Draft ad hoc terms of reference on the human rights of members of the armed forces

Action

To give ad hoc terms of reference to the Steering Committee for Human Rights (CDDH) to give an opinion on the feasibility of preparing a recommendation along the lines proposed in paragraph 10 of Parliamentary Assembly Recommendation 1742 (2006) on the human rights of members of the armed forces.

1. Recommendation 1742 (2006) was adopted on 11 April 2006. In paragraph 10, the Assembly recommended “that the Committee of Ministers prepare and adopt guidelines in the form of a new recommendation to member states designed to guarantee respect for human rights by and within the armed forces, drawing on the European Convention on Human Rights and the case law of the European Court of Human Rights, the previous recommendations of the Committee of Ministers, the recommendations of the Parliamentary Assembly and those of the Commissioner for Human Rights of the Council of Europe”.

2. In its reply, adopted at the 962nd meeting (26 April 2006, item 3.1b) the Committee indicated its intention “to assign terms of reference to the Steering Committee on Human Rights (CDDH) to express an opinion concerning the feasibility of preparing a text along the lines of that proposed by the Assembly in paragraph 10 of the recommendation”.

3. The draft terms of reference are appended to document GR-H(2006)15.

4. The GR-H is scheduled to examine the draft terms of reference at its meeting on 14 September 2006, with a view to recommending their adoption by the Deputies. The Chairman of the GR-H will report orally on the outcome of the debates.

The Deputies adopted Decision No. CM/…/…, giving ad hoc terms of reference to the Steering Committee for Human Rights (CDDH), as it appears at Appendix … to the present volume of Decisions. <see Appendix to document GR-H(2006)15>
