1 General questions
1.9 Accession of the European Union to the European Convention on Human Rights –
State of progress and request by the CDDH for an extension of its ad hoc terms of reference
To examine the request of the CDDH.
1. It is recalled that at its 1085th meeting (26 May 2010), the Deputies adopted Decision No. CM/882/26052010 giving ad hoc terms of reference to the Steering Committee for Human Rights (CDDH) to elaborate a legal instrument setting out the modalities of accession of the European Union to the European Convention on Human Rights. In the terms of reference, the Deputies indicated that the CDDH “shall execute these terms of reference as soon as possible, but no later than 30 June 2011, date of expiry of these terms of reference.” On the same occasion, the Deputies invited the Secretary General to ensure that this activity is carried out efficiently with a view to its swift completion.
2. In November 2010, the Committee of Ministers’ Rapporteur Group on Human Rights held an exchange of views with the Chairs of the Steering Committee for Human Rights (CDDH) and of the CDDH informal Working Group on the Accession of the EU to the ECHR (CDDH-UE), who reported on the progress of the negotiations. At their 1106th meeting (16 February 2011), the Deputies took note of the progress of the work on the accession of the European Union to the European Convention on Human Rights (CM/Del/Dec(2011)1106.4.1a, CM(2011)13).
3. The Chairman of the Deputies wishes to draw the attention of delegations to the recent request made by the CDDH for these terms of reference to be extended until 31 December 2011. In its abridged report transmitted to the Committee of Ministers on 15 April (document CM(2011)53), the CDDH states:
“d. having regard to the complexity of the issues under discussion and to the need to give delegations sufficient time duly to consider the working documents and to hold the necessary consultations in the capitals, to extend until 31 December 2011 the ad hoc terms of reference for the CDDH to elaborate a legal instrument setting out the modalities of accession of the European Union to the European Convention on Human Rights;”.
