10.1 Abolition of restrictions on the right to vote –

Action
To adopt the reply to Parliamentary Assembly Recommendation 1714 (2005) on Abolition of restrictions on the right to vote, as it appears in document CM/AS(2006)Rec1714 prov. 2.

Background

1. The Parliamentary Assembly adopted the Recommendation 1714 (2005) on Abolition of restrictions on the right to vote on 24 June 2005.

2. At their 934th meeting (6-7 July 2005, item 3.1), the Ministers’ Deputies agreed to bring the Recommendation to their governments’ attention. On the same occasion, they agreed to communicate it to the Steering Committee for Human Rights (CDDH) and to the Steering Committee on Local and Regional Democracy (CDLR), for information and possible comments by 31 October 2005. They also agreed to communicate it to the European Commission for democracy through law (Venice Commission) for an opinion by 31 October 2005. Finally, they invited their Rapporteur Group on Legal Cooperation (GR-J) to prepare a draft reply for adoption at one of their forthcoming meetings.

3. The Secretariat prepared a draft reply to the Recommendation in the light of opinions received from the Venice Commission and the CDLR. The GR-J examined the draft reply at its meetings on 8 December 2005 and 10 January 2006. As a disagreement remained on one aspect of the reply in the latter meeting, the Chairman organised an informal meeting with interested delegations in a final effort to reach an agreement on the draft reply. The text circulated in document CM/AS(2006)Rec1714 prov. 2 reflects the agreement reached in the informal meeting.

4. At their 953rd meeting (18 January 2006, item 10.6), the Deputies agreed to resume consideration of the item at their 954th meeting as one delegation had received instructions for an amendment to be made to the draft reply. The Chairman of the GR-J would make another effort to reach a solution through further consultations with the interested delegations.

Decision

The Deputies adopted the reply to Parliamentary Assembly Recommendation 1714 (2005) on Abolition of restrictions on the right to vote, as it appears at Appendix … to the present volume of Decisions.2
