These budgets were examined by the GR-PBA at its meeting of 9 October 2008. The recommendations of the GR-PBA are included under each part below..

General Remarks

2. The Deputies, with membership restricted to the Representatives of the member states of each Partial Agreement are invited to adopt the draft decisions at the end of each section. In the light of these, and subject to paragraph 5 below, the Chair can recommend the adoption of the draft budgets without further debate.

3. The reference documents are indicated at the beginning of each section.

4. The total of member states contributions for each partial agreement is presented in document CM(2008)162, Appendix 2.

5. At the GR-PBA meeting on 9 October 2008, the Chair noted the general reservation of the group as regards the impact of the 2009 salary adjustment on the budgets of the partial agreements. The group would come back to this issue on 25 November 2008.

6. The draft budgets were prepared on the basis of a salary adjustment of 1.9%. For 2009, the CCR has recommended a salary adjustment of 3% for staff based in France. The Secretary General proposes that the increase in the salary adjustment should be financed by savings within each partial agreement without increasing member states’ contributions.

7. Final budgetary tables will be distributed at the present meeting.

Opinion of the Budget Committee

21. The Committee noted that the €106 400 increase (7.72%) corresponded to statutory adjustments and the adjustment for inflation and was mainly the result of statutory changes relating to staff. The Committee recommended the estimates of expenditure and receipts for 2009 as shown in document CM(2008)130 vol3.

22. The Committee questioned whether certain costs relating to Secretarial services provided to the collegiate organs, in particular those detailed in the draft budget (page 10 under section b) should not be covered by the Development Bank. It also considered the total number of meetings to be very high.

The group held an exchange of views on the Budget Committee’s comment that consideration should be given as to whether certain costs relating to Secretarial services provided to the collegiate organs, in particular those detailed in the draft budget (page 10 under section b) should not be covered by the Development Bank. The Secretary General explained that the small team in the Strasbourg secretariat was responsible for the analysis of admissibility of projects and providing secretarial services to the Bank’s collegiate organs. As regards the first task, he thought it was very important that this work was done independently of the Bank. However, as regards the second task, he considered that it would be reasonable to consider whether related expenses could be covered by the Bank. He had discussed this matter with the eminent persons who were currently preparing a strategic review of the Bank. He considered that it would be best to wait for their conclusions before taking this matter forward within the Secretariat.

Delegations thanked the Secretary General for the clarifications. A number of these delegations were open to examining this question further, possibly through a transfer of Secretariat services provided to the collegiate organs to the Bank or through recharging expenses to the Bank, if the study showed that this was justified. One delegation, however, noted that it was not in a position to support this idea, as it believed that the Secretariat should be independent of the Bank. One delegation proposed to add a draft decision along the lines of the Budget Committee recommendation. This proposal was supported, as was a suggestion that the matter should be considered in consultation with the Bank.

Subject to paragraph 5, page 1, the Chair noted that the GR-PBA could recommend the approval the draft budget to the Deputies. He invited the Secretariat to include a draft decision along the lines of paragraph 22 of the Budget Committee report.

In response to one delegation which underlined the need to review the logframes in order to make them more specific and measurable in terms of objectives and performance indicators, the Director General of Social Cohesion stated that he was committed to continue progress in this respect in future years. The Deputies are reminded that in accordance with their decision (CM/Del/Dec(2000)718/11.5), modifying Article  4.2 of the Resolution establishing the Partial Agreement – Resolution (88) 15, member states’ contributions are obligatory and should be calculated by reference to a scale of contributions by using the method outlined in Council of Europe Resolution (94) 31, the contributions of the three big contributors being equalised, with a ceiling of 20%, then adjusted to take account of film production.

During their 112th meeting on the 14-15 October 2008, the Eurimages Board of Management adopted the scale of contributions applied to a total of obligatory member state contributions of € 20 655 000, and approved the draft budget for 2009 (CM(2008)130 vol3).

Opinion of the Budget Committee

26. The Committee took note of the information provided by the Partial Agreement's secretariat. It noted with interest the plans to entrust a specialist outside firm with the task of collecting receipts, so as to increase the reimbursement of advances. The Committee would follow the results of this new approach.

27. With regard to the draft budget for 2009, the Committee recommended the forecast of receipts proposed for 2009 and the corresponding expenditure as shown in document CM(2008)130 vol3.

28. The Committee noted, from the financial statements of Eurimages for 2007, that the present budgetary arrangements meant that the Partial Agreement carried significant cash balances on a continual basis (€32 M at 31 December 2007). It noted that these balances were invested and produced interest which was used to increase the resources of the Fund. The Committee questioned whether this interest income could be used instead to reduce the contributions of Members States. The Committee wished to review the present budgetary arrangements at its May 2009 meeting.

One delegation called for a complete review of the system of granting support, which should aim at achieving a better balance between member states’ contributions and the results of their membership. Two other delegations noted that the GR-PBA was not the appropriate forum to discuss such a matter. The Executive Director of Eurimages also informed the group that the Board of Management was currently reflecting on this as well as on ways of improving the task of collecting receipts. One delegation also took note of the Budget Committee’s comments which it believed merited further reflection.

Daily allowances
The rates of daily allowances will be fixed in relation to the decision taken by the Deputies in respect of the principles regarding increases in allowances under Appendix II of the Ordinary Budget. The Secretary General has proposed to increase the various rates of allowances by 1.9% for 2009 (CM(2008)130 vol1, Appendix II, page 154).

The Secretary General’s proposal is: € 175 for daily subsistence allowances (2008: € 172) and € 240 for work at home (2008: €236).

Opinion of the Budget Committee

29. The Committee recommended the forecast of expenditure and receipts for 2009 as shown in document CM(2008)130 vol3.

30. It recommended transforming two positions into permanent posts and upgrading one of them from B5 to A1/2/3.

31. The Committee noted that there was an increase of 55 500 € in appropriations for 2009 resulting from the organisation of the World Conference on Constitutional Justice in South Africa.

In response to a question, the Secretary of the Commission recalled that the Warsaw Summit had called upon the Venice Commission to step up its cooperation with constitutional courts. The World Conference on Constitutional Justice in 2009, to be organised also in the context of the Council of Europe’s 60 anniversary, would be a unique event, in which already over a 100 states had confirmed their participation. On the question of unpaid contributions, it was also noted that the group would examine this question at a forthcoming meeting.

Having regard to the Secretariat's proposals set out in document CM(2008)85 corr,

Resolves as follows:

The scale of contributions by member states to the budget of the Enlarged Partial Agreement on the European Centre for Modern Languages (Graz) as appended to this resolution is adopted with effect from 1 January 2009. <CM(2008)85 corr>
