DRAFT MEETING REPORT
23 March 2009
1. Opening of the meeting by the Secretariat
Mr Auke van der Goot, Chair of the LR-IC Committee, opened the meeting and welcomed participants (see list of participants in Appendix I).
2. Adoption of the agenda
The agenda, as set out in Appendix II, was adopted.
3. Draft Third Protocol to Madrid Outline Convention
i) Parliamentary Assembly and Congress opinions
The Chair gave the floor to the representatives of the Parliamentary Assembly of the Council of Europe and the Congress of Local and Regional Authorities of the Council of Europe, whose forthcoming opinions would be an important part of the procedure prior to adoption of the Third Protocol by the Committee of Ministers.
The Congress representative informed the Committee that their opinion would be adopted on 15 May by the Institutional Committee, and then by the Standing Committee on 9 June. The Parliamentary Assembly representative outlined the Assembly’s approach to the Third Protocol, and informed the Committee that their opinion would also be adopted some time in June.
ii) Introductory comments on the Third Protocol
Some of the delegations from EU member states were wary of adopting a second instrument in this field, when they were already experiencing problems with the EC Regulation 1082/2006. The Congress representative reassured members, however, that in its study to compare both instruments, it had concluded that if adopted, the Third Protocol would solve the implementation problems of EC Regulation 1082/2006.
The Chair added that to not adopt at this stage would deprive non-EU member states of Council of Europe of the legal basis for co-operation groupings, and Russia and Ukraine had already stated quite clearly they very much needed a legal instrument in this field.
iii) Explanatory report
The Secretariat explained that any convention submitted by a Steering Committee to the Committee of Ministers must be accompanied by an explanatory report. The comments as they currently stood would become the Explanatory Report, but Committee members would be invited to choose whether they wanted to keep the comments explaining the interaction between the CoE and EC instruments, or whether they would prefer a more simplified version.
iv) Comments on the Articles
An in-depth discussion was subsequently held on the Articles. A number of concerns were raised and proposals for amendment were put forward. The draft third protocol, as amended accordingly, appears in document CDLR(2009)9.
v) Procedure before submitting the text to the CDLR
It was agreed that any additional proposals Committee members would like to make to the text should be sent to the Secretariat and to other Committee members by 27 March at the latest.
The Secretariat would send the revised text and the Explanatory Report to Committee members by 8 April.
The text would then be discussed at the CDLR meeting in April, with a view to this Committee adopting it.
4. Date of the next meeting
The date of the next meeting would be decided by the CDLR at its meeting in April, since work on other aspects of the LR-IC’s activities was still in progress.
