1 General questions


1.2 Stocktaking of the Slovenian Chairmanship and follow-up to the 119th Session of the Committee of Ministers (Madrid, 12 May 2009)

Action – Sub-items 1.2b and c are proposed for adoption without debate
To adopt the draft decisions below.

Under this item, the Minister for Foreign Affaires of Slovenia, Mr Samuel ŽBOGAR, will give an overview of the achievements of the Slovenian Chairmanship during the past six months, particularly regarding the follow-up to the Committee of Ministers’ 119th Session. A written report will also be available (document CM/Inf(2009)48). The Deputies will be invited to hold an exchange of views on this issue.

a. In response to the decisions taken by the Committee of Ministers at its 119th Session in Madrid, “that a review of action taken by the Council of Europe following the conflict in Georgia would be carried out at the meeting for the handover of the chairmanship of the Committee of Ministers on 18 November 2009”, the Slovenian Chairmanship has prepared a report on the action taken to date by the Council of Europe in this field (CM(2009)164). The Deputies are invited to hold an exchange of views on the report to be presented by Minister ŽBOGAR.

b. The draft Council of Europe Policy Guidelines on integrated national strategies for the protection of children from violence were examined at a meeting organised on 22 October 2009 by the TC-ENF. A revised version of the draft Guidelines, which includes some amendments proposed has been submitted to delegations for possible written comments by 12 November 2009 (Appendix to document CM(2009)146rev). Following this deadline, a finalised draft will be submitted to the Deputies for adoption without further debate.

c. The report of the Steering Committee for Human Rights (CDDH) on the follow-up given to the Committee of Ministers’ Declaration on Council of Europe action to improve the protection of human rights defenders and promote their activities, contained in document CM(2009)132, was examined by the GR-H at its meeting of 3 November 2009. In the light of the importance of this item which originates from the follow-up decisions to the 118th Ministerial Session (May 2008), the Group agreed to transmit the report to the Deputies for adoption of the relevant decisions, without further debate, at the handover meeting of the chairmanship of the Committee of Ministers from Slovenia to Switzerland (1070bis meeting on 18 November 2009).

The Deputies took note of the report by the Slovenian Chair on the action taken by the Council of Europe since the 119th Session of the Committee of Ministers following the conflict in Georgia, as it appears in document CM(2009)164.

b. Draft Council of Europe Policy Guidelines on Integrated National Strategies for the Protection of Children from Violence
(CM(2009)146rev)

Decisions

The Deputies

1. adopted Recommendation CM/Rec(2009) … of the Committee of Ministers to member states on Council of Europe Policy Guidelines on Integrated National Strategies for the Protection of Children from Violence, as it appears at Appendix … to the present volume of Decisions; < CM(2009)146rev, Appendix >

2. agreed that the Council of Europe, through the programme “Building a Europe for and with children”, should contribute to the protection of children from violence by:

a. providing a forum for the dissemination and exchange of national research, experiences and good practices in violence prevention among member states;
b. supporting the elaboration of integrated national strategies, following progress as regards their implementation and impact, and issuing periodic progress review reports;
c. developing uniform standards for collecting data on violence against children to enhance its international comparability;
d. providing an interface for all European initiatives on violence against children and serving as a reference point for the Special Representative of the UN Secretary General on Violence against Children, UN agencies and the European Union;
e. regularly updating its Policy Guidelines by taking stock of the new standards in this area.

c. Steering Committee for Human Rights (CDDH) –
Report on the follow-up given to the Committee of Ministers’ Declaration on Council of Europe action to improve the protection of human rights defenders and promote their activities

Decisions

The Deputies

1. reaffirmed their condemnation of all attacks on and violations of the rights of human rights defenders in Council of Europe member states or elsewhere, whether carried out by state agents or non-state actors;

2. took note of the Report of the Steering Committee for Human Rights (CDDH) on the follow-up given to the Committee of Ministers’ Declaration on Council of Europe action to improve the protection of human rights defenders and promote their activities, as it appears in document CM(2009)132;

3. welcomed the work undertaken in this field by all Council of Europe bodies and institutions and reiterated their call to them to pay special attention to issues concerning human rights defenders in their respective work.
