Resolution CM/Res(2009)9
concerning the financial statements of the European Pharmacopoeia
for the year ended 31 December 2008

at the 1068th meeting of the Ministers' Deputies)

The Committee of Ministers, under the terms of Article 16 of the Statute of the Council of Europe, and in its membership restricted to the representatives of the States Parties in 2008 to the Convention on the elaboration of a European Pharmacopoeia,1

Having regard to Article 70 of the Financial Regulations;

Having regard to the financial statements of the European Pharmacopoeia for the year ended 31 December 2008, as presented by the Secretary General;

Having regard to the opinion of the External Auditor;

Having regard to the report of the External Auditor;

Having regard to Resolution (91) 18 on the European Pharmacopoeia for 1991;

Having regard to Resolution (97) 48 on the European Pharmacopoeia – 1998 Budget,

Resolves as follows:

1. The financial statements of the European Pharmacopoeia for the year ended 31 December 2008 (CM(2009)100, pages 125-143) presented by the Secretary General, are approved;

2. The unexpended appropriations on the main budget of the European Pharmacopoeia for the financial year 2008 amounting to €639 796.93, as shown in the budgetary management accounts (CM(2009)100, page 131) presented by the Secretary General, are cancelled;

3. The balance of €3 296 631.04 (CM(2009)100, page 126) on the main budget is allocated as follows:

- an amount of €2 834 500 is apportioned among the member states as indicated in the appendix to this resolution;
- an amount of €462 131.04 is transferred to the 2009 main budget of the Pharmacopoeia;

4. The balance of €2 087 187.41 on the 2008 subsidiary budget “Biological Standardisation Programme” (CM(2009)100, page 132) is hereby transferred to the 2009 main budget of the Pharmacopoeia;

5. The cumulative balance at 31 December 2008 of €6 687 697.88 on the 2008 subsidiary budget “Publications, Development, Certification and Conferences” (CM(2009)100, page 136) is transferred to the 2009 main budget of the Pharmacopoeia, subject to any subsequent decisions to be taken in the framework of the 2010 budgetary discussions;

6. The Secretary General is hereby discharged from financial responsibility in respect of the financial year 2008;

7. The share of the surplus of the main European Pharmacopoeia budget due to each state will be applied to meet any additional contributions for which states may become liable, should supplementary appropriations be granted in the 2009 budget, any part of the share that remains being considered as an advance on its contributions for 2010.
