General

 

At their 1149th meeting (12 September 2012) (CM/Del/Dec(2012)1149/11.2), the Deputies expressed their appreciation of the Czech Republic's offer to donate a bust of Václav Havel by Lubomir Janečka and decided to accept it gratefully.  They also took note of the report of the 33rd meeting of the Committee for Works of Art (C-ART) (CM(2012)113).

At their 1149th meeting (12 September 2012) (CM/Del/Dec(2012)1149/11.1), the Deputies appointed Mr Rocco Antonio Cangelosi (Italy) as judge of the Administrative Tribunal of the Council of Europe, for a term of office ending 31 March 2015.

At their 1147th meeting (4 and 6 July 2012) (CM/Del/Dec(2012)1147/11.4), the Deputies took note of the progress review report 2011 (CM/Inf(2012)9), in the light of discussions at the meeting of the GR-PBA on 19 June 2012 (GR-PBA(2012)CB5).  The Deputies acknowledged the progress with regard to the presentation of the report, encouraged further improvement in this respect and in this context welcomed the seminar to be organised under the aegis of the Budget Committee on 25 September 2012.  They invited relevant Rapporteur Groups to examine the progress review report 2011.

At their 1145th meeting (13 June 2012) (CM/Del/Dec(2012)1145/11.4), the Deputies fixed at 11 July 2012 the deadline by which member States may submit candidatures for the position as judge of the Administrative Tribunal to be appointed by the Committee of Ministers.  They agreed to appoint the judge of the Administrative Tribunal at their 1149th meeting (12 September 2012).

At their 1142nd meeting (9 May 2012) (CM/Del/Dec(2012)1142/11.2), the Deputies expressed their appreciation of Albania's offer to donate a traditional woman's dress from the Northern highlands of Albania, called "Xhubleta", and decided to accept it gratefully. Then they took note of the report of the 32nd meeting of the Committee for Works of Art (C-ART) (CM(2012)76).

At their 1142nd meeting (9 May 2012) (CM/Del/Dec(2012)1142/11.1), the Deputies appointed Ms Magdalena Rycak (Poland) as deputy judge of the Administrative Tribunal of the Council of Europe for a term of office coming to an end on 31 March 2015.

At their 1140th meeting (11 and 12 April 2012) (CM/Del/Dec(2012)1140/11.2), the Deputies expressed their appreciation of Georgia's offer to donate a mobile metal sculpture entitled "Ali and Nino" by Tamara Kvesitadze and decided to accept it gratefully.  They took note of the report of the 31st meeting of the Committee for Works of Art (C-ART) (CM(2012)51).

At their 1138th meeting (28 March 2012) (CM/Del/Dec(2012)1138/11.9), the Deputies took note of the Council of Europe's official hospitality policy (CM(2012)17).

At their 1138th meeting (28 March 2012) (CM/Del/Dec(2012)1138/11.1), the Deputies appointed Mr Jean Waline (France) and Dr Klaus-Dieter Schnaphauff (Germany) as judges and Mr Serkan Kizilyel (Turkey) as deputy judge of the Administrative Tribunal of the Council of Europe, for a term of office of three years from 1 April 2012 to 31 March 2015.  They also agreed to extend to 20 April 2012 the deadline by which member States could submit candidatures for the remaining vacancy of deputy judge of the Administrative Tribunal.

At their 1131st meeting (18 January 2012) (CM/Del/Dec(2012)1131/11.1), the Deputies took note of the appointment by the European Court of Human Rights of Mr Christos Rozakis (Greece) as Chair and Mr Giorgio Malinverni (Switzerland) as substitute for a three year term of office with effect from 1 April 2012.  The Deputies fixed at 9 March 2012 the deadline by which member States may submit candidatures for the four positions as judges of the Administrative Tribunal to be appointed by the Committee of Ministers and agreed to appoint the two judges and two substitute judges of the Administrative Tribunal at their 1138th meeting (28 March 2012).


Budget matters

At their 1155th meeting (21 November 2012) (CM/Del/Dec(2012)1155/11.1/Part1), the Deputies adopted Resolution CM/Res(2012)42 on the adjustment of the scale of contributions to the Council of Europe Ordinary Budget, with effect from 1 January 2013, and fixed the rates of contribution to the special accounts for cultural and sports activities for 2013 of the non-member States parties to the European Cultural Convention.

The Deputies approved the amounts for the rates of the various retainers, honoraria and daily allowances with effect from 1 January 2013, and fixed, with effect from 1 January 2013, the rates of the annual representational allowances for specially appointed officials. The Deputies also fixed, with effect from 1 January 2013, registration fees for the activities of the European Youth Centres and fixed the total appropriations for staff-related expenditure at €147 991 200, noting that in accordance with their decision adopted at their 971st meeting (12 July 2006, item 11.6), any increase in this total would require their approval.

The Deputies approved the table of permanent posts, took note of the table of positions and approved the organisation chart, with effect from 1 January 2013.

The Deputies approved the Secretary General's proposal with regard to the use of the reserve for intergovernmental committees (CM(2012)156), and consequently:
- authorised the transfer from the reserve for intergovernmental committees in 2012 of €49 000 to the corresponding programme lines and of €62 000 to the joint programmes provision;
- authorised the transfer from the reserve for intergovernmental committees in 2013 of €123 500 to the corresponding programme lines;
- approved the terms of reference of the Ad hoc Drafting Group on Dangerous Offenders (PC-GR-DD) and of the Ad hoc Drafting Group on Transnational Organised Crime (PC-GR-COT), within the remit of the CDPC.

Having regard to Resolution CM/Res(2011)28 which provisionally approved this budget for 2013, the Deputies approved the Budget for 2013 and, consequently, adopted Resolution CM/Res(2012)43.

Having regard to the decision adopted at their 1127th meeting (22-24 November 2011) (CM/Del/Dec(2011)1127/11.1/Part1) approving the Investment Programme for 2013 on a provisional basis, the Deputies approved the Investment Programme for 2013 for a total of €5 441 400 (CM(2012)130 revcorr).

Having regard to the decision of the Administrative Tribunal concerning the appeal against the doubling of the period between seniority increments, the Deputies noted that the provision for litigation recorded in the accounts in 2011 to cover for that risk, would be cancelled in 2012 and consequently agreed that €466 500 would be credited to member States, as an advance on the 2012 credit balance.

At their 1155th meeting (21 November 2012) (CM/Del/Dec(2012)1155/11.1/Part8), the Deputies approved the scale of contributions for 2013 for the Budget of the Partial Agreement on the Co operation Group for the Prevention of, Protection Against, and Organisation of Relief in Major Natural and Technological Disasters (EUR-OPA) and consequently adopted Resolution CM/Res(2012)44.

The Deputies agreed to suppress 1 B2 post and replace 1 A5 post with 1 A2/3 post with effect from 1 January 2013. Having regard to Resolution CM/Res(2011)42 which provisionally approved this budget for 2013, the Deputies approved the Budget of the Partial Agreement on the Co-operation Group for the Prevention of, Protection Against, and Organisation of Relief in Major Natural and Technological Disasters (EUR-OPA) for 2013, and consequently adopted Resolution CM/Res(2012)45.

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.3), the Deputies approved the financial statements of this Partial Agreement for the year ended 31 December 2011, in the light of the opinion of the External Auditor (CM(2012)101), and accordingly adopted Resolution CM/Res(2012)40.  They agreed to transmit the above-mentioned financial statements to the Parliamentary Assembly for information.

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.4), the Deputies approved the financial statements of this Partial Agreement for the year ended 31 December 2011, in the light of the opinion of the External Auditor (CM(2012)102), and accordingly adopted Resolution CM/Res(2012)41.  They agreed to transmit the above-mentioned financial statements to the Parliamentary Assembly for information.

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.2Aa), the Deputies approved the consolidated financial statements of the Council of Europe for the year ended 31 December 2011, in the light of the opinion of the External Auditor (CM(2012)100), and accordingly adopted Resolution CM/Res(2012)28.  They approved the budgetary management accounts of the General Budget for the year ended 31 December 2011 (Ordinary Budget, Subsidiary Budgets - Services Budgets, Subsidiary Budgets of the European Youth Centres, Subsidiary Budget for Publications, Extraordinary Budget, Pensions Budget, Budget of the European Youth Foundation), in the light of the opinion of the External Auditor (CM(2012)100 add), and accordingly adopted Resolution CM/Res(2012)29.  Finally, the Deputies agreed to transmit the above-mentioned consolidated financial statements and budgetary management accounts to the Parliamentary Assembly for information.

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.2Ab), the Deputies, in their composition restricted to representatives of the States Parties in 2011 to the Convention on the Elaboration of a European Pharmacopoeia, approved the budgetary management accounts of this Partial Agreement for the year ended 31 December 2011, in the light of the opinion of the External Auditor (CM(2012)100), and accordingly adopted Resolution CM/Res(2012)30.

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.2Ac), the Deputies, in their composition restricted to representatives of the States members in 2011 of the Partial Agreement on the Council of Europe Development Bank, approved the budgetary management accounts of this Partial Agreement for the year ended 31 December 2011, in the light of the opinion of the External Auditor (CM(2012)100).

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.2Ad), the Deputies, in their composition restricted to representatives of the States members in 2011 of the Partial Agreement on the Co-operation Group to Combat Drug Abuse and Illicit Trafficking in Drugs (Pompidou Group), approved the budgetary management accounts of this Partial Agreement for the year ended 31 December 2011, in the light of the opinion of the External Auditor (CM(2012)100), and accordingly adopted Resolution CM/Res(2012)32.

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.2Ae), the Deputies, in their composition restricted to representatives of the States members in 2011 of the Partial Agreement on the Co-operation Group for the Prevention of, Protection Against, and Organisation of Relief in Major Natural and Technological Disasters (EUR-OPA), approved the budgetary management accounts of this Partial Agreement for the year ended 31 December 2011, in the light of the opinion of the External Auditor (CM(2012)100), and accordingly adopted Resolution CM/Res(2012)33.

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.2Af), the Deputies approved the budgetary management accounts of the Enlarged Agreement on the European Commission for Democracy through Law (Venice Commission) for the year ended 31 December 2011, in the light of the opinion of the External Auditor (CM(2012)100), and accordingly adopted Resolution CM/Res(2012)34.

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.2Ag), the Deputies, in their composition restricted to representatives of the States members in 2011 of the Partial Agreement on Youth Mobility through the Youth Card, approved the budgetary management accounts of this Partial Agreement for the year ended 31 December 2011, in the light of the opinion of the External Auditor (CM(2012)100), and accordingly adopted Resolution CM/Res(2012)35.

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.2Ah), the Deputies, in their composition restricted to representatives of the States members in 2011 of the Enlarged Partial Agreement establishing the European Centre for Modern Languages (Graz), approved the budgetary management accounts of this Partial Agreement for the year ended 31 December 2011, in the light of the opinion of the External Auditor (CM(2012)100), and accordingly adopted Resolution CM/Res(2012)36.

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.2Ai), the Deputies, in their composition restricted to representatives of the States members in 2011 of the Enlarged Partial Agreement on the "Group of States against Corruption - GRECO", approved the budgetary management accounts of this Partial Agreement for the year ended 31 December 2011, in the light of the opinion of the External Auditor (CM(2012)100), and accordingly adopted Resolution CM/Res(2012)37.

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.2Aj), the Deputies, in their composition restricted to representatives of the States members in 2011 of the Enlarged Partial Agreement on Sport (EPAS), approved the budgetary management accounts of this Partial Agreement for the year ended 31 December 2011, in the light of the opinion of the External Auditor (CM(2012)100), and accordingly adopted Resolution CM/Res(2012)38.

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.2Ak), the Deputies, in their composition restricted to representatives of the States members in 2011 of the Enlarged Partial Agreement on Cultural Routes, approved the budgetary management accounts of this Partial Agreement for the year ended 31 December 2011, in the light of the opinion of the External Auditor (CM(2012)100), and accordingly adopted Resolution CM/Res(2012)39.

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.1/Part1), the Deputies invited the GR-PBA to continue its discussions on the Programme and Budget 2012-2013 - adjustments to 2013.  They invited the Secretary General to present proposals for the use of the resources in the reserve for health cover and to report on the situation of special accounts, in particular in respect of unspent appropriations for activities which have ended, with a view to adopting the Budget.

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.1/Part2), the Deputies adopted Resolution CM/Res(2012)7 on the adjustment of the scale of contributions to the Extraordinary Budget, with effect from 1 January 2013.  Having regard to Resolution CM/Res(2011)30 which provisionally approved this budget for 2013, the Deputies approved the Extraordinary Budget for 2013, and consequently adopted Resolution CM/Res(2012)8.

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.1/Part3A), the Deputies, having regard to Resolution CM/Res(2011)31 which provisionally approved this budget for 2013, approved the Pensions Budget for 2013, and consequently adopted Resolution CM/Res(2012)9.

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.1/Part3B), the Deputies adopted Resolution CM/Res(2012)10 on the adjustment of the scale of contributions to the Pension Reserve Fund, with effect from 1 January 2013.  Having regard to Resolution CM/Res(2011)33 which provisionally approved this budget for 2013, the Deputies approved the Budget of the Pension Reserve Fund for 2013, and consequently adopted Resolution CM/Res(2012)11.  They agreed that the next actuarial study referred to in Article 3, paragraph 1b of the Statute of the Pension Reserve Fund should be advanced from 2014 to 2013 and carried out every four years thereafter and in addition whenever the Committee of Ministers deemed necessary, and consequently adopted Resolution CM/Res(2012)12 amending Article 3, paragraph 1b of the Statute of the Pension Reserve Fund of the Council of Europe (Resolution Res(2006)1).

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.1/Part4), the Deputies adopted Resolution CM/Res(2012)13 on the adjustment of the scale of contributions to the Budget of the European Youth Foundation, with effect from 1 January 2013.  Having regard to Resolution CM/Res(2011)34 which provisionally approved this budget for 2013, the Deputies approved the Budget of the European Youth Foundation for 2013, and consequently adopted Resolution CM/Res(2012)14.  

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.1/Part5), the Deputies, in their composition restricted to the representatives of the States Parties to the Convention on the Elaboration of a European Pharmacopoeia, approved the scale of contributions for 2013 and consequently adopted Resolution CM/Res(2012)15.  Having regard to the decision adopted at their 1127th meeting (22-24 November 2011) (cf. CM/Del/Dec(2011)1127/11.1/Part5), the Deputies approved the creation of 2 posts (1 L3, 1 B4) with effect from 1 January 2013.  Having regard to the decision adopted at their 1127th meeting (22-24 November 2011) (cf. CM/Del/Dec(2011)1127/11.1/Part5), the Deputies approved the Investment Programme for 2013 (Appendix 6 of CM(2012)130 rev) for a total of €2 025 000.  Having regard to Resolution CM/Res(2011)36 which provisionally approved this budget for 2013, the Deputies approved the Budget of the European Pharmacopoeia for 2013, and consequently adopted Resolution CM/Res(2012)16.

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.1/Part6), the Deputies, in their composition restricted to representatives of the States members of the Partial Agreement on the Council of Europe Development Bank, approved the scale of contributions for 2013 and consequently adopted Resolution CM/Res(2012)17.  Having regard to Resolution CM/Res(2011)38 which provisionally approved this budget for 2013, the Deputies approved the Budget of the Partial Agreement on the Council of Europe Development Bank for 2013, and consequently adopted Resolution CM/Res(2012)18.  They noted that the Governing Board might continue its discussions on the financing of the Secretariat of the Partial Agreement and should any relevant decisions be taken in that respect, the Deputies agreed to review, if so implied by the decisions, the level of contributions of member States for 2013.

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.1/Part7), the Deputies, in their composition restricted to the representatives of the States members of the Partial Agreement on the Co-operation Group to Combat Drug Abuse and Illicit Trafficking in Drugs (Pompidou Group), approved the scale of contributions for 2013 and consequently adopted Resolution CM/Res(2012)19, and agreed to suppress 1 A4 post and 1 B4 post with effect from 1 January 2013.  Having regard to Resolution CM/Res(2011)40 which provisionally approved this budget for 2013, the Deputies approved the Budget of the Partial Agreement on the Co-operation Group to Combat Drug Abuse and Illicit Trafficking in Drugs (Pompidou Group) for 2013, and consequently adopted Resolution CM/Res(2012)20.

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.1/Part9), the Deputies, in their composition restricted to the representatives of the States members of the Partial Agreement on the European Support Fund for the Co-production and Distribution of Creative Cinematographic and Audiovisual Works "Eurimages", having regard to Resolution CM/Res(2011)43 which provisionally approved this budget for 2013, approved the Budget of the Partial Agreement on the European Support Fund for the Co-production and Distribution of Creative Cinematographic and Audiovisual Works "Eurimages" for 2013, and consequently adopted Resolution CM/Res(2012)21. 

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.1/Part10), the Deputies approved the scale of contributions for 2013 for the Venice Commission and consequently adopted Resolution CM/Res(2012)22.  They approved, with effect from 1 January 2013, a rate of daily allowance of €175 for:
-           consultants, personalities and delegations from central and eastern European countries attending meetings held at the seat of the Commission in Venice and whose expenses are charged to the budget of the Enlarged Agreement;
-           members of the Commission on official journeys acting as rapporteurs at the request of the Commission and whose expenses are charged to the budget of the Enlarged Agreement.  The Deputies also approved, with effect from 1 January 2013, a rate of daily allowance of €240 for work at home for members of the European Commission for Democracy through Law (Venice Commission).  H
aving regard to Resolution CM/Res(2011)45 which provisionally approved this budget for 2013, the Deputies approved the Budget of the Enlarged Agreement on the European Commission for Democracy through Law (Venice Commission) for 2013, and consequently adopted Resolution CM/Res(2012)23.  

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.1/Part11), the Deputies, in their composition restricted to the representatives of the States members of the Partial Agreement on Youth Mobility through the Youth Card, approved the scale of contributions for 2013 and consequently adopted Resolution CM/Res(2012)24. Having regard to Resolution CM/Res(2011)47 which provisionally approved this budget for 2013, approved the Budget of the Partial Agreement on Youth Mobility through the Youth Card for 2013, and consequently adopted Resolution CM/Res(2012)25.  

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.1/Part12), the Deputies, in their composition restricted to the representatives of the States members of the Enlarged Partial Agreement on the European Centre for Modern Languages (Graz), approved the scale of contributions for 2013 and consequently adopted Resolution CM/Res(2012)26.  Having regard to Resolution CM/Res(2011)49 which provisionally approved this budget for 2013, the Deputies approved the Budget of the Enlarged Partial Agreement on the European Centre for Modern Languages (Graz) for 2013, and consequently adopted Resolution CM/Res(2012)27.

At their 1152nd meeting (10 October 2012) (CM/Del/Dec(2012)1152/11.3), in the light of the explanations given by the Office of the Commissioner for Human Rights, the Deputies agreed to unfreeze the appropriations in the programme line "Commissioner for Human Rights" of the Programme and Budget 2012-2013, i.e. €40 000 in 2012 and €40 000 in 2013.

At their 1147th meeting (4 and 6 July 2012) (CM/Del/Dec(2012)1147/11.2), the Deputies authorised, for 2012 only, the transfer of €300 000 from the budget head for judges' emoluments to the budget head for staff expenditure within the programme line of the European Court of Human Rights.

At their 1147th meeting (4 and 6 July 2012) (CM/Del/Dec(2012)1147/11.1), the Deputies approved the 2012 revised Budget of the Enlarged Agreement on the European Commission for Democracy through Law (Venice Commission) and, consequently, adopted Resolution CM/Res(2012)5.

At their 1138th meeting (28 March 2012) (CM/Del/Dec(2012)1138/11.2), the Deputies, in their composition restricted to the representatives of the States members of the Partial Agreement on the Co-operation Group to Combat Drug Abuse and Illicit Trafficking in Drugs (Pompidou Group), approved the 2012 revised budget of the Pompidou Group and, consequently, adopted Resolution CM/Res(2012)3.

 

Budget Committee

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.8), the Deputies took note of the meeting report of the September 2012 session of the Budget Committee (CM(2012)131).

At their 1152nd meeting (10 October 2012) (CM/Del/Dec(2012)1152/11.1), the Deputies took note of the meeting report of the May 2012 session of the Budget Committee (CM(2012)90).

At their 1138th meeting (28 March 2012) (CM/Del/Dec(2012)1138/11.5), the Deputies appointed Mr Vladimir IOSIFOV as member of the Budget Committee in respect of the Russian Federation and Mr Evgeny KALUGIN as his substitute until 31 December 2013, in accordance with the procedure for the appointment of the members of the Budget Committee.

 

Internal Audit

At their 1155th meeting (21 November 2012) (CM/Del/Dec(2012)1155/11.2), the Deputies invited the GR-PBA to follow the implementation of the External Auditor's recommendations.

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.6), the Deputies took note of the annual report for 2011 of the Audit Committee (CM(2012)126 and CM(2012)126 corr) and agreed to transmit it to the Parliamentary Assembly for information.

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.5), the Deputies took note, in the light of the extensive discussion in which widely diverging views were expressed, of the 2011 annual report of the Directorate of Internal Oversight (CM(2012)84). They agreed to examine the implementation of the Evaluation Policy in 2013, on the basis of a report to be prepared by the Secretary General in the light of the above-mentioned discussions.

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.2B), the Deputies agreed to hold a discussion on the External Auditor's report 2011 at one of their forthcoming meetings.

At their 1138th meeting (28 March 2012) (CM/Del/Dec(2012)1138/11.4), the Deputies took note of the report on the follow-up to the recommendations and of the 2012 work programme of the Directorate of Internal Oversight (CM(2012)8 and GR-PBA(2012)2 respectively), in the light of the discussions within the GR-PBA.

 

Co-ordinating Committee on Remuneration (CCR)

At their 1145th meeting (13 June 2012) (CM/Del/Dec(2012)1145/11.1), the Deputies adopted the remuneration adjustment procedure, as set out in Annex I and its relevant Appendices of the 211th report of the CCR (CM(2012)52).

The Deputies agreed to insert, under Article 8: Affordability of the procedure, some new provisions and agreed that this procedure shall replace the current procedure as from 1 January 2013.  They noted that decision number 2 above, relating to Article 8: Affordability of the procedure, would be applicable as from the salary adjustment for 2013.

At their 1145th meeting (13 June 2012) (CM/Del/Dec(2012)1145/11.2), the Deputies took note of the 2011 activity report of the CCR (CM(2012)57).

At their 1141st meeting (2 May 2012) (CM/Del/Dec(2012)1141/11.1), the Deputies took note of the 217th report of the CCR (CM(2012)58).  They agreed to give a favourable response to the request by the European Organisation for the Exploitation of Meteorological Satellites (EUMETSAT) to join the co-ordination system as a full member from 1 July 2012, subject to approval by the EUMETSAT Council of the remaining changes to its Staff Rules. Provided that all the co-ordinated organisations give a favourable response to the request by EUMETSAT to join the co-ordination system as a full member, the Deputies agreed to add the name of EUMETSAT to the list of co-ordinated organisations provided for in Article 1 of the Co-ordinated Pension Scheme Rules (Appendix V to the Staff Regulations), and to note that the consequences of this amendment will have effect only from EUMETSAT's date of accession.

At their 1138th meeting (28 March 2012) (CM/Del/Dec(2012)1138/11.3), the Deputies took note of the 216th report of the CCR (CM(2012)6 and CM(2012)6 corr).

The Deputies noted that, as a special adjustment, salary scales, as adjusted at 1 May 2011, will be increased by 6.2% for Turkey with effect from 1 December 2011 and, as this exceptional adjustment occurs after the end of the reference period for the annual adjustment at 1 January 2012, the salary scales for Turkey in the 213th report (CM(2011)156) will be adjusted in the same proportion with effect from 1 January 2012.  They also noted that by application of the 150th report by the CCG, dated 4 April 1978 (CCG(78)4), pensions will be increased in the same proportion and on the same date as the remuneration of the staff to whom this recommendation applies.  Finally, the Deputies noted that, in accordance with the interpretation given to paragraph 3 of the 34th report by the CCG (CCG(65)5), the remuneration of auxiliary staff serving in the co-ordinated organisations will be adjusted in accordance with the provisions of this report. 

At their 1135th meeting (22 and 23 February 2012) (CM/Del/Dec(2012)1135/11.3), the Deputies took note of the 214th report of the CCR (CM(2012)4) and approved, with effect from 1 January 2012, the amounts of the kilometric allowance, as they appear in that report.

Also at their 1135th meeting (22 and 23 February 2012) (CM/Del/Dec(2012)1135/11.4), the Deputies took note of the 215th report of the CCR on the revision at 1 January 2012 of the daily subsistence allowance for staff of the co-ordinated organisations (CM(2012)5).

They approved the new calculated rates for 16 countries which should be used for the adjustment of the rates at 1 January 2012 (see table 1 of the 215th report). They also approved the incorporation of the new daily subsistence allowance rates into the co-ordinated system for the two new member countries of the OECD as the basis for the rate adjustment at 1 January 2012 (see table 2 of the 215th report). The Deputies then approved the change of currency for the daily subsistence allowance rate for Mexico, from the US dollar to Mexican pesos, with effect from 1 January 2012 and approved the use of United Nations rates when official travel takes place in countries which are not member countries of the co-ordinated organisations.

The Deputies approved the new rates of the daily subsistence allowance, as set out in the tables which appear in the Annex to the 215th report, with effect from 1 January 2012. They noted that the daily subsistence allowance adjustment method and the parameters of the current procedure, as set out in the Annex to the 189th report, will be maintained pending the results of the programme of work for 2012, where this allowance will be analysed, and encouraged the CCR to achieve further savings in this respect.


Pensions

At their 1158th meeting (12-13 December 2012) (CM/Del/Dec(2012)1158/11.1), the Deputies adopted Resolution CM/Res(2012)46 amending Article 43 of the Staff Regulations, Resolution CM/Res(2012)47 amending Article 24 of the Staff Regulations and inserting a new Article 24 bis to the Staff Regulations, and Resolution CM/Res(2012)48 amending the Regulations instituting a Pension Scheme for specially appointed officials of the Council of Europe and a temporary retiring allowance. With a view to implementing the reform decided by the Committee of Ministers by 1 April 2013, the Deputies invited the CCR to expedite its work on this matter.

At their 1158th meeting (12-13 December 2012) (CM/Del/Dec(2012)1158/11.2a), the Deputies took note of the 218th report of the CCR (CM(2012)125). They adopted Resolution CM/Res(2012)49 amending Articles 18, 21, 22, 26, 28 and 32 of the Pension Scheme Rules (Appendix V to the Staff Regulations).

At their 1158th meeting (12-13 December 2012) (CM/Del/Dec(2012)1158/11.2b), the Deputies adopted Resolution CM/Res(2012)50 amending Articles 18, 21, 22, 26, 28 and 32 of the New Pension Scheme "NPS" (Appendix Vbis to the Staff Regulations).

At their 1149th meeting (12 September 2012) (CM/Del/Dec(2012)1149/11.3), the Deputies decided to nominate Mr Andranik Grigoryan, on the proposal of Armenia, to the Management Board of the Pension Reserve Fund, for a term of appointment of three years beginning 12 September 2012, in accordance with Article 5 of Resolution Res(2006)1.

At their 1147th meeting (4 and 6 July 2012) (CM/Del/Dec(2012)1147/11.3), the Deputies, in accordance with Article 5, paragraph 4 of Resolution Res(2006)1, approved the nomination of Ms Teresa Angela Sandri in Floridi as Chair of the Pension Reserve Fund Management Board.

The Deputies took note of the 1st report for 2012 of the Management Board of the Pension Reserve Fund to the Committee of Ministers (CM(2012)88), in the light of the discussions within the GR-PBA on 19 June 2012 (GR-PBA(2012)CB5).  They expressed concern about the performance of the Pension Reserve Fund and recalled their decision inviting the Management Board of the Pension Reserve Fund to review the general policies, goals and guidelines for investment of the assets of the Fund and make proposals with a view to enhancing the performance of the Fund (CM/Del/Dec(2012)1146/11.1).

At their 1146th meeting (20 June 2012) (CM/Del/Dec(2012)1146/11.1), the Deputies, underlining the need to substantially reform the pension system against the background of ageing societies and financial restraints, decided to create a Third Pension Scheme, with the following main features:
- the accumulation rate to be reduced to 1.75%;
- the minimum pension rate to be reduced to 1.75% of the salary for grade B3 step 1;
- the pensionable age to be raised to 65 years, with early retirement allowed from the age of 55 years, the latter being gradually raised to 60 years; early retirement is to be implemented in a way as to strictly ensure its cost-neutrality for all Council of Europe budgets, while taking into account also the need for effective management of human resources;
- the employee share of cost to be raised to 45% and the employer share of cost to be reduced to 55%, in order to maintain the parity with the level of contributions of staff members in the New Pension Scheme;[1]

as well as including additional saving measures as specified in paragraphs 18, 21, 22 and 25 of CM(2012)20 as follows:
- the reference salary to take no account of a promotion awarded during the last 24 months of service;
- pensions to be adjusted in line with inflation;
- other minimum rates, such as those applied to survivor's/reversion pensions and invalidity pensions, to be reviewed;
- a number of more minor points, such as entitlement to the education allowance for a pensioner who remains in the country of his/her last duty station or payment of a capital sum to the widow or widower of a staff member who remarries (and who thus loses all entitlement to a survivor's/reversion pension), to be reviewed;
and invited the Secretary General to undertake the necessary work without delay with a view to its application as from 1 January 2013.

The Deputies invited the Secretary General to include in the Third Pension Scheme a flexibility clause with a view to allowing for future modifications of contributions, benefits or other pension parameters, after consultations, within the Third Pension Scheme, thereby avoiding the necessity of introducing new pension schemes in the future, while respecting legal provisions applicable to the Council of Europe.

The Deputies decided to gradually raise the pensionable age from 63 to 65 years, as well as the early pension age from 51 to 53 years, for staff members in the New Pension Scheme (Appendix Vbis to the Staff Regulations), and invited the Secretary General to present proposals with appropriate transitional measures for its implementation.  They expressed their intention to increase the share of cost of Council of Europe staff members in the Co-ordinated Pension Scheme from 33.33% to 40% and invited the CCR to prepare, to this end, an amendment of Article 41 of the Pension Scheme Rules (Appendix V to the Staff Regulations) and expressed their commitment to supporting this measure in the framework of the CCR.

The Deputies decided that the Secretary General should be able to authorise, on a case-by-case basis and where duly motivated in the sole interest of the Organisation, the prolongation of service of a staff member up to the age of 67, without accruing any further pension rights, and invited the Secretary General to present the necessary draft amendments to the Staff Regulations to implement this decision.  They also decided to keep the matter under review and to assess the implementation of the reform, no later than the next actuarial study in 2014.

Having regard to their decision of 11-12 April 2012 (CM/Del/Dec(2012)1140/11.1b), the Deputies agreed to transfer €2 475 560 to the Pension Reserve Fund, in accordance with Article 3.1.e of its Statute (Resolution Res(2006)1) and invited the Management Board of the Pension Reserve Fund to review the general policies, goals and guidelines for investment of the assets of the Fund and make proposals with a view to enhancing the performance of the Fund.

At their 1145th meeting (13 June 2012) (CM/Del/Dec(2012)1145/11.5), the Deputies invited member States to submit, by 24 August 2012 at the latest, candidatures of specialists with expertise in the management of investment funds for the nomination of one member of the Management Board for a term of appointment of three years beginning on the day of appointment by the Deputies, in accordance with Article 5, paragraph 1.a of Resolution Res(2006)1.

At their 1141st meeting (2 May 2012) (CM/Del/Dec(2012)1141/11.4), the Deputies invited member States to submit, by 24 May 2012 at the latest, candidatures of specialists with expertise in the management of investment funds for the nomination of one member of the Management Board for a term of appointment of three years beginning on the day of appointment by the Deputies, in accordance with Article 5, paragraph 1.a of Resolution Res(2006)1.

At their 1140th meeting (11 and 12 April 2012) (CM/Del/Dec(2012)1140/11.1b), the Deputies took note of the sale of the B-Building for a net amount of €6 665 560 and agreed to allocate the net proceeds as follows:

- €4 190 000 to be used to finance the increase in member States' contributions to the Pension Reserve Fund for the biennium 2012-2013;

- €2 475 560 to be transferred to a suspense account pending further discussions on the reform of the Council of Europe's pension schemes.

At their 1138th meeting (28 March 2012) (CM/Del/Dec(2012)1138/11.8), the Deputies invited member States to submit, before 20 April 2012, candidatures of specialists with expertise in the management of investment funds for the nomination of one member of the Management Board for a term of appointment of three years beginning 24 May 2012, in accordance with Article 5, paragraph 1.a of Resolution Res(2006)1.  They also appointed Ms Ute Dahremöller, on the proposal of the Secretary General, as member of the Management Board of the Pension Reserve Fund for a term of three years beginning 24 May 2012, in accordance with Article 5, paragraph 1.b of Resolution Res(2006)1.

At their 1135th meeting (22 and 23 February 2012) (CM/Del/Dec(2012)1135/11.5), the Deputies took note of the 2nd report for 2011 of the Management Board of the Pension Reserve Fund to the Committee of Ministers (CM(2012)10), in the light of the discussions held in the GR-PBA on 16 February 2012.

At their 1131st meeting (18 January 2012) (CM/Del/Dec(2012)1131/11.2), the Deputies invited member States to submit, before 15 March 2012, candidatures of specialists with expertise in the management of investment funds for the nomination of one member of the Management Board in accordance with Article 5, paragraph 1.a of Res(2006)1, for a term of appointment of three years beginning 24 May 2012.  They also invited the Secretary General to submit, before 15 March 2012, the name of one person for nomination to the Management Board in accordance with Article 5, paragraph 1.b of Res(2006)1, for a term of appointment of three years beginning 24 May 2012.

Unpaid contributions

At their 1153rd meeting (24 October 2012) (CM/Del/Dec(2012)1153/11.7), the Deputies took note of the situation concerning unpaid contributions to the various budgets and funds of the Council of Europe as at 30 June 2012 (CM(2012)127), as well as the updated situation as at 4 October 2012 (CM(2012)127 add2). They invited the Secretary General to enter into contact with the competent authorities of the non member States with a view to ensuring that the necessary measures would be taken for their financial obligations to be honoured.

At their 1145th meeting (13 June 2012) (CM/Del/Dec(2012)1145/11.3), the Deputies took note of the situation concerning unpaid contributions to the various budgets and funds of the Council of Europe as at 17 February 2012 (CM(2012)18) and of the updated situation as at 9 May 2012 (CM(2012)18 add).  The Deputies invited the Secretary General to enter into contact with the competent authorities of the non-member States with a view to ensuring that the necessary measures would be taken for their financial obligations to be honoured and took note of member States' efforts to fulfil their financial obligations under the current economic difficulties.


Staff policy

At their 1134th meeting (15-16 February 2012) (CM/Del/Dec(2012)1134/11.1), the Deputies adopted Resolution CM/Res(2012)2 establishing Regulations for secondments to the Council of Europe.
