4.5 Council of Europe Commissioner for Human Rights –
Procedure for Election

To pursue the debate concerning the Election of a Council of Europe Commissioner in 2005.
1. The Secretariat recalls that Article 9 of Resolution (99) 50 provides as follows:
“1. The Commissioner shall be elected by the Parliamentary Assembly by a majority of votes cast from a list of three candidates drawn up by the Committee of Ministers.
2. Member states may submit candidatures by letter addressed to the Secretary General. Candidates must be nationals of a member state of the Council of Europe.”
Article 11 provides that “The Commissioner shall be elected for a non-renewable term of office of six years.”
2. The present Commissioner took up his function on 15 October 1999, following an election held at the September 1999 part-Session of the Parliamentary Assembly.
3. Following the debates held at the 909th (15 December 2004), 911th (12 January 2005) and 912th (19 January 2005) meetings, and the discussions in the Joint Committee on 27 January 2005, the Chairman will make oral proposals concerning the procedure to be followed at the present meeting.
