Nomination of an ECRI member in respect of Latvia

Action

To take note of the name and curriculum vitae of the person nominated by Latvia to serve as member of ECRI for a term of office of five years, starting on 20 April 2005.

1. In accordance with Article 3.5 of ECRI's Statute (Resolution Res(2002)8), ECRI members are appointed for a term of office of five years and may only be replaced if they have tendered their resignation.

2. The Chair of ECRI informed the Director General of Human Rights that he had received the resignation of Ms Ruta MARJASA, ECRI member in respect of Latvia, by letter of 23 February 2005 addressed to the Chair of ECRI in accordance with Article 3 of ECRI's internal Rules of Procedure.

3. By letter of 1 March 2005, the Director General of Human Rights asked the Permanent Representative of Latvia to notify him of the appointment of a new member of ECRI in respect of his country, and to communicate to him the curriculum vitae of the person appointed, so that he could inform the Committee of Ministers, in accordance with Article 3 of ECRI's Statute.

4. In accordance with Article 2 of ECRI's Statute, the members of ECRI should have high moral authority and recognised expertise in dealing with racism, racial discrimination, xenophobia, antisemitism and intolerance. They should serve in their individual capacity and should be independent and impartial in fulfilling their mandate. They should not receive any instructions from their government.

5. In accordance with Article 3.3 of ECRI's Statute, if the Committee of Ministers were to consider that the appointment of one or more members of ECRI would not be in conformity with the provisions of Article 2 of ECRI's Statute, it may ask the member state(s) concerned to make another appointment.

6. The document DGII(2005)7 reproduces the curriculum vitae communicated with the notification received concerning the person designated by Latvia authorities as member of ECRI. The GR-H will examine this curriculum at a special meeting on 20 April 2005 at 9.30 a.m. before the opening of the 924th meeting with a view to formulating a recommendation to the Deputies.

Decision

The Deputies took note of the name and curriculum vitae of the person designated by Latvia as member of ECRI for a term of office of five years, starting on 20 April 2005, as contained in document DGII(2005)7.

Note 1 This document has been classified restricted at the date of issue. Unless the Committee of Ministers decides otherwise, it will be declassified according to the rules set up in Resolution Res(2001)6 on access to Council of Europe documents.
