Action – Sub-item a. proposed for adoption without debate

To adopt the following decisions.

The CDLR held its 40th meeting in Strasbourg, on 3-5 December 2007. The abridged report is contained in document CM(2008)6.

At the meeting, the CDLR adopted comments and opinions on a number of recommendations of the Parliamentary Assembly and the Congress, as requested by the Committee of Ministers. As regards PACE Recommendation 1811 on regionalisation in Europe (Appendix 2 to CM(2008)6), the CDLR, having recalled its work on regional self-government, declared itself ready to pursue exploring this issue, in the light of Recommendation 1811, if the Committee of Ministers instructs it to do so.

As regards Congress Recommendation 218 (2007) “The opening of the European Charter of Local Self-Government to the accession of the European Community and of non-member states of the Council of Europe” (Appendix 3 to CM(2008)6), the CDLR also expressed its readiness to pursue the consideration of this matter further, if the Committee of Ministers so requests.

Having been invited by the Committee of Ministers to study further “whether and if so how, within the resources available to it, it might increase its efficiency and effectiveness so as to enhance further both the quality and focus of its outputs”, the CDLR, when reviewing the activities to be implemented in 2008 and the corresponding working methods, agreed to a reshaping of both the scope and membership of its subordinate committees (Appendices 4 to 6 to CM(2008)6). It further agreed to return to this issue once the Committee of Ministers has taken its decisions on the follow-up to be given to the 15th session of the Conference of European ministers responsible for local and regional government.
The CDLR reviewed the state of implementation of the programme of activities for 2007 and took a number of decisions in this respect. In particular, it adopted three reports (Detailed comparative study of municipal competences, Relationship between central and local authorities, Intermunicipal co-operation) and agreed to submit to the Committee of Ministers the report on Regional self-government it had drawn up at the request of the latter and submitted to the Ministerial conference (see CDLR(2007)69 final Addendum and Appendix). This report, if the Deputies agree, could also be sent to the Congress and the Parliamentary Assembly.

As regards the activities to be implemented in 2008, the CDLR looked at them in the light of the Declaration adopted at the Ministerial conference in Valencia, which includes an updating of the Budapest Agenda on Delivering Good Local and Regional Governance. The CDLR did not add any new activity to the current ones but invited the Secretariat to adjust the Intergovernmental programme of activities to the new priorities agreed by the Ministers.

In this connection, the CDLR agreed to request the Committee of Ministers to authorise Mr Paul-Henri Philips (Belgium) to chair for the third year the Committee of experts on democratic participation and public ethics, as an exception to the rule established by Article 12 (e) of Appendix 1 to Resolution Res(2005)47 on committees and subordinate bodies, their terms of reference and working methods.

The CDLR finally considered the proposed Strategy for innovation and good governance at local level, endorsed by the European Ministers. As agreed at the meeting held in Valencia, in connection with the Ministerial conference, the CDLR opened the floor for an in-depth discussion. The CDLR did not identify any issues concerning the Strategy in need of clarification or further elaboration.

The Deputies are reminded that they are invited to take the appropriate decisions in relation to the Strategy in the framework of their examination of the report of the Secretary General on the Valencia Ministerial conference (CM(2008)14, item 2.4 of the present meeting).

Decisions

The Deputies

1. took note of the comments adopted by the CDLR on Recommendation 1811 of the Parliamentary Assembly on regionalisation (Appendix 2 to CM(2008)6), which will be discussed in due course in the light of the debates held at the 15th Conference of European Ministers responsible for local and regional government (Valencia, 15-16 October 2007);

2. instructed the CDLR, by 31 December 2008, to conduct, and report on, an in-depth discussion on regionalisation in Europe, on the basis of the conclusions adopted by the European Ministers during the Valencia Conference;

3. took note of the opinion of the CDLR on Recommendation 218 (2007) of the Congress (Appendix 3 to CM(2008)6);

4. instructed the CDLR to carry out by 31 December 2008, on the basis of the proposal by the Congress included in its Recommendation 218(2007), a study on the feasibility and desirability of an amending protocol to the European Charter of Local Self-Government enabling accession by the European Community/European Union and non-member States;

5. took note with satisfaction of the report on European practice and recent developments in the field of regional self-government (CDLR(2007)69 final Addendum and Appendix) prepared by the CDLR and noted that the terms of reference given to the CDLR at their 907th meeting have been fulfilled;

6. agreed to transmit this report to the Parliamentary Assembly and the Congress in order that they may benefit from it;

7. as an exception to Article 12 (e) of Appendix 1 to Resolution Res(2005)47 on committees and subordinate bodies, their terms of reference and working methods, allowed the LR-DP Committee to be chaired in the year 2008 for the third consecutive (one-year) term by Mr Paul-Henri Philips (Belgium);

8. approved the specific terms of reference of the following subordinate committees:
- Committee of experts on democratic participation and public ethics at local and regional level
(LR-DP)
- Committee of experts on the institutions of local and regional government (LR-GI)
- Committee on experts on governance and resources at local and regional level (LR-GR)
as they appear at appendices … to the present volume of decisions (appendices 4-6 to CM(2008)6);

9. having regard to decisions 1 to 8 above, took note of the abridged report of the 40th meeting of the CDLR (CM(2008)6) as a whole.
