputies approved the European Youth Foundation's Programme for 2014-2015 and its Budget for 2014, as well as its Budget for 2015 on a provisional basis, and consequently adopted Resolution CM/Res(2013)37. They noted that the amount of €4 200, resulting from the application of the 2014 salary adjustment, would be frozen pending their future decisions.

At their 1185th (Budget) meeting (19-20 November 2013) (CM/Del/Dec(2013)1185/11.1/Part5), the Deputies approved in principle the Secretary General’s proposal of a contingency plan for the EDQM to mitigate the risks that could affect the continuity of the activities of the EDQM and subsequently the availability of reference standards that are needed for the production of medicines (CM(2013)138), it being understood that it would not lead to additional contributions from member States; and consequently authorised the Secretary General to undertake the necessary measures for the creation of a contingency stock and its storage in rented facilities. The Deputies authorised the Secretary General to undertake preliminary studies for the construction of a secondary site for the storage of the contingency stock of reference standards and their distribution, should the EDQM building be impaired by disaster. They authorised the Secretary General to use the line “Project expenditure earmarked for future activities” to finance the above contingency measures and consequently to transfer €1.7 million in 2014 and €1.5 million in 2015 to the grant to the investment budget for this purpose. The Deputies agreed to resume consideration of this matter at one of their forthcoming meetings.

At the same meeting, the Deputies approved the scale of contributions for the Budget of the European Pharmacopoeia for 2014 and adopted Resolution CM/Res(2013)38. They approved the creation of 12 posts (4 A, 5 B, 2 C, 1 L) with effect from 1 January 2014, as well as, on a provisional basis, the creation of 4 posts (2 B, 2 C) with effect from 1 January 2015. The Deputies took note of the EDQM Medium-term Investment Plan 2014-2015 (CM(2013)130 corr). They approved the Investment Programme for 2014, as well as for 2015 on a provisional basis (CM(2013)130 corr) for a total of €5 110 000 in 2014 and €4 115 000 in 2015. The Deputies then approved the European Pharmacopoeia’s Programme for 2014-2015 and its Budget for 2014, as well as its Budget for 2015 on a provisional basis, and adopted Resolution CM/Res(2013)39. They approved the terms of reference of the CD-P-PH, the CD-P-SC, the CD-P-TO and the CD-P-TS (CM(2013)131 addfinal). Finally, the Deputies noted that the amount of €168 700, resulting from the application of the 2014 salary adjustment, would be frozen pending their future decisions.

At their 1185th (Budget) meeting (19-20 November 2013) (CM/Del/Dec(2013)1185/11.1/Part6), the Deputies approved the scale of contributions of the Partial Agreement Development Bank of the Council of Europe for 2014 and, consequently, adopted Resolution CM/Res(2013)40. They approved this Partial Agreement’s Programme for 2014-2015 and its Budget for 2014, as well as its Budget for 2015 on a provisional basis, and, consequently, adopted Resolution CM/Res(2013)41. The Deputies noted that the amount of €8 300, resulting from the application of the 2014 salary adjustment, would be frozen pending their future decisions.

At their 1185th (Budget) meeting (19-20 November 2013) (CM/Del/Dec(2013)1185/11.1/Part7), the Deputies approved the scale of contributions of the Enlarged Partial Agreement on the Co-operation Group to Combat Drug Abuse and Illicit Trafficking in Drugs (Pompidou Group) for 2014 and, consequently, adopted Resolution CM/Res(2013)42. They approved this Enlarged Partial Agreement’s Programme for 2014-2015 and its Budget for 2014, as well as its Budget for 2015 on a provisional basis, and, consequently, adopted Resolution CM/Res(2013)43. The Deputies noted that the amount of €5 700, resulting from the application of the 2014 salary adjustment, would be frozen pending their future decisions.

At their 1185th (Budget) meeting (19-20 November 2013) (CM/Del/Dec(2013)1185/11.1/Part8), the Deputies approved the scale of contributions for 2014 of the Partial Agreement on the Co-operation Group for the Prevention of, Protection against, and Organisation of Relief in Major Natural and Technological Disasters (EUR-OPA) and, consequently, adopted Resolution CM/Res(2013)44. The Deputies approved this Partial Agreement’s Programme for 2014-2015 and its Budget for 2014, as well as its Budget for 2015 on a provisional basis, and, consequently, adopted Resolution CM/Res(2013)45. They noted that the amount of €3 200, resulting from the application of the 2014 salary adjustment, would be frozen pending their future decisions.

At their 1185th (Budget) meeting (19-20 November 2013) (CM/Del/Dec(2013)1185/11.1/Part9), the Deputies approved the Programme for 2014-2015 of the Partial Agreement on the European Support Fund for the Co-production and Distribution of Creative Cinematographic and Audiovisual Works “Eurimages” and its Budget for 2014, as well as its Budget for 2015 on a provisional basis, and, consequently, adopted Resolution CM/Res(2013)46. They noted that the amount of €14 900, resulting from the application of the 2014 salary adjustment, would be frozen pending their future decisions.

At their 1185th (Budget) meeting (19-20 November 2013) (CM/Del/Dec(2013)1185/11.1/Part10), the Deputies approved the scale of contributions for 2014 for the Venice Commission and, consequently, adopted Resolution CM/Res(2013)47.

The Deputies approved the creation of 1 post (A2/A3) with effect from 1 January 2014. They approved, with effect from 1 January 2014, a rate of daily subsistence allowance of €175 for consultants, personalities and delegations from central and eastern European countries attending meetings held at the seat of the Commission in Venice and whose expenses are charged to the Budget of the Enlarged Agreement; and members of the Commission on official journeys acting as rapporteurs at the request of the Commission and whose expenses are charged to the Budget of the Enlarged Agreement. The Deputies also approved, with effect from 1 January 2014, a rate of daily allowance of €240 for work at home for members of the Venice Commission.

The Deputies approved this Enlarged Agreement's Programme for 2014-2015 and its Budget for 2014, as well as its Budget for 2015 on a provisional basis, and, consequently, adopted Resolution CM/Res(2013)48. They noted that the amount of €21 000, resulting from the application of the 2014 salary adjustment, would be frozen pending their future decisions.

At their 1185th (Budget) meeting (19-20 November 2013) (CM/Del/Dec(2013)1185/11.1/Part11), the Deputies approved the scale of contributions for 2014 of the Enlarged Partial Agreement on Youth Mobility through the Youth Card and, consequently, adopted Resolution CM/Res(2013)49. They approved this Enlarged Partial Agreement’s Programme for 2014-2015 and its Budget for 2014, as well as its Budget for 2015 on a provisional basis, and, consequently, adopted Resolution CM/Res(2013)50.

At their 1185th (Budget) meeting (19-20 November 2013) (CM/Del/Dec(2013)1185/11.1/Part12), the Deputies approved the scale of contributions for 2014 of the Enlarged Partial Agreement on the European Centre for Modern Languages (Graz) and, consequently, adopted Resolution CM/Res(2013)51. They approved this Enlarged Partial Agreement's Programme for 2014-2015 and its Budget for 2014, as well as its Budget for 2015 on a provisional basis, and, consequently, adopted Resolution CM/Res(2013)52.

At their 1183rd meeting (6 November 2013) (CM/Del/Dec(2013)1183/11.2), the Deputies, without prejudice to any future Committee of Ministers’ decision concerning amounts remaining on the Council of Europe accounts, took note of the Secretary General’s proposal on the use of the “common programmes balance” (CM(2013)107 and GR-PBA(2013)16).

The Deputies endorsed the € 400 000 provision for unforeseen financial responsibilities relating to joint programmes (“liability shield”). They authorised the Secretary General to make the necessary transfers from the “common programmes balance” in order to maintain the provision at € 400 000 and authorised the use of the remaining amount in the “common programmes balance” amounting to € 342 032.01 as at 31 December 2012 for the preparation, the implementation and the follow-up of joint programmes.

The Deputies then invited the Secretary General to report on a regular basis on the implementation of the above decisions.

At their 1182nd meeting (24 October 2013) (CM/Del/Dec(2013)1182/11.1), the Deputies approved the 2013 revised Budget of the Pompidou Group and, consequently, adopted Resolution CM/Res(2013)29.

At their 1181st meeting (16 October 2013) (CM/Del/Dec(2013)1181/11.1a), the Deputies approved the consolidated financial statements of the Council of Europe for the year ended 31 December 2012, in the light of the opinion of the External Auditor (CM(2013)100), and accordingly adopted Resolution CM/Res(2013)14. They approved the budgetary management accounts of the General Budget for the year ended 31 December 2012 (Ordinary Budget, Subsidiary Budgets: Services, Subsidiary Budgets of the European Youth Centres, Subsidiary Budget for Publications, Extraordinary Budget, Pensions Budget, Budget of the European Youth Foundation), in the light of the opinion of the External Auditor (CM(2013)100 add), and accordingly adopted Resolution CM/Res(2013)15. The Deputies agreed to transmit the above-mentioned consolidated financial statements and budgetary management accounts to the Parliamentary Assembly for information.

At their 1181st meeting (16 October 2013) (CM/Del/Dec(2013)1181/11.1b), the Deputies approved the budgetary management accounts of the Partial Agreement on the Convention on the Elaboration of a European Pharmacopoeia for the year ended 31 December 2012, in the light of the opinion of the External Auditor (CM(2013)100), and accordingly adopted Resolution CM/Res(2013)16.

At their 1181st meeting (16 October 2013) (CM/Del/Dec(2013)1181/11.1c), the Deputies approved the budgetary management accounts of the Partial Agreement on the Council of Europe Development Bank for the year ended 31 December 2012, in the light of the opinion of the External Auditor (CM(2013)100), and accordingly adopted Resolution CM/Res(2013)17.

At their 1181st meeting (16 October 2013) (CM/Del/Dec(2013)1181/11.1d), the Deputies approved the budgetary management accounts of the Enlarged Partial Agreement on the Co-operation Group to Combat Drug Abuse and Illicit Trafficking in Drugs (Pompidou Group) for the year ended 31 December 2012, in the light of the opinion of the External Auditor (CM(2013)100), and accordingly adopted Resolution CM/Res(2013)18.

At their 1181st meeting (16 October 2013) (CM/Del/Dec(2013)1181/11.1e), the Deputies approved the budgetary management accounts of the Partial Agreement on the Co-operation Group for the Prevention of, Protection Against, and Organisation of Relief in Major Natural and Technological Disasters (EUR-OPA) for the year ended 31 December 2012, in the light of the opinion of the External Auditor (CM(2013)100), and accordingly adopted Resolution CM/Res(2013)19.

At their 1181st meeting (16 October 2013) (CM/Del/Dec(2013)1181/11.1f), the Deputies approved the budgetary management accounts of the Enlarged Agreement on the European Commission for Democracy through Law (Venice Commission) for the year ended 31 December 2012, in the light of the opinion of the External Auditor (CM(2013)100), and accordingly adopted Resolution CM/Res(2013)20.

At their 1181st meeting (16 October 2013) (CM/Del/Dec(2013)1181/11.1g), the Deputies approved the budgetary management accounts of the Enlarged Partial Agreement on Youth Mobility through the Youth Card for the year ended 31 December 2012, in the light of the opinion of the External Auditor (CM(2013)100), and accordingly adopted Resolution CM/Res(2013)21.

At their 1181st meeting (16 October 2013) (CM/Del/Dec(2013)1181/11.1h), the Deputies approved the budgetary management accounts of the Enlarged Partial Agreement establishing the European Centre for Modern Languages (Graz) for the year ended 31 December 2012, in the light of the opinion of the External Auditor (CM(2013)100), and accordingly adopted Resolution CM/Res(2013)22.

At their 1181st meeting (16 October 2013) (CM/Del/Dec(2013)1181/11.1i), the Deputies approved the budgetary management accounts of the Enlarged Agreement on the Group of States against Corruption (GRECO) for the year ended 31 December 2012, in the light of the opinion of the External Auditor (CM(2013)100), and accordingly adopted Resolution CM/Res(2013)23.

At their 1181st meeting (16 October 2013) (CM/Del/Dec(2013)1181/11.1j), the Deputies approved the budgetary management accounts of the Enlarged Partial Agreement on Sport (EPAS) for the year ended 31 December 2012, in the light of the opinion of the External Auditor (CM(2013)100), and accordingly adopted Resolution CM/Res(2013)24.

At their 1181st meeting (16 October 2013) (CM/Del/Dec(2013)1181/11.1k), the Deputies approved the budgetary management accounts of the Enlarged Partial Agreement on Cultural Routes for the year ended 31 December 2012, in the light of the opinion of the External Auditor (CM(2013)100), and accordingly adopted Resolution CM/Res(2013)25.

At their 1181st meeting (16 October 2013) (CM/Del/Dec(2013)1181/11.2), the Deputies approved the financial statements of the Enlarged Partial Agreement establishing the European Centre for Global Interdependence and Solidarity (North-South Centre) for the year ended 31 December 2012, in the light of the opinion of the External Auditor (CM(2013)101), and accordingly adopted Resolution CM/Res(2013)26. They agreed to transmit the above-mentioned financial statements to the Parliamentary Assembly for information.

At their 1181st meeting (16 October 2013) (CM/Del/Dec(2013)1181/11.3), the Deputies approved the financial statements of the Partial Agreement of the European Support Fund for the Co-production and Distribution of Creative Cinematographic and Audiovisual Works “Eurimages” for the year ended 31 December 2012, in the light of the opinion of the External Auditor (CM(2013)102), and accordingly adopted Resolution CM/Res(2013)27. They agreed to transmit the above-mentioned financial statements to the Parliamentary Assembly for information.

At their 1175th meeting (3 July 2013) (CM/Del/Dec(2013)1175/11.3), the Deputies approved the 2013 revised budget of the Enlarged Agreement on the European Commission for Democracy through Law (Venice Commission) and, consequently, adopted Resolution CM/Res(2013)11.

At their 1162nd meeting (13-14 February 2013) (CM/Del/Dec(2013)1162/11.6), the Deputies, recognising the exceptional and urgent nature of the work to reinforce security in the Palais de l’Europe, invited the Secretary General to carry out this work without further delay and to finance the corresponding expenditure, amounting to €360 000, within the appropriation of the Ordinary Budget for 2013 (Governing Bodies, General Services and Other).

Budget Committee

At their 1187th meeting (11-12 December 2013) (CM/Del/Dec(2013)1187/11.1), the Deputies appointed the members and alternate members of the Budget Committee for a term of three years from 1 January 2014 to 31 December 2016.

At their 1185th (Budget) meeting (19-20 November 2013) (CM/Del/Dec(2013)1185/11.3), the Deputies welcomed the fact that the Budget Committee would continue to pay close attention to the question of results-based budgeting in the future and in particular to the formulation of objectives, expected results and performance indicators. They then took note of the meeting report of the September 2013 session of the Budget Committee (CM(2013)113).

At their 1178th meeting (17-18 September 2013) (CM/Del/Dec(2013)1178/11.2), the Deputies took note of the deadline (15 October 2013) for the deposit of candidatures – with the Directorate of Programme, Finance and Linguistic Services of the Council of Europe – for members and alternate members of the Budget Committee for the period 1 January 2014 to 31 December 2016.

At their 1175th meeting (3 July 2013) (CM/Del/Dec(2013)1175/11.1), the Deputies took note of the meeting report of the May 2013 session of the Budget Committee (CM(2013)63).

At their 1171st meeting (29 May 2013) (CM/Del/Dec(2013)1171/11.2), the Deputies took note of the information provided by the Secretariat on the procedure for appointment of members and alternate members of the Budget Committee for the period 1 January 2014 to 31 December 2016 (CM(2013)38), and in particular that candidatures should be deposited with the Directorate of Programme, Finance and Linguistic Services of the Council of Europe before 15 October 2013.

Audit

At their 1185th (Budget) meeting (19-20 November 2013) (CM/Del/Dec(2013)1185/11.2), the Deputies took note of the report prepared by the Secretary General on the implementation of the evaluation policy (CM(2013)120). They welcomed the Secretary General’s commitment to enhancing the Organisation’s evaluation culture and welcomed the Secretary General’s proposal to strengthen the resources of the Directorate of Internal Oversight and to clarify and document, in line with Article 2 of the Financial Regulations and international best practice, evaluation procedures and processes, notably in the form of a revision of paragraphs 18 and 19 of the Evaluation Policy and revised Guidelines which should be submitted for approval.

At their 1181st meeting (16 October 2013) (CM/Del/Dec(2013)1181/11.5), the Deputies took note of the annual report for 2012 of the Audit Committee (CM(2013)92), and agreed to transmit it to the Parliamentary Assembly for information.

Internal Oversight

At their 1181st meeting (16 October 2013) (CM/Del/Dec(2013)1181/11.4), the Deputies took note of the annual report 2012 of the Directorate of Internal Oversight (CM(2013)91), and agreed, in the light of the comments, to transmit it to the Parliamentary Assembly for information.

External Auditor

At their 1187th meeting (11-12 December 2013) (CM/Del/Dec(2013)1187/11.2), the Deputies appointed the Najwyższa Izba Kontroli (NIK), Poland, as External Auditor for a five-year period beginning with the audit of the financial statements for the year ending 31 December 2014.

At their 1178th meeting (17-18 September 2013) (CM/Del/Dec(2013)1178/11.1), the Deputies took note of the Secretariat's reminder that member States are invited to submit candidatures for the position of External Auditor before 15 October 2013, in conformity with the procedure for the appointment of the External Auditor, for a five-year period beginning with the audit of the financial statements for the year ending 31 December 2014.

At their 1171st meeting (29 May 2013) (CM/Del/Dec(2013)1171/11.1), the Deputies invited member States to submit candidatures for the position of External Auditor before 15 October 2013, in conformity with the procedure for the appointment of the External Auditor, for a five-year period beginning with the audit of the financial statements for the year ending 31 December 2014.

Co-ordinating Committee on Remuneration (CCR)

At their 1185th (Budget) meeting (19-20 November 2013) (CM/Del/Dec(2013)1185/11.9), the Deputies, having regard to the recommendations set out in paragraph 4 of the 223rd report of the CCR (CM(2013)142), concerning the adjustment of remuneration of the staff of the co-ordinated organisations, in so far as they concern the Council of Europe, agreed to adopt, with effect from 1 January 2014, the salary scales resulting from the application of the adjustment indices indicated in Annex 2 of the 223rd report (the adjustment index for France being - 0.8%), as shown in the tables for each State attached to that report (Appendix 5), with the exception of the salary scales for B and C grade staff members for Belgium, France, Germany and Hungary, which are replaced by the salary scales set out in CM(2013)142 add. They approved, with effect at 1 January 2014, the amounts of allowances and indemnities fixed in absolute value, adjusted in accordance with the procedure, set out in Annex 4 to the 223rd report of the CCR and noted that, in pursuance of Article 36 of the 132nd report (CM(2001)170 rev), pensions payable under Appendix V of the Staff Regulations will be adjusted in the same proportions and at the same date as the salary of staff in relation to which they are calculated. The Deputies noted that, in accordance with the interpretation given to paragraph 3 of the 34th report by the CCG (CCG(65)5) dated 25 October 1965, at its 77th session on 29 June 1966 (cf. CCG/M(66)6), the salary of temporary staff serving in the Council of Europe will be adjusted in the same proportions as that of permanent staff. They also noted that under the terms of Article 3 of Resolution CM/Res(2009)5 on the status and conditions of service of judges of the European Court of Human Rights and of the Commissioner for Human Rights, the annual remuneration of judges and of the Commissioner for Human Rights will be adjusted in accordance with any adjustments made to salaries of staff members based in France.

The Deputies adopted Resolution CM/Res(2013)53 on the revision of the Regulations governing staff salaries and allowances, and Resolution CM/Res(2013)54 on the remuneration of specially appointed officials.

At their 1185th (Budget) meeting (19-20 November 2013) (CM/Del/Dec(2013)1185/11.8), the Deputies took note of the 222nd report of the CCR (CM(2013)141) and decided that, as a special adjustment, the remuneration, as adjusted at 1 January 2013, be increased by 0.2% for Turkey, with effect from 1 May 2013. They noted that by application of the 150th report by the Co-ordinating Committee of Government Budget Experts (CCG), dated 4 April 1978 [CCG(78)4], pensions will be increased in the same proportion and on the same date as the remuneration of the staff to whom this recommendation applies, and noted that, in accordance with the interpretation given to paragraph 3 of the 34th report by the CCG [CCG(65)5], the remuneration of auxiliary staff serving in the co-ordinated organisations will be adjusted in accordance with the provisions of this report.

At their 1167th meeting (3 April 2013) (CM/Del/Dec(2013)1167/11.2), the Deputies took note of the 2012 activity report of the CCR (CM(2013)25). They invited the Secretary General to write to the CCR to encourage it to complete in 2013 the work which is priority and directly connected with the ongoing reforms in the Council of Europe (contributive share of the co-ordinated pension scheme, tax adjustment, review of the co-ordinated allowances and indemnities, modernisation of the salary system).

At their 1162nd meeting (13-14 February 2013) (CM/Del/Dec(2013)1162/11.3), the Deputies took note of the 221st report of the CCR (CM(2012)178), and approved, with effect from 1 January 2013, the amounts of the kilometric allowance, as they appear in that report.

At their 1162nd meeting (13-14 February 2013) (CM/Del/Dec(2013)1162/11.2), the Deputies took note of the 220th report of the CCR on the revision at 1 January 2013 of the daily subsistence allowance for staff of the co-ordinated organisations (CM(2012)177), and approved, with effect from 1 January 2013, the rates of the daily subsistence allowance, as they appear in the tables appended to that report.

At their 1162nd meeting (13-14 February 2013) (CM/Del/Dec(2013)1162/11.1), the Deputies, having regard to the recommendations set out in paragraph 5 of the 219th report of the CCR (CM(2012)158), concerning the adjustment of remuneration of the staff of the co-ordinated organisations, in so far as they concern the Council of Europe, having regard to the Secretary General’s proposal in this respect (CM(2013)9), recalling the difficult budgetary context in many member States, and having expressed concern about the interpretation of data by the International Service for Remunerations and Pensions (ISRP) in the calculation of the adjustment, adopted, with effect from 1 March 2013, the salary scales resulting from the application of the adjustment indices indicated in Annex 2 of the 219th report (the adjustment index for France being 2.3%), as shown in the tables for each State attached to that report, with the exception of the salary scales for B and C grade staff members for Belgium, France, Germany and Hungary which are replaced by the salary scales set out in CM(2012)158 add. The Deputies noted that, in accordance with Article 5 of the 211th report, any special adjustment shall be deducted from the annual adjustment.

At the same time, the Deputies noted that, in pursuance of Article 36 of the 132nd report (CM(2001)170 rev), pensions payable under Appendix V of the Staff Regulations will be adjusted in the same proportions and at the same date as the salary of staff in relation to which they are calculated and noted that, in accordance with the interpretation given to paragraph 3 of the 34th report by the CCG (CCG(65)5) dated 25 October 1965, at its 77th session on 29 June 1966 (cf. CCG/M(66)6), the salary of temporary staff serving in the Council of Europe will be adjusted in the same proportions as that of permanent staff. The Deputies noted that under the terms of Article 3 of Resolution CM/Res(2009)5 on the status and conditions of service of judges of the European Court of Human Rights and of the Commissioner for Human Rights, the annual remuneration of judges and of the Commissioner for Human Rights will be adjusted in accordance with any adjustments made to salaries of staff members based in France.

The Deputies approved, with effect at 1 January 2013, the amounts of allowances and indemnities fixed in absolute value, adjusted in accordance with the procedure, set out in Annex 4 to the 219th report of the CCR, and adopted Resolution CM/Res(2013)1 on the revision of the Regulations governing staff salaries and allowances and Resolution CM/Res(2013)2 on the remuneration of specially appointed officials. The Deputies unblocked the provisions for adjustment to remuneration entered under the Ordinary Budget, the Budget of the European Youth Foundation, the Service Budgets, the Pensions Budget and Subsidiary Budgets.

The Deputies, in their composition restricted to the representatives of the States Parties to the Convention on the Elaboration of a European Pharmacopoeia, unblocked the provisions for adjustment to remuneration entered under the budget of the Partial Agreement for 2013.

The Deputies, in their composition restricted to the representatives of the States members of the Council of Europe Development Bank, unblocked the provisions for adjustment to remuneration entered under the budget of the Partial Agreement for 2013.

The Deputies, in their composition restricted to the representatives of the States members of the Partial Agreement on the Co-operation Group to Combat Drug Abuse and Illicit Trafficking in Drugs (Pompidou Group), unblocked the provisions for adjustment to remuneration entered under the budget of the Partial Agreement for 2013.

The Deputies, in their composition restricted to the representatives of the States members of the Partial Agreement on the Co-operation Group for the Prevention of, Protection against, and Organisation of Relief in Major Natural and Technological Disasters, unblocked the provisions for adjustment to remuneration entered under the budget of the Partial Agreement for 2013.

The Deputies, in their composition restricted to the representatives of the States members of the Partial Agreement on the European Support Fund for the Co-production and Distribution of Creative Cinematographic and Audiovisual Works “Eurimages”, unblocked the provisions for adjustment to remuneration entered under the budget of the Partial Agreement for 2013.

The Deputies unblocked the provisions for adjustment to remuneration entered under the budget of the Enlarged Agreement on the European Commission for Democracy through Law (Venice Commission) for 2013.

The Deputies, in their composition restricted to the representatives of the States members of the Partial Agreement on the Youth Card, unblocked the provisions for adjustment to remuneration entered under the budget of the Partial Agreement for 2013.

The Deputies, in their composition restricted to the representatives of the States members of the Enlarged Partial Agreement on the European Centre for Modern Languages (Graz), unblocked the provisions for adjustment to remuneration entered under the budget of the Partial Agreement for 2013.

Pensions

At their 1175th meeting (3 July 2013) (CM/Del/Dec(2013)1175/11.5), the Deputies took note of the first report for 2013 of the Management Board of the Pension Reserve Fund to the Committee of Ministers (CM(2013)68).

At their 1175th meeting (3 July 2013) (CM/Del/Dec(2013)1175/11.2), the Deputies took note of the actuarial study (CM(2013)56).

At their 1167th meeting (3 April 2013) (CM/Del/Dec(2013)1167/11.1), the Deputies decided to nominate Mr Isa Coşkun, on the proposal of Turkey, and Mr Marc Baechel, on the proposal of the Staff Committee, to the Management Board of the Pension Reserve Fund, for a term of appointment of three years beginning on 24 May 2013, in accordance with Article 5 of Resolution Res(2006)1.

At their 1166th meeting (27 March 2013) (CM/Del/Dec(2013)1166/11.4), the Deputies took note of the 2nd report for 2012 of the Management Board of the Pension Reserve Fund to the Committee of Ministers (CM(2012)180).

At their 1166th meeting (27 March 2013) (CM/Del/Dec(2013)1166/11.2), the Deputies adopted Resolution CM/Res(2013)6 providing for a Third Pension Scheme for staff members appointed on or after 1 April 2013. They agreed to review the issue of the tax adjustment in accordance with Article 46 of the Third Pension Scheme, and in the light of the result of the discussions within the CCR.

At their 1159th meeting (16 January 2013) (CM/Del/Dec(2013)1159/11.1), the Deputies invited member States to submit, before 15 March 2013, candidatures of specialists with expertise in the management of investment funds for the nomination of one member of the Pension Reserve Fund Management Board in accordance with Article 5, paragraph 1.a of Resolution Res(2006)1, for a term of appointment of three years beginning 24 May 2013. They invited the Staff Committee to submit, before 15 March 2013, the name of one person for nomination to the Management Board in accordance with Article 5, paragraph 1.c of Resolution Res(2006)1, for a term of appointment of three years beginning 24 May 2013.

Unpaid contributions

At their 1180th meeting (9 October 2013) (CM/Del/Dec(2013)1180/11.1), the Deputies took note of the situation concerning unpaid contributions to the various budgets and funds of the Council of Europe as at 30 June 2013 (CM(2013)105) and as updated at 13 September 2013 (CM(2013)105 add). They invited the Secretary General to enter into contact with the competent authorities of the non-member States with a view to ensuring that the necessary measures would be taken for their financial obligations to be honoured.

At their 1166th meeting (27 March 2013) (CM/Del/Dec(2013)1166/11.3), the Deputies took note of the situation concerning unpaid contributions to the various budgets and funds of the Council of Europe as at 29 January 2013 (CM(2013)15 and CM(2013)15 corr), as well as the updated situation as at 22 February 2013 (CM(2013)15 add). They invited the Secretary General to enter into contact with the competent authorities of the non-member States with a view to ensuring that the necessary measures would be taken for their financial obligations to be honoured.

Staff policy

At their 1187th meeting (11-12 December 2013) (CM/Del/Dec(2013)1187/11.4), the Deputies adopted Resolution CM/Res(2013)58 amending the Staff Regulations; Resolution CM/Res(2013)59 amending the Regulations on appointments (Appendix II to the Staff Regulations); Resolution CM/Res(2013)60 amending the Regulations governing staff salaries and allowances (Appendix IV to the Staff Regulations); Resolution CM/Res(2013)61 amending the Regulations on indemnity for loss of job (Appendix VI to the Staff Regulations); Resolution CM/Res(2013)62 amending the Regulations on unpaid leave (Appendix VII to the Staff Regulations); Resolution CM/Res(2013)63 amending the Regulations on part-time work (Appendix IX to the Staff Regulations); Resolution CM/Res(2013)64 amending the Statute of the Administrative Tribunal (Appendix XI to the Staff Regulations) and Resolution CM/Res(2013)65 amending the Regulations on the medical and social insurance scheme (Appendix XII to the Staff Regulations).

The Deputies agreed that the reformed contractual policy should increase flexibility in staffing and efficiency of the Organisation, attract and retain the best quality staff, ensure contractual stringency and certainty, improve talent management and performance, and ensure independence, integrity, expertise and institutional memory. They welcomed the Secretary General’s commitment to maintaining his moratorium on granting CDIs and to therefore grant new CDIs in very exceptional circumstances only, and agreed that this policy should be continued beyond the Secretary General’s mandate in order to further set a clear, continuous trend in favour of CDDs. The Deputies invited the GR-PBA to examine, on the basis of a document to be prepared by the Secretary General, his expectations for the future proportion of CDDs, CDDs renewed beyond 10 years and CDIs and how and when these will be achieved, and the criteria for granting these different contracts, and to report back to the Committee of Ministers for a decision to be taken by May 2014.

The Deputies invited the Secretary General to report annually on and evaluate the implementation and impact of the reform of the contractual policy, including by providing on a six monthly basis statistics on the proportion of CDDs, CDDs renewed beyond 10 years and CDIs within the Organisation’s entire workforce. They undertook to review the contractual policy in advance of the 2016-2017 biennium, by no later than April 2015 based on a document prepared by the Secretary General.

At their 1174th meeting (19 June 2013) (CM/Del/Dec(2013)1174/11.1), the Deputies took note of the Secretary General’s proposals concerning the reform of the Organisation’s contractual policy (CM(2013)75) and adopted Resolution CM/Res(2013)10 on the application of Article 20 bis of the Regulations on Appointments (Appendix II to the Staff Regulations). The Deputies invited the Secretary General to submit the necessary draft regulatory amendments, with a view to the entry into force of the new contractual policy, on 1 January 2014 at the latest.
