Framework Convention for the protection of national minorities – Presentation by the outgoing President of the Advisory Committee of the opinions on the implementation of the Convention by:

The outgoing President of the Advisory Committee will present the Opinions adopted in the framework of the second cycle of monitoring under the Framework Convention in respect of the three states mentioned above.

Framework Convention for the Protection of National Minorities – Debate on the draft resolution on the implementation of the Convention by:

The GR-H is invited to examine these draft Resolutions with a view to approving them and submitting them to the Deputies at a future meeting for adoption without further debate.

06/58 Steering Committee for Human Rights (CDDH)
a. Abridged report of the 63rd meeting (Strasbourg, 24-27 October 2006)
b. Draft terms of reference of the CDDH and bodies answerable to it

The Group is invited to examine the abridged report of the 63rd meeting of the Steering Committee for Human Rights (CDDH) contained in document CM(2006)210 and CM(2006)210 add, with a view to transmitting it to the Deputies for adoption of the relevant decisions at their 984th meeting on 17 January 2007. If there is agreement in the Group, the Deputies will be invited to adopt the decisions without further debate (item placed in the box).

Please note that following a decision taken at the 981st meeting (29 November 2006, item 11.2) all committees with a coordinating function should have the following included in their terms of reference:

“While taking account of the progress of this work, prepare, under its responsibility, proposals for the Programme of Activities for the coming years.”

In this case, that would refer to the CDDH and this wording will be inserted in a revised version of the terms of reference to be submitted to the Deputies as point 4 ix.

The following draft decisions are suggested:

4. took note of the Activity Report of the Committee of Experts on Issues relating to the Protection of National Minorities (DH-MIN), as it appears in document CM(2006)210 add;

5. adopted the terms of reference of the Committee of Experts on Issues relating to the Protection of National Minorities (DH-MIN), as they appear at Appendix … to the present volume of Decisions; < see Appendix I to document CM(2006)210 >

6. adopted the ad hoc terms of reference of the Committee of Experts for the Development of Human Rights (DH-DEV) on human rights in a multicultural society, as they appear at Appendix … to the present volume of Decisions; < see Appendix II to document CM(2006)210 >

7. adopted the ad hoc terms of reference of the Group of Specialists on human rights defenders (DH-S-DDH), as they appear at Appendix … to the present volume of Decisions; < see Appendix II to document CM(2006)210 >

8. adopted the ad hoc terms of reference of the Group of Specialists on access to official documents (DH-S-AC), as they appear at Appendix … to the present volume of Decisions; < see Appendix II to document CM(2006)210 >

9. adopted the ad hoc terms of reference of the Working Group on human rights protection in the context of accelerated asylum procedures (GT-DH-AS), as they appear at Appendix … to the present volume of Decisions; < see Appendix II to document CM(2006)210 >

10. adopted the ad hoc terms of reference of the DH-PR Group on the execution of judgements of the European Court of Human Rights (GT-DH-PR A) , as they appear at Appendix … to the present volume of Decisions; < see Appendix II to document CM(2006)210 >

11. adopted the ad hoc terms of reference of the DH-PR Group on the review of the implementation of the “reform” recommendations (GT-DH-PR B), as they appear at Appendix … to the present volume of Decisions; < see Appendix II to document CM(2006)210 >

12. took note of the opinion of the CDDH on Parliamentary Assembly Recommendation 1742 (2006) on human rights of members of the armed forces and adopted Decision No. CM/…/… giving ad hoc terms of reference to the Steering Committee for Human Rights (CDDH), as it appears at Appendix … to the present volume of Decisions; <see the Appendix to this annotated agenda>;

13. took note of the opinion of the Bureau of the CDDH on Recommendation 1755 (2006) – “Human rights of irregular migrants”,

14. in the light of decisions 1-13 above, took note of the abridged report of the 63rd meeting of the CDDH as a whole, as it appears in document CM(2006)210.”

Advisory Committee of the Framework Convention – Election of candidates in respect of:

It has not proved possible to submit a list of candidates in time for the meeting. The item is therefore postponed to the next meeting of the Group.

Ad hoc terms of reference of the Steering Committee for Human Rights (CDDH)

1. Name of Committee: Steering Committee for Human Rights (CDDH)

2. Source: Committee of Ministers

3. Duration: These terms of reference shall expire on 30 June 2008.

4. Terms of reference:

To prepare a recommendation along the lines proposed in paragraph 10 of Parliamentary Assembly Recommendation 1742 (2006) - Human rights of members of the armed forces whilst also taking into account the Recommendation as a whole. In doing so, due account shall be taken of the work carried out on this topic in other international fora, and notably the UN and the OSCE.

Note 1 This document has been classified restricted at the date of issue. Unless the Committee of Ministers decides otherwise, it will be declassified according to the rules set up in Resolution Res(2001)6 on access to Council of Europe documents.
