      The Deputies are invited to consider, with a view to its adoption, a draft reply to the above-mentioned Recommendation.


    Background

    The Congress of Local and Regional Authorities of Europe (CLRAE) adopted Recommendation 22 (1996) on the European Charter of Regional Self-Government at its 3rd session (Strasbourg, 2-4 July 1996). The Deputies examined it at their 574th meeting (2 October 1996, item 9.1).

    Given that the recommendation was not addressed to the Committee of Ministers, the Deputies just took note of it, and the Secretariat did not prepare any reply to it at that time. Nonetheless, now that the Committee of Ministers has undertaken, through its Steering Committee on Local and Regional Democracy (CDLR), substantial work on this subject, it would be useful to inform the CLRAE of the progress made, as this item is high on the CLRAE’s agenda.

    The CDLR adopted the final activity report on the completion of the groundwork for the elaboration of a legal instrument on regional self-government at its 28th meeting (10-12 December 2001). The Deputies took note of it at their 786th meeting (6 March 2002, item 10.1a) and requested the 13th session of the Conference of European Ministers responsible for Local and Regional Government (Helsinki, 27-28 June 2002), to express, in the light of the completed groundwork, an opinion on the nature of the instrument to be adopted by the Committee of Ministers, which will resume consideration of this question, in its turn, in the light of the Conference’s opinion.

    Draft reply to Recommendation 22 (1996) of the Congress of Local and Regional Authorities of Europe (CLRAE)

    Decision

    The Deputies adopted the following reply to this recommendation:

    “The Committee of Ministers would like to inform the CLRAE on the state of progress in respect of the instrument on regional self-government, referred to in its Recommendation 22 (1996). Since the adoption of this text, the Committee of Ministers has undertaken substantial work on the subject through its Steering Committee on Local and Regional Democracy (CDLR). The latter recently adopted the final activity report on the completion of the groundwork for the elaboration of a legal instrument on regional self-government. The Committee of Ministers subsequently requested the 13th session of the Conference of European Ministers responsible for Local and Regional Government (Helsinki, 27-28 June 2002), to express, in the light of the completed groundwork, an opinion on the nature of the instrument to be adopted by the Committee of Ministers. The Committee of Ministers will resume consideration of this issue and take a stand on it once it has received the opinion of the Conference.”
