4.1 European Social Charter – European Committee of Social Rights (ECSR)

Election of a member

Action

1. To elect a member for the remaining vacant seat in the European Committee of Social Rights following the procedure which is recalled below;

2. To examine the draft Resolution appended hereto with a view to its adoption.

1. It is recalled that by the expiry of the deadline for nomination of candidates on 30 September 2006 for the five seats on the European Committee of Social Rights falling vacant on 31 December 2006 as well as the seat left vacant following the resignation of a member of the Committee, five nominations had been received for the six vacant seats: only one candidate had been nominated for the two vacant seats in Group III. The Ministers’ Deputies therefore decided to extend to 1 December 2006 the deadline for nominating candidates for the remaining vacant seat in Group III. The decision is contained in Appendix II to document CM(2006)227.

2. By the expiry of this extended deadline the Secretariat had received one nomination for the seat in question. The nomination and the curriculum vitae of the candidate are contained in document CM(2006)227.

3. Voting will be by secret ballot. A single voting paper will be distributed in the meeting room. For information a copy of the ballot sheet appears in Appendix II to the present Notes on the Agenda. The ballot sheet contains information on the voting procedure.

4. Please note that all member states take part in the vote, not only the States Parties to the Charter:

    - States have been divided into five groups to establish a balance within the European Committee of Social Rights. Nevertheless, delegations are invited to vote in every group, not only in the group in which their country has been placed;

    - the candidate or candidates having obtained an absolute majority of the votes cast and the highest number of votes will be declared elected; if one or more seats remain vacant after the first ballot, there will be a second round of voting and the candidate or candidates having obtained the highest number of votes will be declared elected.

5. This item will be prepared in the Rapporteur Group on Human Rights (GR-H) on 18 January 2007 by an informal exchange of views on the candidatures.

The Deputies, having voted in accordance with Article 25 of the European Social Charter,

1. declared the following candidate elected as members of the European Committee of Social Rights, with immediate effect, for a term of office which will expire on 31 December 2012:

The Committee of Ministers, under the terms of Article 25 of the European Social Charter (hereinafter referred to as “the Charter”),

Having regard to its decision adopted at the 969th meeting of the Ministers’ Deputies (21 June 2006, item 4.3) to fill the five seats of the European Committee of Social Rights falling vacant on 31 December 2006 and the seat left vacant following the resignation of a member of the Committee;

Having regard to the procedure adopted at the 969th meeting of the Minister’s Deputies;

Having regard to the decision adopted at the 979th meeting of the Ministers’ Deputies (8 November 2006, item 4.4) to extend the deadline to 1 December 2006 for states in Group III to nominate candidates for the remaining vacant seat;

Having regard to the list of candidates proposed by the States Parties to the Charter or to the Revised Charter for the remaining vacant seat;

Having voted by secret ballot,

Declares the following candidate elected as member of the European Committee of Social Rights, with immediate effect, for a term of office which will expire on 31 December 2012:
