1.6 121st Session of the Committee of Ministers

Action

To hold a preliminary exchange of views regarding the preparation of the 121st Session of the Committee of Ministers.

1. At their 1085th meeting (25 May 2010), the Deputies decided that the 121st Ministerial Session would be held on 11 May 2011 in Istanbul. The handover of the chairmanship from Turkey to Ukraine would consequently take place on the same date.

2. At the 1105th meeting of the Deputies (9 February 2011), the Chair confirmed this date and informed the Deputies of the proposals by the Turkish Chairmanship regarding the venue and format of the 121st Session. It is planned that the ministers hold an informal meeting on 10 May 2011, on the occasion of a working dinner in restricted session at ministerial level (a theme for this informal session will shortly be proposed) and that the formal session take place on 11 May 2011 in the morning, at Ciragan Palace Kempinski. This session will be followed by a lunch.

3. The Chair also recalled to delegations the invitation addressed by his minister to his colleagues as well as to the Vice-President of the European Union after he took up the Chairmanship of the Committee of Ministers and invited delegations to bring again these dates to the attention of their capitals so that they be marked down in the ministers’ schedule.

4. With respect to the contents of the agenda, it is recalled, in accordance with the guidelines for the organisation of future ministerial sessions agreed upon by the Deputies as a follow-up to Recommendation No. 13 of the Juncker report (see CM(2008)34) that it is for the chair to fix the political agenda, organise the discussion and the session as a whole. The outgoing and incoming chairs propose subjects for discussion, in close consultation with member states and the Secretary General. The final decision on the draft agenda, which will be formally adopted by the Ministers at the beginning of the Session, is to be taken by the Deputies.

Items for discussion

5. On the occasion of the ministerial session it is foreseen that the ministers adopt a Declaration as well as a series of decisions regarding the items on the agenda. It is proposed that the agenda be structured around 4 main items, as follows:

1. The Council of Europe: a strategy for values in action – Activity report by the Secretary General

6. Under this item, the discussion will be based on a report by the Secretary General on the reform process, on the Organisation’s political agenda and on the state of implementation of the Strasbourg Declaration on Roma. This written report will be distributed in due course.

2. European Convention on Human Rights

7. Under this item, Ministers will be expected to discuss the follow-up to be given to the High-level Conference on the future of the European Court of Human Rights (Izmir, 26-27 April 2011), in the light of a report to be prepared by the Deputies after the conference.

3. Living together in 21st century Europe – Report of the Group of Eminent Persons

8. Under this item, Ministers will be expected to consider the report of the Group of Eminent Persons and to discuss the follow-up action proposed.

4. Neighbourhood policy of the Council of Europe

9. Under this item, Ministers will be invited to consider the approach of the Council of Europe’s neighbourhood policy, in the light of the report presented by the Secretary General on this question (SG/Inf(2011)7) and of the follow-up which will be proposed by the Ministers’ Deputies.

10. Institutional matters linked to the handover of the chairmanship (stocktaking of the achievements of the outgoing chair and presentation of the priorities of the incoming chair) will also be included on the agenda. In addition and subject to the state of progress of work, it is foreseen that the Council of Europe Convention on preventing and combating violence against women and domestic violence be opened for signature in the margins of the ministerial session. A preliminary draft programme of the session appears in the appendix to the present notes.

Participants

11. Where participants from the Council of Europe are concerned, the practice is that the President of the Parliamentary Assembly is invited to all Ministerial sessions. In view of the themes proposed for discussion by the Ministers, the Chairmanship proposes that the President of the European Court of Human Rights, the President of the Congress of Local and Regional Authorities of the Council of Europe, the President of the Conference of INGOs of the Council of Europe, as well as the Commissioner for Human Rights, also be invited.

12. As far as participants from outside the Council of Europe are concerned, the Chairmanship has already invited the Vice-President and High Representative of the European Union for Foreign Affairs and Security Policy. It further proposes to invite the Secretary General of the United Nations, the Secretary General of the OSCE and as was the case in the last years, the Ministers for Foreign Affairs of the five observer countries.

Decisions

The Deputies

As far as the issues to be discussed at the Ministerial Session are concerned:

1. took note of the Chairmanship's proposals for the items to be included on the agenda of the 121st Session of the Committee of Ministers, in the light of the preliminary draft programme prepared by the Chairmanship for the Session < see appendix to the present Notes>;

2. on the basis of these proposals, decided to include the following items on the provisional draft agenda of the 121st Session:

    i. The Council of Europe: a strategy for values in action – Activity report by the Secretary General

    ii. European Convention on Human Rights

    iii. Living together in 21st century Europe – Report of the Group of Eminent Persons

    iv. Neighbourhood policy of the Council of Europe

As far as the participants in the Ministerial Session are concerned:

3. noted that in addition to the President of the Parliamentary Assembly, who is invited to attend all Ministerial Sessions, the Chair would also issue invitations to the following Council of Europe representatives:

- the President of the European Court of Human Rights;

- the President of the Congress of Local and Regional Authorities of the Council of Europe;

- the President of the Conference of INGOs of the Council of Europe;

- the Commissioner for Human Rights of the Council of Europe;

4. noted also that in addition to the Vice-President and High Representative of the European Union for the Common Foreign and Security Policy, the Chairmanship would issue invitations to the Secretary General of the United Nations, the Secretary General of the OSCE and to the Ministers for Foreign Affairs of the five observer countries;

5. agreed to resume examination of the preparation of the 121st Session at their next meeting.
