10.1 European Charter for Regional or Minority Languages –
a. Election of a member of the Committee of Experts in respect of Romania

Action

To elect a member of the Committee of Experts of the European Charter for Regional or Minority Languages, in respect of Romania.


The European Charter for Regional or Minority Languages (ETS No. 148) came into force on 1 March 1998. Its Committee of Experts is composed of as many independent experts as there are Parties to the Charter. They are elected pursuant to Article 17 of the latter, which reads as follows:

    “1. The committee of experts shall be composed of one member per Party, appointed by the Committee of Ministers from a list of individuals of the highest integrity and recognised competence in the matters dealt with in the Charter, who shall be nominated by the Party concerned.

    2. Members of the committee shall be appointed for a period of six years and shall be eligible for reappointment. A member who is unable to complete a term of office shall be replaced in accordance with the procedure laid down in paragraph 1, and the replacing member shall complete his predecessor's term of office.”

The explanatory report on the Charter specifies that "the experts appointed to the committee, in carrying out their task, should be free to act independently and not be subject to instructions from the governments concerned" (§131). These requirements have been examined by the GR-J, which has agreed on the guidelines contained in document GR-J(2004)2 rev.

Romania ratified the Charter on 29 January 2008, and the Charter entered into force in respect of it on 1 May 2008.

With a view to the election of a member of the Committee of Experts in respect of Romania, the Romanian authorities have submitted a list of candidates whose curricula vitae are reproduced in CM(2010)132.

The Committee of Ministers elects the members of the Committee of Experts by secret ballot.

To be elected, it is necessary to obtain a simple majority of the votes. All members of the Committee of Ministers are entitled to take part in the vote. Should none of the candidates on the list obtain the required majority, it would be necessary to hold a second round of voting.
