Introduction

As agreed by the CDLR at its meeting in December 2008, the LR-IC and LR-GG Committees are to meet together on Tuesday 10 February in order to take further the preparations for the Utrecht session of the Ministerial conference which will be held on 16-17 November 2009.

The draft agenda for the 16th session, prepared by the Dutch CDLR delegation in consultation with the Secretariat, appears at Appendix 1.

A draft for the programme of the 16th session will be prepared and presented in time for the CDLR meeting in April. This document will also contain suggestions as to the item on the agenda for which one or more introductions by ministers might be envisaged.

The following items of the proposed agenda require particular attention at this stage.

Item 4:  Implementation of the Budapest Agenda by the Council of Europe and by member States

It is proposed that the Secretariat prepare for the CDLR meeting in April a first draft of the report to Ministers on the work carried out by the CDLR under the Budapest Agenda. No questionnaire is needed for that.

Furthermore it is proposed to take stock of the actions undertaken by member States along the same lines as was done for the Valencia Ministerial session in 2007. A draft for the questionnaire appears at Appendix 2. The deadline for reply is proposed for 30 April 2009.

Finally, stock needs also to be taken of the steps taken by members States in respect of the follow-up given to the Council of Europe’s acquis. The draft for this questionnaire appears at Appendix 3, including the proposal of the same deadline of 30 April 2008

Item 5: Strategy for innovation and good governance at local level

A report will be prepared by the Stakeholders’ Platform to enable ministers to take stock of developments since the Valencia Ministerial session and to give further guidance.

Item 6: The Kiviniemi report on the outlook for the future

Minister Kiviniemi’s report will be finalised shortly. The Utrecht Declaration will no doubt address the proposals from her report (see below).


Item 8 and 9: Good governance at local and regional level, challenges and possible actions - Transfrontier co-operation: challenges and possible actions 

These two items of the agenda concern the two substantive themes of the session. It is proposed that Ministers deal with them from two distinct perspectives: outlook and exchange of practice and experience, corresponding to two different moments in the programme to come. “Outlook” means looking to the future, discussing the issues and challenges ahead that Ministers have identified in their own countries. The discussion will enable Ministers to contribute and exchange points of view prior to the adoption of the new Utrecht Agenda, which will succeed the Budapest Agenda (2005-2010) (see item 10 below).

Information about the current priorities of member States is already available through the questionnaire on “Frontline issues of change”. As a first step member States that have not yet done so could be invited to fill-in the questionnaire and others that so wish could provide new information. A second step would be to ask supplementary questions on the challenges member States face in the field of local and regional democracy. Drafts for the questionnaires appear as appendices 4 and 5.

Item 10: Adoption of the Utrecht Agenda

The Ministers are expected to adopt a new medium-term agenda to succeed the Budapest Agenda adopted in 2005. The overall objective of “delivering good local and regional governance” remains valid, but no doubt a fresh look is necessary following the five years of work under the Budapest Agenda. The proposed approach is for Ministers at the session itself to express their views on the challenges, actions and priorities to be included in the new Utrecht Agenda. Thus, it is not proposed to present Ministers with a fully prepared agenda to which they can but say yes or no, but to present them with a range of challenges and actions on which they can express themselves by attributing points to those that they consider most important.

This exercise would not be dissimilar to the one organised prior to the Valencia session where delegations were invited to distribute a total of 100 points over different themes and challenges in order to express their priorities. However, in this case the exercise is to be carried out by the Ministers themselves at the session itself, possibly through a system of electronic voting. The Utrecht Agenda would thus be the result of direct ministerial choice, giving it real political credibility and legitimacy.

The discussions under agenda items 8 and 9 would provide the opportunity for Ministers to debate the range of challenges between which they are to choose under the current agenda item.

The results to the questionnaires mentioned under agenda items 8 and 9 should provide the basis for drawing up the menu of challenges and actions from which Ministers are to choose. In the light of these results it may be decided whether it is nonetheless still necessary to launch a further questionnaire to member States.


Item 13: European Local Democracy Week

A report for Ministers will be prepared by the Secretariat.

Items 13, 14 and 15: European Local Democracy Week - Good governance at local and regional level in the 21st century: Exchange of practice and experience - Transfrontier Co-operation: Exchange of practice and experience

Under these three items of the agenda the ELDW and the two main themes of the session are taken up from the perspective of exchanging between Ministers practice and experience.

Item 17: Adoption of the Utrecht Declaration and final resolution

As has been the case in previous sessions, it is proposed that the final declaration will consist of several parts, each relating to one of the major agenda items, including the new Utrecht Agenda.

A first outline could be presented and discussed at the CDLR meeting in April and be developed over subsequent meetings.

Action required

The LR-IC and LR-GG Committees are invited to decide jointly on the preparations for the 16th session of the Ministerial Conference on the basis of the elements provided above, making any changes they deem appropriate. Thus, they are invited to adopt the questionnaires proposed, making any changes they deem necessary, and to set the dead-lines for reply. The Committees are also invited to agree that the  questionnaires, thus adopted, are to be sent out as soon as possible after their Joint meeting.

By doing so they may refer to the replies given during the equivalent survey that was undertaken in 2007 with regard to the interim review of the Budapest Agenda and the report presented to ministers at their 15th session in Valencia. The question of the importance of the Council of Europe’s acquis in a given field of action (theme) has been added since the last exercise.
