    Action

    To resume consideration of the reply proposed by the Chairman of the Committee of Ministers to the Written question No. 427 addressed to him, in the light of the discussions held on this item at the 850th meeting.

    In considering the draft reply prepared by the Chair, the Deputies are invited to bear in mind the reply given by the Chairman of the Committee of Ministers, Mr Nicolae Dudau, to parliamentary questions during his communication to the Parliamentary Assembly on 26 June 2003 (See appendix to these Notes).

    REPLY TO WRITTEN QUESTION No. 4

    Question:
    In view of the assurances given by the Prime Minister of Turkey to the Council of Europe Parliamentary Assembly at the first part-session of 2003,
    Noting that Ms Loizidou is a refugee from Kyrenia whose property was illegally confiscated by the Turkish occupying authorities,
    To ask the Chairman of the Committee of Ministers,
    If the Committee of Ministers could inform the Parliamentary Assembly whether there has been progress with regard to the implementation of the judgment delivered on 28 July 1998 by the European Court of Human Rights in the Loizidou case, and what supplementary measures the Committee of Ministers envisages to ensure that the judgment is applied.

    Reply:
    I can tell the Honourable Member of the Assembly that the Turkish authorities declared unequivocally, at the Deputies' meeting on 19 June 2003, that the necessary action will have been taken to allow the Committee of Ministers to find, at the Human Rights meeting on 7-8 October 2003, that the just satisfaction awarded by the Court had been paid. This will also allow the Deputies to adopt a final resolution on the execution of the Court's judgment of 28 July 1998.

    The Deputies have so far concentrated, for obvious reasons, on payment of the just satisfaction awarded by the Court. Once this question has been settled, the Committee will decide how to proceed on the other issues raised by this case.
