The Deputies are invited to consider the amendment of Article 9 of the Rules set out on page 3 of the present Notes and accordingly to adopt the attached draft Decision.

Arrangements for insurance cover and reimbursement of expenses for persons who travel at the charge of the Council of Europe budgets are governed by a multitude of different rules. In particular, the regulations provide for two different systems. Under the first of these, no travel insurance cover is provided at all, under the second, travel insurance cover is restricted to the risk of accident.

 

Thus, in the case of government experts whose travel expenses are chargeable to Council of Europe budgets, no insurance has been taken out by the Council of Europe to cover risks related to their official travel. In order to remedy this deficiency, the Secretary General intends to include government experts in the definition of the persons insured under the contract taken out to cover risks related to official journeys undertaken by Council of Europe staff members.

 

It is accordingly proposed that the present wording of Article 9[1] of the Rules concerning the reimbursement of travel and subsistence expenses to “government experts and other persons travelling at the charge of Council of Europe budgets” be amended.

 

Other categories of persons[2] who travel at the charge of the Council of Europe budgets fall within the second system (i.e. travel insurance cover restricted to the risk of accident); their cover is in fact insured through a wide variety of contracts concluded by the Organisation providing capital guarantees of equal or smaller amounts than are provided for under the “official journeys” insurance.

 

It having been agreed in the course of negotiations with the insurer that these persons could be covered by the main “official journeys” insurance, the Secretary General wishes to rationalise and standardise cover for them. This extension of the scope of the “official journeys” insurance contract came into effect de facto as from 1 January 2001, without any increase in premium.

 

As all the rules governing the persons concerned follow the same model, it is proposed that Article 9[3] of each set of Rules be amended to extend cover to travel risks in addition to accident.

 

Rules to be amended:

 

-           Rules concerning the reimbursement of travel and subsistence expenses to government experts and other persons travelling at the charge of Council of Europe budgets;

 

-           Rules concerning the reimbursement of travel and subsistence expenses to Members of the European Committee for Social Rights travelling at the charge of the Council of Europe budgets;

 

-           Rules concerning the reimbursement of travel and subsistence expenses to Members of the European Committee for the Prevention of Torture when travelling at the charge of the Council of Europe budgets;

 

-           Rules concerning the reimbursement of travel and subsistence expenses to Experts assisting the European Committee for the Prevention of Torture when travelling at the charge of the Council of Europe budgets;

 

-           Rules concerning the reimbursement of travel and subsistence expenses to Members of the Administrative Tribunal travelling at the charge of Council of Europe budgets;

 

-           Rules concerning the reimbursement of travel and subsistence expenses to the Data Protection Commissioner travelling at the charge of Council of Europe budgets;

 

-           Rules concerning the reimbursement of travel and subsistence expenses to Members of the Committee on the European Charter for regional or minority languages, Members of the European Commission against Racism and Intolerance,  Members and additional Members of the Advisory Committee for the Framework Convention for the Protection of National Minorities, travelling at the charge of the Council of Europe budgets;

 

-           Rules concerning the reimbursement of travel and subsistence expenses to Members of the Congress of Local and Regional Authorities of Europe travelling at the charge of Council of Europe budgets.

Decision

 

The Deputies adopted, with effect as from 1 January 2001, the following amendments:

 

1.         Rules concerning the reimbursement of travel and subsistence expenses to government experts and other persons travelling at the charge of Council of Europe budgets

 

“IV. INSURANCE FOR ILLNESS, ACCIDENT AND OTHER TRAVEL-RELATED RISKS

 

Article 9

 

When travelling on behalf of the Council of Europe, government experts are covered in respect of risks specifically related to such travel by insurance taken out by the Organisation on their behalf. They are nevertheless obliged in the first instance to exhaust all possibilities of payment of benefits due to them under the scheme to which they are affiliated in their own country in respect of illness and accident occurring  during the journey and/or the meeting.”

 

2.         Rules concerning the reimbursement of travel and subsistence expenses to Members of the European Committee for Social Rights travelling at the charge of the Council of Europe budgets

 

“IV. INSURANCE FOR ILLNESS, ACCIDENT AND OTHER TRAVEL-RELATED RISKS

 

Article 9

 

When travelling on behalf of the Council of Europe, Members of the European Committee for Social Rights are covered in respect of risks specifically related to such travel by insurance taken out by the Organisation on their behalf. They are nevertheless obliged in the first instance to exhaust all possibilities of payment of benefits due to them under the scheme to which they are affiliated in their own country in respect of illness and accident occurring  during the journey and/or the meeting.”

 

3.         Rules concerning the reimbursement of travel and subsistence expenses to Members of the European Committee for the Prevention of Torture when travelling at the charge of the Council of Europe budgets

 

“IV. INSURANCE FOR ILLNESS, ACCIDENT AND OTHER TRAVEL-RELATED RISKS

 

Article 9

 

When travelling on behalf of the Council of Europe, Members of the European Committee for the Prevention of Torture are covered in respect of risks specifically related to such travel by insurance taken out by the Organisation on their behalf. They are nevertheless obliged in the first instance to exhaust all possibilities of payment of benefits due to them under the scheme to which they are affiliated in their own country in respect of illness and accident occurring  during the journey and/or the meeting.”

 

4.         Rules concerning the reimbursement of travel and subsistence expenses to Experts assisting the European Committee for the Prevention of Torture when travelling at the charge of the Council of Europe budgets

They are nevertheless obliged in the first instance to exhaust all possibilities of payment of benefits due to them under the scheme to which they are affiliated in their own country in respect of illness and accident occurring  during the journey and/or the meeting.”

 

6.         Rules concerning the reimbursement of travel and subsistence expenses to the Data Protection Commissioner travelling at the charge of Council of Europe budgets

Article 9

 

When travelling on behalf of the Council of Europe, the Data Protection Commissioner is covered in respect of risks specifically related to such travel by insurance taken out by the Organisation on his behalf. He is nevertheless obliged in the first instance to exhaust all possibilities of payment of benefits due to him under the scheme to which he is affiliated in his own country in respect of illness and accident occurring  during the journey and/or the meeting.”

 

7.         Rules concerning the reimbursement of travel and subsistence expenses to Members of the Committee on the European Charter for regional or minority languages, Members of the European Commission against Racism and Intolerance,  Members and additional Members of the Advisory Committee for the Framework Convention for the Protection of National Minorities, travelling at the charge of the Council of Europe budgets

Article 9

 

When travelling on behalf of the Council of Europe, Members of the Committee on the European Charter for Regional or Minority languages, Members of the European Commission against Racism and Intolerance,  Members and additional Members of the Advisory Committee on the Framework Convention for the Protection of National Minorities are covered in respect of risks specifically related to such travel by insurance taken out by the Organisation on their behalf. They are nevertheless obliged in the first instance to exhaust all possibilities of payment of benefits due to them under the scheme to which they are affiliated in their own country in respect of illness and accident occurring  during the journey and/or the meeting.”

 

8.         Rules concerning the reimbursement of travel and subsistence expenses to Members of the Congress of Local and Regional Authorities of Europe travelling at the charge of Council of Europe budgets

 

“IV. INSURANCE FOR ILLNESS, ACCIDENT AND OTHER TRAVEL-RELATED RISKS

 

Article 9

 

When travelling on behalf of the Council of Europe, Members of the Congress of Local and Regional Authorities of Europe are covered in respect of risks specifically related to such travel by insurance taken out by the Organisation on their behalf. They are nevertheless obliged in the first instance to exhaust all possibilities of payment of benefits due to them under the scheme to which they are affiliated in their own country in respect of illness and accident occurring  during the journey and/or the meeting.”
