Action

To discuss the follow-up action to the Committee of Ministers' 119th Session with a view to adopting the relevant decisions (see below).

1. The Committee of Ministers held its 119h Session in Madrid on 12 May 2009, with Mr Miguel Ángel MORATINOS, Minister for Foreign Affairs and Cooperation of Spain, in the Chair.

2. The statements made by the Ministers and other participants in the 119th Session are set out in full in the draft minutes prepared by the Secretariat (document CM(2009)PV1 prov and CM(2009)PV1 prov add1). National position papers are contained in document CM(2009)PV1 add2.

3. The priorities of the new Chairmanship of the Committee of Ministers were presented at the end of the Session by Mr Samuel ŽBOGAR, Minister for Foreign Affairs of Slovenia (document CM/Inf(2009)22, CM/Inf(2009)22 add1 and CM/Inf(2009)22 add2).

4. At the present meeting, there will be a debriefing of the discussions held during the informal working lunch on the theme “The state of democracy in Europe. Belarus”. Furthermore, the Deputies are invited to hold a general discussion on the outcome of the Session and to hold an exchange of views on the Slovenian priorities. The Deputies are finally invited to adopt the enclosed draft decisions on the follow-up to the decisions adopted taken by the Ministers at the Ministerial Session. In this context, the Secretary General will inform delegations about recent developments as regards the decisions taken by the Conference of High Contracting Parties to the European Convention on Human Rights and by the Ministers in relation to the Court’s situation. Decisions concerning the Council of Europe and the conflict in Georgia are dealt with under item 2.1.

Decisions

The Deputies, on the basis of the decisions taken at the 119th Session and the discussions held,

On Guaranteeing the long-term effectiveness of the control system of the European Convention on Human Rights,

1. invited its Rapporteur Group on Human Rights (GR-H) to further examine the specific measures envisaged in the report “Guaranteeing the long-term effectiveness of the control system of the European Convention on Human Rights” (document CM(2009)51) and to report back to it;

2. invited its Rapporteur Group on Human Rights (GR-H) to follow closely the work of the Steering Committee for Human Rights (CDDH) on effective remedies for excessive length of proceedings and to report back in due time;

3. called on member states to accept, as soon as possible, that the provisions regarding the new single-judge formation and the new competence of the Committees of three judges contained in Protocol No. 14 to the European Convention on Human Rights are to be applied to them on a provisional basis either by signing and ratifying Protocol No. 14bis to the European Convention on Human Rights – and if possible accepting its provisional application - or by making a declaration of acceptance as foreseen in document CM(2009)71 rev 2;

On the Relations between the Council of Europe and the European Union,

4. invited their Rapporteur Group on External Relations (GR-EXT) to follow developments in the co-operation between the Council of Europe and the European Union in the light of the priorities for future action adopted on 27 November 2008 (document CM(2008)169) and to prepare a comprehensive report, in close co-operation with the European Union, for the 120th Ministerial Session in May 2010;

On the follow-up to other priorities resulting from the Warsaw Summit,

5. invited their Working Party on Institutional Reforms (GT-REF.INST) to prepare a report on the ongoing reform process of the Council of Europe’s organisational structures and working methods for the 120th Ministerial Session in May 2010;

On the Declaration marking the 60th anniversary of the Council of Europe

6. agreed to transmit the Declaration marking the 60th anniversary of the Council of Europe to the Parliamentary Assembly, the Congress of Local and Regional Authorities of the Council of Europe, the European Court of Human Rights, the Council of Europe Human Rights Commissioner, and to all the Committees answerable to the Committee of Ministers, for information.
