    10.1 European Committee on Legal Co-operation (CDCJ) -
    Abridged report of the 76th meeting (Strasbourg, 4-7 December 2001)

      Action

      The Deputies are invited:
      - to postpone consideration of the draft Convention on Contact concerning Children to a future meeting, pending submission of the Parliamentary Assembly opinion;
      - to approve the revised specific terms of reference of two subordinate committees of the CDCJ;
      - to take note of the opinions of the CDCJ on Parliamentary Assembly Recommendations 1443 (2000) and 1500 (2001);
      - to take note of the abridged report as a whole.


    1. The European Committee on Legal Co-operation (CDCJ) held its 76th meeting in Strasbourg from 4 to 7 December 2001. The abridged meeting report appears in document CM(2002)4.

    2. In the abridged report, the CDCJ invited the Committee of Ministers in particular to adopt the text of the draft Convention on Contact concerning Children, to decide on the date and place of the convention’s opening for signature and to authorise publication of the text of its explanatory report. The draft convention appears in document CM(2001)185 revised 1 ; the explanatory report is contained in an addendum to CM(2001)185 revised.

    3. However, it is recalled in this connection that, at their 778th meeting (19 December 2001), the Deputies forwarded the draft convention to the Assembly and agreed to reconsider it in the light of the Assembly opinion. Accordingly, the Deputies might wish to resume consideration of the draft once they have received this opinion.

    4. The CDCJ also invited the Committee of Ministers to approve the revised terms of reference of the Project Group on Administrative Law (CJ-DA) (see Appendix V to CM(2002)4) and of the Committee of Experts on Nationality (CJ-NA) (see Appendix VI to CM(2002)4).

    5. The CDCJ forwarded opinions to the Committee of Ministers on Parliamentary Assembly Recommendation 1500 (2001) on participation of immigrants and foreign residents in political life in the Council of Europe member States (see Appendix III to CM(2002)4) and Parliamentary Assembly Recommendation 1443 (2000) on international adoption: respecting children’s rights (see Appendix IV to CM(2002)4) and invited the Committee of Ministers to take note of these texts.

    6. It should be noted that, at its meeting on 18 February 2002, the Rapporteur Group on Legal Co-operation (GR-J) will consider, in the light of the opinion on Recommendation 1443 (2000) and other opinions submitted in this connection, a draft reply to be sent to the Assembly.

    7. The other items considered by the CDCJ and forwarded for information to the Committee of Ministers appear in the abridged report (CM(2002)4), which the Committee of Ministers is invited to take note of as a whole.

    The Deputies

    1. agreed, pending receipt of the Parliamentary Assembly opinion, to postpone consideration of the draft Convention on Contact concerning Children to a future meeting;

    2. approved the revised specific terms of reference of the Project Group on Administrative Law (CJ-DA) as they appear in Appendix V to CM(2002)4);

    3. approved the revised specific terms of reference of the Committee of Experts on Nationality (CJ-NA) as they appear in Appendix VI to CM(2002)4);

    4. took note of the opinions of the CDCJ on Parliamentary Assembly Recommendation 1500 (2001) on participation of immigrants and foreign residents in political life in the Council of Europe member States (Appendix III to CM(2002)4) and Parliamentary Assembly Recommendation 1443 (2000) on international adoption: respecting children’s rights (Appendix IV to CM(2002)4);

    5. took note, bearing in mind decisions 1 to 4 above, of the abridged report of the CDCJ’s 76th meeting, as a whole (CM(2002)4).
