Action

a. To take note of the communication by the Secretary General of the Assembly on the 2nd Part-Session of 2007 (document SG-AS(2007)3);

b. To decide on the action to be taken on the texts adopted by the Parliamentary Assembly at its 2nd Part-Session of 2007;


c. To take note of the communication by the Chairman of the Committee of Ministers to the Assembly as well as of the replies given by the Chairman of the Committee of Ministers to parliamentary written questions.

The Secretary General of the Assembly will make his communication on the 2nd Part of the 2007 Session and other Assembly activities, in the light of document SG-AS(2007)32

The Deputies are invited to take note of this communication.

b. Texts adopted at the 2nd Part of the 2007 Session (Provisional compendium of texts adopted)

Following the adoption by the Parliamentary Assembly, on the occasion of its 2nd part-session in 2007
(16 - 20 April 2007), of the texts reproduced in the Provisional Compendium of adopted texts, the Deputies are invited to take a series of decisions on the action to be taken on these texts.

c. Communication by the Chairman of the Committee of Ministers and replies to parliamentary questions (17 April 2007)

On 17 April 2007, Mr Fiorenzo Stolfi, Minister for Foreign Affairs of San Marino and Chairman of the Committee of Ministers, presented the statutory report to the Parliamentary Assembly. His oral statement is set out in document CM/AS(2007)4. It was complemented by a written communication, which appears in document CM/AS(2007)3.

The Chairman of the Committee of the Ministers then answered 11 parliamentary questions orally.

The text of the Chairman’s address and the questions and answers appear in document AS(2007)CR13 and Addendum 1.

1. took note of the following Opinions:

- Opinion No. 261 (2007) - Accession of the Republic of Montenegro to the Council of Europe;

- Opinion No. 262 (2007) - Memorandum of understanding between the Council of Europe and the
European Union;

- Opinion No. 263 (2007) - Draft convention on the protection of children against sexual exploitation and sexual abuse;

2. agreed to examine them in the framework of their discussion on these topics.

3. concerning Recommendation 1791 (2007) – State of human rights and democracy in Europe

a. decided to bring it to the attention of their governments;

      b. agreed to communicate it to the Steering Committee on Legal and Regional Democracy (CDLR), to the Ad hoc Committee on e-democracy (CAHDE), to the Steering Committee for Human Rights (CDDH), to the Steering Committee on the Media and New Communications Services (CDMC), to the European Committee on Legal Co-operation (CDCJ) and to the Enlarged Agreement on the European Commission for Democracy through Law (Venice Commission) for information and possible comments by 15 June 2007;
      c. in the light of possible comments, invited their Rapporteur Group on Democracy (GR-DEM) to prepare a draft reply for adoption at one of their forthcoming meetings;

4. concerning Recommendation 1792 (2007) – Fair trial issues in criminal cases concerning espionage or divulging state secrets

a. decided to bring it to the attention of their governments;

      b. agreed to communicate it to the European Commission for the Efficiency of Justice (CEPEJ); to the European Committee on legal co-operation (CDCJ), to the European Committee on Crime Problems (CDPC), to the Group of States against Corruption (GRECO), to the Steering Committee for Human Rights (CDDH) and to the Steering Committee on the Media and New Communication Services (CDMC) for information and possible comments by 15 June 2007;

    c. in the light of possible comments, invited their Rapporteur Group on Legal Co-operation (GR-J) to prepare a draft reply for adoption at one of their forthcoming meetings;

5. concerning Recommendation 1793 (2007) – Need for a Council of Europe convention on the suppression of counterfeiting and trafficking in counterfeit goods

a. decided to bring it to the attention of their governments;

      b. agreed to communicate it to the European Committee on Crime Problems (CDPC) and to the Public Health Committee (CD-P-SP) for information and possible comments by 15 June 2007;
      c. in the light of possible comments, invited their Rapporteur Group on Legal Co-operation (GR-J) to prepare a draft reply for adoption at one of their forthcoming meetings;

6. concerning Recommendation 1794 (2007) – The quality of medicines in Europe

a. decided to bring it to the attention of their governments;

      b. agreed to communicate it to the European Committee on Crime Problems (CDPC), to the European Health Committee (CDSP) and to the Public Health Committee (CD-P-SP) for information and possible comments by 15 June 2007;
      c. in the light of possible comments, invited their Rapporteur Group on Social and Health Questions (GR-SOC) to prepare a draft reply for adoption at one of their forthcoming meetings;

7. took note of the following Resolutions:

Resolution 1546 (2007) – The code of good practice for political parties

Resolution 1547 (2007) – State of human rights and democracy in Europe

Resolution 1550 (2007) – Situation in the Middle East

8. adopted the following reply to the texts adopted by the Parliamentary Assembly at the 2nd part of the 2007 Session (16-20 April 2007):

      “The Committee of Ministers took note of Opinions 261, 262 and 263, Recommendations 1791 to 1794 and Resolutions 1545 to 1551 adopted by the Parliamentary Assembly at its 2nd Part of the 2007 Session (16 - 20 April 2007).

    The Committee of Ministers brought Recommendations 1791 to 1794 (2007) to the attention of the governments of member states and entrusted them to the competent organs and/or committees of experts for information or comments and to Rapporteur Groups/Thematic Coordinators with a view to preparing draft replies for adoption at an early date.”
