High-level Conference on the future of the European Court of Human Rights
(Interlaken, 18-19 February 2010) – Action to be taken

Decisions

The Deputies

1. agreed to set up an open-ended ad hoc working party to steer, under their authority, the follow-up process to the Interlaken Declaration as a whole (GT-SUIVI.Interlaken);

2. took note of the Secretary General’s document on the modalities of implementation of the Interlaken Declaration as a whole (document CM(2010)31) and invited the working party to take it into account in its work;

3. invited the working party to plan its work in such a way as to ensure that the deadlines set out in the Interlaken Declaration could be met and with due regard to the deadlines set in the initial ad hoc terms of reference given to the CDDH by Decision No. CM/880/10032010 adopted at their 1079th meeting
(10 March 2010);

4. invited the working party as a matter of priority to follow up the decision taken at their 1079th meeting (10 March 2010)1 to complete the examination of the existing proposals of the Steering Committee for Human Rights (CDDH) for measures that do not require amendment to the European Convention on Human Rights (ECHR) (document CM(2009)51 add final of 6 May 2009) as well as those appearing in the Interlaken Declaration with a view to submitting in due course possible draft decisions for the 120th Session of the Committee of Ministers (11 May 2010);

5. invited the working party to liaise closely with the Steering Committee for Human Rights (CDDH) as it discharged the terms of reference adopted at their 1079th meeting (10 March 2010) (CM/Del/Dec(2010)1079/1.6/appendix2) and to provide further guidance to the CDDH as and when necessary;

6. invited the working party to work in close co-operation with the Liaison Committee with the European Court of Human Rights (CL-CEDH) as regards the measures contained in the Interlaken Declaration to be implemented by the Court;

7. agreed that delegations may be assisted by experts from capitals at the meetings of the working party;

8. agreed that the Parliamentary Assembly, the Court, the Commissioner for Human Rights and other Council of Europe bodies may be invited to participate in meetings of the working party, as appropriate;

9. agreed that the present mandate would expire on 30 June 2012.
