1. Pension Reserve Fund – 2nd report for 2009 of the Management Board to the Committee of Ministers
(CM(2009)179 rev)

1.1. In accordance with Article 4.72 of the Statute of the Pension Reserve Fund of the Council of Europe (Resolution Res(2006)1), the Management Board has submitted – for 2009 – its second report on the status of the fund to the Committee of Ministers in document CM(2009)179 rev.

1.2. The group is invited to examine this item with a view to recommending that the Deputies take note of the report at their 1077th meeting 24 February 2010) without further debate.

2. “Congress resources and its 2010 budget” – Recommendation 267 (2009) of the Congress of Local and Regional Authorities of the Council of Europe – draft reply
(Congress REC_267 (2009) and CM/Cong(2009)Rec267 prov)

2.1. The group is invited to examine the draft reply (cf. CM/Cong(2009)Rec267 prov) to the above mentioned recommendation with a view to recommending to the Deputies its adoption without further debate.

3. Co-ordinating Committee on Remuneration (CCR) – Revision at 1 January 2010 of the daily subsistence allowance for staff of the co-ordinated organisations – 200th Report
(CM(2009)178)

3.1. The CCR has issued in its 200th report the rates of the daily subsistence allowance for staff on official journeys proposed from 1 January 2010. They have been calculated in accordance with the provisions of the CCR’s 189th Report (CM(2008)149). A table comparing the new rates with 2009 is set out, for information, in document GR-PBA(2009)22. The group is invited to examine this item with a view to recommending to the Deputies the adoption, without further debate, of the following draft decisions:

    The Deputies

    1. took note of the 200th report of the Coordinated Committee on Remuneration (CCR) on the revision at 1 January 2010 of the daily subsistence allowance for staff of the co-ordinated organisations, as it appears in document CM(2009)178;

    2. approved, with effect from 1 January 2010, the rates of the daily subsistence allowance, as they appear in the tables appended to that report;

4. Co-ordinating Committee on Remuneration (CCR) – Review at 1 January 2010 of the amounts of the kilometric allowance for staff of the co-ordinated organisations – 199th Report
(CM(2009)177)

4.1. The 199th report sets out, with effect at 1 January 2010, the new amounts for the kilometric allowance payable to staff members who, in the interest of the Organisation, have been authorised to travel on duty in their own cars. The budgetary impact (negligible) of the adjustment will be covered by the appropriations already approved in the 2010 budgets. The group is invited to examine this item with a view to recommending to the Deputies the adoption, without further debate, of the following draft decisions:

    The Deputies

    1. took note of the 199th report of the Co-ordinating Committee on Remuneration (CCR), as it appears in document CM(2009)177;

    2. approved, with effect from 1 January 2010, the amounts of the kilometric allowance, as they appear in that report.

5. Co-ordinating Committee on Remuneration (CCR) – co-ordination: 2009 activity report (Report by the Chairman, Mr Hans Stefan Kruse)
(CM(2010)6)

5.1. This report summarises activities carried out in the framework of the CCR in 2009. During the year the CCR made a number of recommendations concerning mainly the adjustment of remuneration scales for 2010, the method for calculating the rate of contribution to the Pension Scheme and its adjustment at 1st January 2010, special adjustment of remuneration during the course of the year for certain countries, adjustment of the rates of daily subsistence allowance for 2010 and the granting of observer status in the co-ordination system to EUMETSAT. The programme of work of Co-ordination for 2010 will focus on modernising the co-ordinated salary structure and also on revising the salary adjustment method, building on preparatory work carried out in 2009.

5.2. The GR-PBA is invited to examine this item with a view to recommending to the Deputies the adoption, without further debate, of the following draft decision:

      The Deputies took note of the 2009 activity report of the Co-ordinating Committee on Remuneration (CCR), as it appears in document CM(2010)6.

6. Staff Regulations
Modification of Appendix Vbis – New Pension Scheme “NPS”, Article 7 “Conditions of entitlement”
(CM(2009)196)

6.1. The Secretary General proposes in document CM(2009)196 to amend the New Pension Scheme rules to correct an inconsistency which would prevent recognition of the years of service of staff recruited from one of the co-ordination organisations, namely the European Centre for Medium-Range Weather Forecasts (ECMWF). The recognition of these rights would be accompanied by the payment of a sum that corresponds to the recognised rights, so the measure would be budgetary neutral. To date, no Council of Europe staff members have been recruited from the ECMWF. The latter has likewise amended its staff regulations.

6.2. The group is invited to consider this item with a view to recommending to the Deputies the adoption, without further debate, of the following draft decisions:

      The Deputies

      1. adopted Resolution CM/Res(2010)… amending Article 7 of the New Pension Scheme “NPS” (Appendix Vbis to the Staff Regulations), as it appears at Appendix … to the present volume of Decisions;

      2. decided that it would enter into force on the date of its adoption and invited the Secretary General to inform Council of Europe staff of the relevant amendments to the Staff Regulations.

7. Other business

The Chair intends to raise the question of the budgetary process for 2011.

Appendix

Draft Resolution CM/Res(2010)…
amending Article 7 of the New Pension Scheme “NPS” (Appendix Vbis to the Staff Regulations)

at the … meeting of the Ministers’ Deputies)

The Committee of Ministers, in accordance with Article 16 of the Statute of the Council of Europe,

Having regard to the New Pension Scheme “NPS” (Appendix Vbis to the Staff Regulations);

Having regard to the technical opinion of the Pensions Administrative Committee of the Co-ordinated Organisations (PACCO) on an amendment to the NPS (CM(2009)196);

Considering that, further to this technical opinion, it is expedient to make an amendment to Article 7 of the NPS;

On a proposal of the Secretary General;

Resolves as follows:

1. The first paragraph of Article 7 shall be numbered paragraph 1;

2. a paragraph worded as follows shall be added after the first paragraph of Article 7 of the NPS:

“2. For the implementation of the condition of length of service referred to in paragraph 1 above, periods of service in respect of which contributions to the Defined Benefit Funded Pension Scheme of the ECMWF have been paid and for which the staff member has benefited from an inward transfer of pension rights, under the provisions laid down in Article 12, paragraph 1 and its implementing instructions, shall also be taken into account.”
