The Group is invited to examine the abridged report of the 69th meeting of the CDDH (CM(2010)4 and addenda 1-3), with a view to transmitting it to the Deputies for adoption of the relevant decisions at their 1077th meeting (24 February 2010), if appropriate, without further debate (item placed in the box).

It should be noted that draft Recommendation CM/Rec(2010)… of the Committee of Ministers to member states on human rights of members of the armed forces (CM(2010)4, Appendix 4) and draft Recommendation CM/Rec(2010)… of the Committee of Ministers to member states on measures to combat discrimination on grounds of sexual orientation or gender identity (CM(2010)4, Appendix 5) envisage that the Committee of Ministers examine their implementation after a period of two and three years respectively. In compliance with an opinion of the Legal Advice Department, it is proposed to delete this point from the draft recommendations (CM(2010)4, Appendix 4, point 3 and Appendix 5, point 6 of the operational provisions) and to integrate it into the respective draft decisions of the Deputies (see below).

The Group’ attention is also drawn to the exchange of views of the CDDH on the organisation of future work concerning the accession of the European Union to the European Convention on Human Rights (CM(2010)4, Appendix 10); the CDDH requested that the importance of a rapid start to this work be reiterated.

These are the proposed decisions:

    “The Deputies

    1. took note of the opinions of the CDDH on Parliamentary Assembly recommendations,2 as they appear in Appendix 2 to document CM(2010)4;

    2. adopted Recommendation CM/Rec(2010)… of the Committee of Ministers to member states on effective remedies for excessive length of proceedings, as it appears at Appendix … to the present volume of Decisions << Appendix 3 to CM(2010)4 >> and took note of the accompanying Guide to Good Practice (document CM(2010)4 add1);

    3. adopted Recommendation CM/Rec(2010)… of the Committee of Ministers to member states on human rights of members of the armed forces, as it appears at Appendix … to the present volume of Decisions << Appendix 4 to CM(2010)4 >>, took note of its Explanatory Memorandum (document CM(2010)4 add2) and agreed to examine the implementation of the Recommendation two years after its adoption;

    4. adopted Recommendation CM/Rec(2010)… of the Committee of Ministers to member states on measures to combat discrimination on grounds of sexual orientation or gender identity, as it appears at Appendix … to the present volume of Decisions << Appendix 5 to CM(2010)4  >>, took note of its Explanatory Memorandum (document CM(2010)4 add3) and agreed to examine the implementation of the Recommendation three years after its adoption;

    5. renewed the terms of reference of the Committee of Experts for the development of human rights (DH-DEV), Committee of Experts for the improvement of procedures for the protection of human rights (DH-PR), Committee of Experts on issues relating to the protection of national minorities (DH-MIN) and Committee of Experts on the reform of the Court (DH-GDR), as they appear at Appendices … to … to the present volume of Decisions; << Appendices 6-9 of document CM(2010)4 >>

    6. took note of the exchange of views in the CDDH on the organisation of future work concerning the accession of the European Union to the European Convention on Human Rights (CM(2010)4, Appendix 10) and reiterated the importance of a rapid start of this work;

    7. in the light of decisions 1 to 6 above and of the ones taken at previous meetings,3 took note of the abridged report of the 69th meeting of the CDDH as a whole, as it appears in document CM(2010)4 and Addenda.”

10/02 Steering Committee for Equality between Women and Men (CDEG) – Abridged report of the 42nd meeting (Strasbourg, 25 27 November 2009)

In agreement with the Chair of the GR-H, the Thematic Coordinator on equality between women and men (TC-EG) submits to the Group the abridged report of the 42nd meeting of the Steering Committee for Equality between Women and Men (CDEG), as it appears in document CM(2010)5. The Group is invited to examine it with a view to forwarding it to the Deputies, for them to take note thereof without further debate at their 1077th meeting (24 February 2010) (item placed in the box).

10/03 European Commission against Racism and Intolerance (ECRI) – Examination of proposals for the nomination of a member in respect of Austria, a deputy member in respect of Georgia, a member in respect of Latvia and a deputy member in respect of San Marino

The GR-H is invited to hold an informal exchange of views on the curricula vitae of the proposed member in respect of Austria, deputy member in respect of Georgia, member in respect of Latvia, and deputy member in respect of San Marino, with a view to submitting them to the Deputies at their 1077th meeting (24 February 2010) so that the appropriate decision may be taken without further debate (item placed in the box).

Framework Convention for the protection of national minorities – Presentation by the President of the Advisory Committee of the opinions on the implementation of the Convention by:

The President of the Advisory Committee will present the opinions adopted in the framework of the second cycle of monitoring under the Framework Convention in respect of the states mentioned above. The Chair recalls that the GR-H is expected, in principle, merely to hold an initial exchange of views on the opinions concerned, with a view to instructing the Secretariat to prepare the next stage in its debate, i.e. a draft resolution for consideration by the GR-H and adoption by the Deputies, unless it is possible to present the draft resolution, with the agreement of the Delegation concerned, at the same time.
