5.    LeThe CEPEJ-GT-MED salutes ( ?) welcomed the finalised version of the report concerning the evaluation of the iImpact of the Recommendations of the Council of Europe in the field of mediation matters and gives thanksed to its author, Mr. Julien LHUILLIER, rResearcher (research fellow/ worker) at the Law faculty of Nancy, for introducipresenting to the Working group with such a complete view on mediation in some about fifteen Mmember Sstates.

salue la version finalisée du rapport concernant l’évaluation de l’impact des Recommandations du Conseil de l’Europe en matière de médiation et remercie son auteur, M. Julien LHUILLIER, Chercheur à la Faculté de droit de Nancy, d’avoir ainsi fourni au Groupe de travail un panorama très complet de la médiation dans une quinzaine d’Etats membres.

 

6.    This Report analyses, for each of the four Recommendations on mediation, their impactits impact at a national level, and includes specific proposals for the improving ement of the visibility of the texts and the implementation of the principles of mediation principles that they includecontained in them.

Ce Rapport analyse, pour chacune des quatre Recommandations concernant la médiation, leur impact au niveau national et contient des propositions concrètes pour améliorer la visibilité des textes et la mise en œuvre des principes concernant la médiation figurant dans les textes.

7.    The group considersed that this Report could be very useful to all the actors involved in the mediation process in Europe and proposesd to refer submit it to the CEPEJ in view of its for publicationishing.

1.        Le Groupe estime que ce Rapport pourrait être très utile à l’ensemble des acteurs de la médiation en Europe et propose de le soumettre à la CEPEJ pour publication.

III.           III.  Finalisation of the draft guidelines for the improvement ofing the application of the existing Recommendations on mediation

du projet de lignes directrices visant à améliorer la mise en œuvre des    Recommandations existantes en matière de médiation

8.    TheLe CEPEJ-GT-MED  remindsed that, in order to fulfil accomplish successfully the the tasks conferred upon it given by the CEPEJ, it hasd considered appropriate : rappelle que, pour mener à bien la tâche qui lui a été confiée par la CEPEJ, il a estimé opportun :

§  to prepare the guidelines which could offer national authorities in charge of mediation, as well as the other actors of the mediation process, specific measures enabling them to resolve the possible difficulties arising from the application of the provisions of the relevant Recommendations concerned, namely because of their general character (nature);

§de préparer des lignes directrices destinées à offrir aux autorités nationales en charge de la médiation, ainsi qu’aux divers acteurs de la médiation, des mesures concrètes permettant de résoudre des éventuelles difficultés d’application des dispositions contenues dans les Recommandations concernées, en raison notamment de leur caractère trop général ;

§  given the specific nature of the issues at stakefields in question (namely, family mediation and mediation in civil matters, mediation in criminal matters and mediation in administrative matters), and in as much as the instruments willould  be used separately, to prepare three different documents for each of the relevant mediation fields;

§compte tenu de la spécificité des domaines concernés  (à savoir la médiation civile et familiale, la médiation pénale et la médiation en matière administrative), et dans la mesure où il s’agit d’outils qui seront utilisés séparément, de préparer trois documents distincts pour les trois domaines de médiation ;

§  to remind of the difficulty in in laying out defining clear provisions on mediation, capable of being that could be used by all Mmember Sstates, due to the significant disparities which exist between mMember sStates as regards concerning the development of mediation.

 Guidelines in civil and family matters

9.    The Working group examinesd the draft guidelines for a better application of the recommendations on mediation in civil matters (CM/Rec(2002)10) and on family mediation (CM/Rec(98)1), which itwere prepared at its second meeting (20-22nd November 2006) and on which were it worked on between both the two meetings.

1.        Le Groupe de travail examine le projet de lignes directrices visant à une meilleure application des Recommandations sur la médiation en matière civile (CM/Rec(2002)10) et sur la médiation familiale (CM/Rec(98)1), qu’il a préparé lors de sa 2^ème réunion (20-22 novembre 2006) et sur lequel il a travaillé entre les deux réunions.

10.  The section concerning the child’s welfare and best interests hasd drawn particular attention, in particular more specificly, as regards the ways for possible modes of a possible auditioning hearing of the child during the mediation procedure.

La partie concernant l’intérêt supérieur de l’enfant fait l’objet d’une attention particulière, en particulier les modalités de l’audition éventuelle de l’enfant lors de la procédure de médiation.

Draft guidelines in criminal matters

Lignes directrices en matière pénale

11.  The Working group examinesd the draft guidelines for a better application of the Recommendation in criminal matters (CM/Rec(99)19) which hasd been devised drafted by Mr. J. LHUILLIER following the 2^nd meeting of CEPEJ-GT-MED.

1.        Le Groupe de travail examine le projet de lignes directrices visant à une meilleure application de la Recommandation en matière pénale (CM/Rec(99)19) qui a été préparé par M. J. LHUILLIER suite à la 2^ème réunion du CEPEJ-GT-MED.

12.  The draft hasd also been extensively commented on by Mrs. A. WERGENS who suggestsed to pay particular attention to victims’ rights and interests in the mediation procedure. The Group acknowledged recognises that Mmember Sstates haved adopted various interpretations concerning mediation in civil matters and that there was a trend in traditional justice systems tend to focus place emphasis on offenders’ punishment rather than on victims’ interests. Thus, it hasd been decided to use the expression “victim-offender mediation” rather than “penal mediation”.  

1.        Le projet a également été commenté en détail par Mme A. WERGENS qui suggère notamment de porter une attention particulière aux droits et intérêts des victimes dans la procédure de médiation. Le Groupe reconnaît que les Etats membres ont adopté diverses interprétations s’agissant du domaine de la médiation en matière pénale et que les systèmes judiciaires traditionnels tendent à se focaliser sur la punition des délinquants plutôt que sur les intérêts de la victime. Il est ainsi décidé d’utiliser l’expression « médiation victime-délinquant »au lieu de celle « médiation pénale ».  

13.  Mrs. A. WERGENS also suggestsed to modify the structure proposed (Availability/Accessibility/ Awareness) by adding specific sections concerning “the general principles of the mediation procedure” and “the quality of mediation”.  

1.        Mme A. WERGENS propose également de modifier la structure proposée (Disponibilité/Accessibilité/Sensibilisation) en ajoutant notamment des sections spécifiques concernant « les principes généraux de la procédure de médiation » et « la qualité de la médiation ».

14.  The CEPEJ-GT-MED pinpointsed that, if it were to decide to modify the structure, it would, in all logic, also be necessary to do so with the guidelines in civil and family matters, whose initial structure was established specificlyspecifically and which doesid not necessarily require a reconsideration. Nevertheless, the Group puts entrusted Mrs. A. WERGENS in charge of to prepareing written suggestions for a new structure applicable to all three draft guidelines., tThe Group would then have to take a decision in writing after the meeting.    

1.        Le CEPEJ-GT-MED fait valoir que s’il décidait de modifier ainsi la structure, la logique voudrait d’en faire autant pour les lignes directrices en matière civile et familiale pour lesquelles la structure initiale a été spécifiquement élaborée et qui ne nécessite pas forcément une remise en cause. Le Groupe de travail charge Mme A. WERGENS de proposer néanmoins par écrit une nouvelle structure applicable aux trois projets de lignes directrices, à charge pour le Groupe de prendre une décision après la réunion par procédure écrite.

 

Lignes directrices en matière administrativeDraft guidelines in administrative matters

15.  The Working group examineds the draft guidelines for a better application of the Recommendation on the techniques of alternative dispute resolution between administrative authorities and private persons (CM/Rec(2001)9), prepared by Mrs. Maria OLIVEIRA (Portugal) following the 2nd meeting ofCEPEJ-GT-MED.

1.        Le Groupe de travail examine le projet de lignes directrices visant à une meilleure application de la Recommandation sur les modes alternatifs de au règlement des litiges entre les autorités administratives et les personnes privées (CM/Rec(2001)9),  qui a été préparé par Mme Maria OLIVEIRA (Portugal) suite à la 2^ème réunion du CEPEJ-GT-MED.

16.  The CEPEJ-GT-MED adoptsed a certain number of amendments to the three draft guidelines and agreedconvenes to finalise them in writing. It also agreed  as well as athat an informal meeting which could be organised in Vilnius for between theose members of the group, who willouldparticipate in the Conference on mediation (see paragraph 27 below).

1.        Le CEPEJ-GT-MED adopte un certain nombre d’amendements pour les trois projets de lignes directrices et convient de les finaliser par procédure écrite ainsi que lors d’une réunion informelle qui pourra être organisée à Vilnius entre les membres du groupe qui assisteront à la Conférence sur la médiation (voir paragraphe …27 ci-dessous).

17.  All three draft guidelines shall be submitted referred to the CEPEJ for adoption at its 9^th Plenary meeting (Strasbourg, 13-14^th June 2007).

1.        Les trois projets de lignes directrices seront soumis à la CEPEJ pour adoption lors de sa 9^ème réunion plénière (Strasbourg, 13-14 juin 2007).

18.  Concerning the 3rd and final meeting of the CEPEJ-GT-MED, its the members give thanksed to the CEPEJ for the its trust it has placed upon them and declared their readiness to pursue and enhance its work on mediation, which is  in a field where the drafting of specific norms of direct application by all actors in the mediation process, in all mMember sStates, seemsed  particularly necessary.   

1.        S’agissant de la 3^ème et dernière réunion du CEPEJ-GT-MED, ses membres remercient la CEPEJ pour la confiance qui leur a été accordée et font part de leur disponibilité à poursuivre et à approfondir ses travaux en matière de médiation dans un domaine où l’édiction de normes concrètes et directement applicables par l’ensemble des acteurs de la médiation, dans l’ensemble des Etats membres, s’avère particulièrement nécessaire.

19.  The Working group also reiteratesd its proposal to create a Task-Force in charge of assisting the persons concerned by the mediation process in applying the existing texts and principles. This could imply putting the setting up of in place a help-line, a newsletter or a dialogue box through which the members of the Working group could assist mediation actors in transforming the general principles of mediation in specific measures of direct application. Finally, Tthe CEPEJ-GT-MED wishes to highlighted underline (insists on) one of the guidelines it has put in place, which addressesevokes the creation of a separate page on mediation on the website of the CEPEJ.   

1.        Le Groupe de travail réitère également sa proposition de créer une Task-Force chargée d’aider les personnes concernées par la médiation à mettre en œuvre les textes et principes existants. Il pourrait s’agit d’une help-line, d’une newsletter, d’une boite de dialogue par lesquelles les membres du Groupe de travail pourraient aider les acteurs de la médiation à transformer les principes généraux de la médiation en mesures concrètes directement applicables. Le CEPEJ-GT-MED tient enfin à mettre l’accent sur l’une des lignes directrices qu’il a énoncé, suscitant la création, sur le site internet de la CEPEJ, d’une page spécifique sur la médiation.

IV.  IV.        Adjustment of the « Mediation » section of the CEPEJ's scheme for evaluationg of judicial systems

20.  At its 7^th meeting (29 – 31st January 2007), the Working group of the CEPEJ for the evaluation of judicial systems (CEPEJ-GT-EVAL) suggested that the CEPEJ-GT-MED, following an analysis of the replies to the mediation questionnaire on mediation, should make proposals for the “Mediation” section of the scheme for the evaluationg of judicial systems.

1.        Le Groupe de travail de la CEPEJ sur l’évaluation des systèmes judiciaires (CEPEJ-GT-EVAL), lors de sa 7^ème réunion (29 – 31 janvier 2007) a proposé que le CEPEJ-GT-MED, suite à l’analyse des réponses au questionnaire sur la médiation, fasse des suggestions sur la partie « Médiation » du questionnaire sur l’évaluation des systèmes judiciaires.

21.  Due to the lack of sufficient time to deal with this question at the meeting, it puts entrusted its the Secretariat in charge of to submitting proposals which willould then be examined through a in written procedureedings by the members of the CEPEJ-GT-MED.

1.        En l’absence de temps suffisant pour traiter de cette question lors de la réunion, il charge son secrétariat de faire des propositions qui seront étudiées par procédure écrite par les membres du CEPEJ-GT-MED.

V.   Elaboration d’unof a document contenantaining des suggestions concernantfor laa possible  reévision        éventuelle desof the  

existing recommeandations existantes en matière de médiationon mediation

22.  The report concerning the evaluation of the impact of the Recommendations of the Council of Europe on mediation containsed, for each of the Recommendations concerned, proposals for the improvementing of the implementation of the mediation principles which were included they affirm. These proposals implyied certain amendments to the text of these Recommendations.   

1.        Le rapport concernant l’évaluation de l’impact des Recommandations du Conseil de l’Europe en matière de médiation contient, pour chacune des Recommandations concernées, des propositions pour améliorer la mise en œuvre des principes concernant la médiation qui y sont contenus. Ces propositions impliqueraient certains amendements au texte des Recommandations.

23.  The Working group examinesd the opportunity to prepare a document providing a summary of all the amendment proposals for amendment that the CEPEJ could decide to refer submit to the attention of the European Committee on LegalCooperation (CDCJ), which is responsible for a possible revision of the Recommendations on mediation.

1.        Le Groupe de travail examine l’opportunité de préparer un document rassemblant ces propositions d’amendementsn, que la CEPEJ pourrait décider de soumettre à l’examen du Comité de Coopération juridique (CDCJ) chargé d’une éventuelle révision des Recommandations en matière de médiation.

24.  The Group underligneds that the report impact evaluationg the impact report concontainsned notes and suggestions which implyied the direct participation of national judicial systems and which required, therefore, a careful consideration by Mmember Sstates. In addition, the guidelines drafted by the CEPEJ-GT-MED weare likely, if they are used in the sStates, to encourage the evolution of mediation procedures in Europe. At this stage, the Working group considersed it is preferable to solely publish solely the Evaluation report and the guidelines and proposeds to the CEPEJ to reconsider the question of possible proposals of amendments to the Recommendations in three years, in the light of Sstates’ reaction to the documents already produced by the CEPEJ-GT-MED.    

1.        Le Groupe note que le rapport d’évaluation d’impact contient des remarques et suggestions impliquant directement les systèmes judiciaires nationaux, qui nécessitent de ce fait une lecture attentive par les Etats membres. En outre, les lignes directrices élaborées par le CEPEJ-GT-MED sont susceptibles, si elles sont utilisées au sein des Etats, de faire évoluer les procédures de médiation en Europe. Le Groupe de travail estime donc préférable, à ce stade, de ne publier que le Rapport d’évaluation et les lignes directrices et propose à la CEPEJ de reconsidérer la question d’éventuelles propositions d’amendements aux Recommandations dans trois ans, à la lumière des réactions des Etats sur les documents déjà produits par le CEPEJ-GT-MED.

VI.  Analysis of the work of the other institutions on concerning a possible mediation and possible cooperation

Analyse des travaux des autres institutions concernant la médiation et coopération  possible

25.  Given the close relationship between the work of the European Union and the Council of Europe in the field of mediation, the CEPEJ-GT-MED regretsted that the European Union was not able to participate in its activities at the 2^nd and 3^rd meetings.

1.        Compte tenu de la connexité des travaux de l’Union européenne et du Conseil de l’Europe concernant la médiation, le CEPEJ-GT-MED regrette le fait que l’Union européenne n’ait pu participer à ses travaux lors des 2^ème et 3^ème réunions.

26.  The working group pinpointsed certain guidelines which it hasd established and which contained proposals forcooperation between both institutions on some aspects of mediation.  

1.        Le groupe de travail attire l’attention sur certaines lignes directrices qu’il a élaborées et qui contiennent des propositions de coopération, sur certains aspects de la médiation, entre les deux institutions.

Conference on mediation (Vilnius, 24-25^th May 2007)

27.  The President of the Working group giaves details about the Conference which is would to take place in Vilnius (Lithuania) on 24 and 25 May 24^th and 25^th 2007 on the topic “Mediation in Europe: present challenges and future developments”. This Conference iwas organised by the Ministry of Justice of Lithuania, the Vilnius Law Faculty and the a law firmNorcous and Partners. The Council of Europe also assists with supported the organisation of this Conference by financing the participation of three members of the CEPEJ-GT-MED and of theascientific expert.

1.        Le Président du Groupe de travail donne des précisions sur la Conférence qui se tiendra à Vilnius (Lituanie) les 24 et 25 mai 2007 sur le thème « La médiation en Europe : défis actuels et développements futurs ». Cette Conférence est organisée par le Ministère de la justice de Lituanie, la Faculté de droit de Vilnius et le cabinet d’avocats Norcous & Partners. Le Conseil de l’Europe coopère également à l’organisation de cette Conférence en finançant la participation, en tant que rapporteur, de trois membres du CEPEJ-GT-MED et de l’expert scientifique.

28.  The Director of Cooperation at the Directorate General for Legal aAffaires shall would open the Conference with in the presence of the Lithuanian Minister of Justice. The Secretariat Le Directeur de la Coopération à la Direction Générale des Affaires juridiques ouvrira la Conférence en présence notamment du Ministre lituanien de la Justice. Le Ssecrétariat is would also to go travel to Vilnius in order so as to allow the present members of the CEPEJ-GT-MED to finalise the work underway(undertaken).

29.  The CEPEJ-GT-MED suggestsed that Mrs. Maria OLIVEIRA shwould represent the CEPEJ-GT-MED at the abovementioned Conference organised by the Council of Europe.

30.  The Secretariat wishes to informed the working group that the theme of the 27th Conference of European Ministers of Justice, which willould be held in Lanzarote (Spain) next Ooctober, is, would include among others, the issue problem of mediation as a key element of access to justice.
