10.2 Democratic oversight of the security sector in member states –

Action

To adopt the reply to Parliamentary Assembly Recommendation 1713 (2005) on the democratic oversight of the security sector in member states, as it appears in document CM/AS(2006)Rec1713 prov.6.

Background

1. The Parliamentary Assembly adopted Recommendation 1713 (2005) on the democratic oversight of the security sector in member states on 23 June 2005.

2. At their 934th meeting (6-7 July 2005, item 3.1), the Ministers’ Deputies agreed to bring the Recommendation to their governments’ attention. On the same occasion, they agreed to communicate it to the European Committee on Crime Problems (CDPC) and the Steering Committee for Human Rights (CDDH), for information and possible comments by 31 October 2005. They also agreed to communicate it to the European Commission for Democracy through Law (Venice Commission), for an opinion by 31 October 2005 and to the Committee of Experts on Terrorism (CODEXTER), for information. Finally, they invited their Rapporteur Group on Legal Cooperation (GR-J) to prepare draft reply for adoption at one of their forthcoming meetings.

3. The Secretariat prepared a draft reply to the Recommendation in the light of the opinions received, which was examined by the GR-J at its meeting on 30 March 2006 and transmitted to the Deputies for adoption. At their 958th meeting (15 March 2006, item 1.1), the Deputies agreed to postpone the item to one of its forthcoming meetings following a request from the Secretary General. A revised draft reply was then prepared for consideration by the GR-J containing certain proposals made by the Secretariat following the Secretary General’s Article 52 Report. Following a written consultation within the GR-J, and a further examination of an additional proposal made by one delegation at the GR-J meeting held on 1 June 2006, the Group reached a provisional agreement on the text with a deadline expiring on Wednesday, 7 June 2006 at the close of business.

4. At their 967th meeting (14 June 2006), the Deputies agreed again to postpone the item. The Chairman of the GR-J has made another attempt to find a compromise solution together with the most interested delegations. He now invites delegations to adopt the text contained in document CM/AS(2006)Rec1713 prov.6.

Decision

The Deputies adopted the reply to Parliamentary Assembly Recommendation 1713 (2005) on the democratic oversight of the security sector in member states, as it appears at Appendix … to the present volume of Decisions.2
