Action

To take note of the abridged report of the 55th meeting of the CDPC (document CM(2006)61) as a whole and to adopt the relevant decisions.

To adopt the draft Recommendation on Assistance to Crime Victims (document CM(2006)61, Appendix 2) and to take note of its Explanatory Memorandum (document CM(2006)61 Addendum).

1. The abridged report of the 55th meeting of the European Committee on Crime Problems (CDPC) (Strasbourg, 3-7 April 2006) is set out in document CM(2006)61.

2. At its meeting, the CDPC dealt with a number of points which require decisions to be taken by the Committee of Ministers. The CDPC invited the Committee of Ministers:

a. to approve the terms of reference, revised in accordance with the provisions of Resolution (2005) 47, of the Council for penological co-operation (PC-CP) (document CM(2006)61, Appendix 3), the Council for police matters (PC-PM) (document CM(2006)61, Appendix 4) and the Committee of experts on the operation of European conventions in the legal field (PC-OC) (document CM(2006)61, Appendix5), and also:

    i. as regards the PC-CP, in particular, to approve the increase in membership from seven to nine members and the PC-CP mandate to undertake regular re-examination of the European Prison Rules;

    ii. as regards the PC-PM in particular, to approve the re-election of some of its members for an additional mandate of two years and the proposed Rules for the PC-PM;

      iii. as regards the PC-OC, in particular to approve the specific mandate to make proposals for the improvement of judicial co-operation in criminal matters;

b. to adopt the draft Recommendation on Assistance to Crime Victims (document CM(2006)61, Appendix 2) and take note of its Explanatory Memorandum (document CM(2006)61 Addendum). The GR-J agreed to give delegations until Friday 9 June 2006 at noon to indicate any disagreement with the proposals for amendments made at the GR-J meeting held on 1 June 2006 (see document DD(2006)344).

    3. The Deputies are also invited to take note of the CDPC’s Report to the Committee of Ministers on action to implement the Warsaw Action Plan (in conformity with the Committee of Ministers’ request as contained in document CM(2005) 145 revised), indicating its completed and proposed actions to implement the Action Plan adopted by the Heads of State and Government in Warsaw 16 and 17 May 2005 (see document CM(2006)61, Appendix 6).

    4. The CDPC furthermore submitted a number of items to the Deputies for information (see document CM(2006)61). The Deputies may wish to note in particular that in the opinion of CDPC, a binding instrument, in the form of a European Prison Charter, is not a feasible proposition and that the CDPC made a consequent proposal to strengthen penitentiary reform inter alia through the elaboration of a Compendium of Council of Europe recommendations in the penitentiary field.

The Deputies

1. adopted the terms of reference of the Council for penological co-operation (PC-CP) (, as they appear at Appendix … to the present volume of Decisions [Appendix 3 of document CM(2006)61];

2. adopted the terms of reference of the Council for police matters (PC-PM), as they appear at Appendix … to the present volume of Decisions [Appendix 4 of document CM(2006)61];

3. adopted the terms of reference of the Committee of experts on the operation of European conventions in the legal field (PC-OC), as they appear at Appendix … to the present volume of Decisions [Appendix 5 of document CM(2006)61];

4. welcomed the reply, prepared by the CDPC in accordance with the message from the Committee of Ministers (CM(2005)145 rev) to all committees involved in intergovernmental co-operation, concerning the CDPC’s contribution to the implementation of the Action Plan of the Third Summit of the Heads of State and Government of the Council of Europe (Warsaw, 16-17 May 2005) and, in particular, its future priorities, as it appears at Appendix 6 of document CM(2006)61;

5. in the light of decisions 1 to 4 above, took note of the abridged report of the CDPC, as it appears in document CM(2006)61, as a whole.

1. adopted Recommendation Rec(2006) of the Committee of Ministers to member states on assistance to crime victims, as it appears at Appendix to the present volume of Decisions; < see CM(2006)61, Appendix 2 revised et DD(2006)344 >

2. took note of the Explanatory Memorandum to the recommendation as it appears in document CM(2006)61 Addendum revised.4

Note 1 Item 10.3a: The GR-J proposed an amendment to the draft decisions which is indicated in bold. Item 10.3b: The GR-J agreed to give delegations until Friday 9 June 2006 at noon to indicate any disagreement with the proposals for amendments made at the GR-J meeting held on 1 June 2006 (see document DD(2006)344).
