Supervision of the execution of the judgments of the European Court of Human Rights
Romania: the Committee of Ministers welcomes the adoption of the reform of the mechanism allowing compensation or restitution of nationalised properties in response to the pilot judgment of the European Court in the case of Maria Atanasiu and others
Strasbourg, 06.06.2013 – At its meeting from 4 to 6 June devoted to the supervision of the execution of the judgments of the European Court of Human Rights, the Committee of Ministers adopted a decision regarding the pilot judgment Maria Atanasiu and others, following a debate on the group of cases concerning the compensation or the restitution of properties nationalised in Romania.
In its decision, the Committee welcomes the determination shown by the Romanian authorities in the execution of this judgment, which has allowed the adoption of a new law reforming the reparation mechanism with a view to ensuring its effectiveness and viability.
The Committee also takes note of the Court’s decision to maintain the freeze on repetitive cases until it can decide by one or several lead decisions on the action taken by the Romanian authorities in response to the pilot judgment Maria Atanasiu and others.
One of the issues underlined by the Committee of Ministers is the importance of close and constant monitoring of the application of the new law so that the competent authorities can, if necessary, rapidly intervene including through legislative measures, with a view to ensuring an effective operation of the newly established mechanism.
