The Deputies are invited to hold a first exchange of views on Written Question No. 396 by Mrs Hajiyeva to the Committee of Ministers with a view to the preparation of a reply.

Written question No. 396 by Mrs Hadjyeva on the Recognition of the territorial integrity of Azerbaijan by Armenia is the subject of document CM(2001)101.  In her question, Mrs Hadjyeva refers to the 108th Session of the Committee of Ministers (10 and 11 May 2001).

 

Ms Hajiyeva asks the Committee of Ministers to invite the Republic of Armenia to:

 

-           to respect such principles of International Law as territorial integrity and sovereignty of states and to recognise the territorial integrity of Azerbaijan;

 

-          to secure immediate withdrawal of the Armenian military forces from the occupied Azerbaijani lands.

 

It is recalled that the Communiqué of the 108th ordinary Session of the Committee of Ministers contains the following text concerning the situation in the Balkans and the Caucusus:

 

“The Ministers reaffirmed their support for the respect for internationally recognised borders, sovereignty and territorial integrity of States throughout Europe, as well as for the other principles of international law set out in the United Nations Charter, the CSCE Helsinki Final Act and other relevant texts.”

 

In a footnote it was specified that:

 

“One delegation said that it accepted this sentence on the understanding that there was no hierarchy between the principles of international law referred to, whether these are explicitly mentioned or not.  That delegation made a statement in this respect, which is reproduced in the minutes of the meeting.”

 

At the adoption of the Communiqué, the Minister for Foreign Affairs of the Republic of Armenia, Mr V. Oskanian, made the following declaration:

 

“It is Armenia's understanding that all Helsinki Final Act principles, including the right to self-determination of people, have equal weight and application under international law.

 

Furthermore, Armenia will continue to refrain from granting recognition to Azerbaijan's territorial integrity until the final resolution of the OSCE mediated Nagorno-Karabakh conflict.”

 

It should be noted that this question was raised with the members of the GT-SUIVI.AGO during the visit of the Group to the region, both by the authorities of Armenia and Azerbaijan (cf. CM(2001)115 under item 2.6 of the present meeting).  One possibility would therefore be, after an initial exchange of views, to mandate the GT-SUIVI.AGO, along with the Representatives of Armenia and Azerbaijan, to prepare a draft reply.
