10.1 European Charter for Regional and Minority Languages –
Election of a member for the Committee of Experts in respect of Hungary
Item to be prepared by the GR-J
To elect a member of the Committee of Experts for the European Charter for Regional or Minority Languages, in respect of Hungary.
The European Charter for Regional or Minority Languages (ETS No. 148) came into force on 1 March 1998. Its Committee of Experts is composed of as many independent experts as there are Parties to the Charter. They are elected pursuant to Article 17 of the latter, which reads as follows:
“1. The committee of experts shall be composed of one member per Party, appointed by the Committee of Ministers from a list of individuals of the highest integrity and recognised competence in the matters dealt with in the Charter, who shall be nominated by the Party concerned.
2. Members of the committee shall be appointed for a period of six years and shall be eligible for reappointment. A member who is unable to complete a term of office shall be replaced in accordance with the procedure laid down in paragraph 1, and the replacing member shall complete his predecessor's term of office.”
The explanatory report on the Charter specifies that "the experts appointed to the committee, in carrying out their task, should be free to act independently and not be subject to instructions from the governments concerned".
Hungary ratified the Charter on 26 April 1995, and the Charter came into force in respect of it on 1 March 1998.
M. Gábor KARDOS, currently serving on the Committee of Experts in respect of Hungary, was elected on 9 June 1998 and his mandate therefore expires on 9 June 2004.
The Hungarian authorities have submitted a list of candidates, in relation to a new mandate of an expert in respect of Hungary starting on 10 June 2004, whose curricula vitae are reproduced in CM (2004)64.
The Committee of Ministers elects the members of the Committee of Experts by secret ballot. A ballot paper will be issued with the candidates' names listed in the order of their presentation by the proposing country.
The Deputies are each invited to cast one vote. The candidate receiving the highest number of votes is elected.

The Deputies, in accordance with Article 17, paragraph 1, of the European Charter for Regional or Minority Languages, declared the person whose name appears below elected as a member of the Committee of Experts of the European Charter for Regional or Minority Languages, in respect of Hungary.
