1.11 Election of the Secretary General

Action

To draw up the draft resolution to be submitted to the Ministers for adoption at the 119th Session.

1. Article 36.b of the Statute of the Council of Europe reads as follows: “The Secretary General and the Deputy Secretary General shall be appointed by the [Parliamentary] Assembly on the recommendation by the Committee of Ministers”. Traditionally, the ‘recommendation by the Committee of Ministers’ takes the form of a Resolution of the Committee, transmitting to the Assembly a list of names with a view to the appointment by the Assembly of the Secretary General.

According to the timetable adopted by the Deputies on 5 November 2008 (CM/Del/Dec(2008)1040/1.7), the Resolution should be adopted by the Ministers at their 119th Session (Madrid, 12 May 2009).

2. On 15 April 2009, at their 1045th meeting (item 1.6), the Deputies interviewed the four candidates, ie:

- Mr Thorbjørn JAGLAND (presented by Norway)
- Mr Luc Van den BRANDE (presented by Belgium)
- Mr Mátyás EŎRSI (presented by Hungary)
- Mr Włodzimierz CIMOSZEWICZ (presented by Poland)

3. On 14 April 2009, a number of delegations addressed a letter to the Chair (DD(2009)191), requesting that, “in order to determine the list of names to appear in the recommendation, a vote be taken on each candidate at the Deputies’ 1055th meeting on 22 April 2009. The vote will serve to ascertain whether the candidate has the required substantial positive support of the Committee of Ministers, in line with Article 20.d of the Statute, in the light of the criteria contained in the decision taken at the 117th Ministerial Session and the ‘outline for the short listing of candidates’ adopted by the Ministers’ Deputies at their 1047th meeting on
4 February 2009.”

4. The Deputies are invited to draw up the draft resolution to be submitted to the Ministers for adoption at the 119th Session. A preliminary draft appears in the Appendix to these notes.

1. agreed on the draft Resolution on the appointment of the Secretary General, as it appears at Appendix … to the present volume of Decisions;

2. agreed to forward it to the 119th Ministerial Session (Madrid, 12 May 2009) for adoption and transmission to the Parliamentary Assembly.

on the appointment of the Secretary General

The Committee of Ministers, under the terms of Article 36.b of the Statute of the Council of Europe,

Having regard to the Regulations relating to the appointment of the Secretary General, Deputy Secretary General and Secretary General of the Assembly having the rank of Deputy Secretary General;

Having regard to the decisions taken at the 117th Ministerial Session (May 2007);

Having examined the four candidatures presented by the Governments of Norway, Belgium, Hungary and Poland;

Having interviewed the four candidates;

Having consulted the representatives of the Parliamentary Assembly in the Joint Committee,

Decides to transmit to the Parliamentary Assembly, for appointment to the post of Secretary General, with effect from 1 September 2009, the following candidatures, listed in [alphabetical order] [order of preference], with the names of the sponsoring governments in brackets:
