Resolution CM/Res(2010)..
amending Articles 7, 10, 15 and 20 of and inserting a new Article 20 bis to the Regulations on appointments (Appendix II to the Staff Regulations) and amending Article 2 of the Regulations governing staff salaries and allowances (Appendix IV to the Staff Regulations)

at the meeting of the Ministers’ Deputies)

The Committee of Ministers, in accordance with Article 16 of the Statute of the Council of Europe,

Having regard to the Regulations on appointments (Appendix II to the Staff Regulations);

Having regard to the Regulations governing staff salaries and allowances (Appendix IV to the Staff Regulations);

Considering that the minimum time-limit for submission of applications for both internal and external vacancies should be three weeks and for external vacancies four weeks;

Considering that, in light of the case-law of the Administative Tribunal of the Council of Europe, the provisions relating to the participation of representatives of Major Administrative Entities in the recruitment process should be specified;

Considering that it should be clarified that total employment with the Organisation on fixed-term contracts shall not exceed five years;

Considering that the Secretary General should, by way of a General Rule, be able to determine the basic salaries of staff members based in a country for which there are no salary scales of the Co-ordinated Organisations;

Considering that, to achieve the above-mentioned objectives, the Regulations on appointments and the Regulations governing staff salaries and allowances should be amended;

On a proposal of the Secretary General, who has consulted the Staff Committee under Article 6, paragraph 1, of the Regulations on staff participation (Appendix I to the Staff Regulations),

Resolves as follows:

Article 1

Article 7, paragraph 4, of the Regulations on appointments will henceforth read as follows:

“The notice shall describe the duties attaching to the vacant post or position and state the conditions for eligibility, the qualifications required of candidates and the time-limit for submission of applications. The time-limit shall not be less than three weeks in the case of internal competition and not less than four weeks in the case of external recruitment.”

Article 2

Article 10, paragraph 1, third bullet point, of the Regulations on appointments shall henceforth read as follows:

"in the case of recruitment or internal competition to fill a post or position in a specific Major Administrative Entity, a representative of this entity of at least the same grade as that of the post or position to be filled; in the case of recruitment to fill posts or positions in several Major Administrative Entities, a representative of one of these entities of at least the same grade as that of the post or positions to be filled;".

Article 3

1. Article 15, paragraph 5, first bullet point, of the Regulations on appointments shall henceforth read as follows:

"approve question papers and tests for written examinations; in the case of recruitment or internal competition to fill a post or position in a specific Major Administrative Entity, question papers and tests for written examinations shall be prepared in consultation with this entity; the questions must be selected in such a way that candidates are treated equally;".

2. Article 15, paragraph 5, third bullet point, of the Regulations on appointments shall henceforth read as follows:

"determine, in the case of recruitment or internal competition to fill a post or position in a specific Major Administrative Entity after having consulted this entity, how many of the applicants who have obtained the highest marks in the tests and examinations should be interviewed by the Board."

Article 4

Article 20, paragraph 2b, of the Regulations on appointments shall henceforth read as follows:

“A fixed-term contract may be offered for a duration of at least six months. It may be extended or renewed one or more times.”

Article 5

An Article, entitled “Article 20 bis – Maximum length of fixed-term employment” and worded as follows shall be added after Article 20 of the Regulations on appointments:

“Total employment with the Organisation on fixed-term contracts in the same category shall not exceed five years. A probationary period under Article 17, paragraph 1, leading to an indefinite term contract shall not count towards this limit.”

Article 6

The following sentence shall be added to Article 2 of the Regulations governing staff salaries and allowances as a second sentence:

“The basic salaries of staff members based in a country for which such scales do not exist shall, until such scales are established, be determined by the Secretary General in a General Rule. In this Rule, the Secretary General shall have due regard to the basic salary applicable in Belgium and apply an appropriate coefficient reflecting the cost and conditions of living in the country concerned. Establishment of scales for any given country shall invalidate the Rule as regards that country.

Article 7

This Resolution shall enter into force on the date of its adoption.
