European Committee on Legal Co-operation (CDCJ) – Freedom of movement between the Council of Europe member states
At their 920th meeting (23 March 2005, item 10.1, CM/Del/Dec(2005)920/10.1), the Deputies:
1. authorised the publication of the Report on “Good practices relating to the movement of persons between the Council of Europe member states” prepared by the European Committee on Legal Cooperation (CDCJ) in accordance with Decision No. CM/863/05052004 of the Committee of Ministers adopted at the 883rd meeting of the Ministers' Deputies on 5 May 2004 (CM(2004)224 revised);
2. instructed the Secretariat to transmit the Report referred to above to the European Commission and the Council of the European Union for information;
3. invited the member states to disseminate the Report referred to above to their competent authorities in the field of visas, migration and border control;
4. noting that the idea of updating the above-mentioned Report at regular intervals had received wide support in its Rapporteur Group on Legal Cooperation (GR-J), instructed the GR-J to resume consideration of the issue of freedom of movement after the Third Summit of Heads of State and Government (Warsaw, 16-17 May 2005), in the light of any decisions to be taken at the Summit.
It is recalled that under Chapter 4 “Ensuring compliance of the commitments made by member states and promoting political dialogue”, the Action plan adopted at the Third Summit (CM(2005)80 final), provides that:
“To this end [building Europe without dividing lines], the Council of Europe, in co-operation with the European Union, will continue to promote the exchange of good practices as far as free movement of persons is concerned, with a view to further improving contacts and exchanges between Europeans throughout the continent.”
At the GR-J’s meeting on 9 June 2005, the Chairman brought the Group’s attention to the 4th draft decision contained in document GR-J(2005)9, proposing to give specific terms of reference to the European Committee on Legal Cooperation (CDCJ) (see also Appendix to GR-J(2005)CB6). He recalled that a large majority of delegations had previously stated they could agree with this draft decision, which appeared to be in line with the text of the Action Plan.
The item was postponed at the request of two delegations. The GR-J is invited to resume consideration.
European Charter for Regional or Minority Languages – First report of the Committee of Experts in respect of Spain
At their 935th meeting (13 July 2005, item 1.4), the Deputies agreed that reports on the implementation of the European Charter for Regional and Minority Languages be given preliminary examination in the GR-J.
The Group is invited to examine the report relating to Spain contained in document CM(2005)128. See also CM/Notes/938/10.1.
