Specific terms of reference of the Select Committee of Experts on the minimum rights of irregular migrants (MG-R-AD)

4. Terms of reference:
The Committee shall have the following tasks:
Examine the access of irregular migrants to minimum rights, on the basis of the report on obstacles to effective access of irregular migrants to minimum social rights (CDMG (2004) 29) and the exploratory report on the access of irregular migrants to social protection (CDCS (2004) 55) and make proposals to CDMG in this field.
a. The Committee of Experts shall consist of five experts designated by the governments of the following member states: Italy, Poland, Portugal, Russia, Turkey.
The Council of Europe budget will bear the travel and subsistence expenses of these five experts.
These experts shall have an extensive knowledge of the issues dealt with by the Committee of Experts.
b. The European Committee for Social Cohesion (CDCS) and the European Commission Against Racism and Intolerance (ECRI) may send representatives to meetings of the Committee, without the right to vote but at the charge of the corresponding Council of Europe budget sub-head.
c. The Parliamentary Assembly and the Congress of Local and Regional Authorities of the Council of Europe may send representatives to meetings of the Committee, without the right to vote or defrayal of expenses.
d. The European Union may send a representative to meetings of the Committee, without the right to vote or defrayal of expenses.
e. The following observers with the CDMG may send representatives to meetings of the Committee, without the right to vote or defrayal of expenses:
- International Labour Office (ILO);
- International Organisation for Migration (IOM);
- European Trades Union Confederation (ETUC);
- Union of Industrial and Employers' Confederations of Europe (UNICE).
6. Structures and working methods:
The Committee shall hold two meetings in 2005 and be assisted by a consultant.
A hearing with representatives of the following organisations will be held during the first meeting of the Committee:
- Churches' Commission for Migrants in Europe (CCME);
- International Catholic Migration Commission (ICMC);
- Platform for International Cooperation on Undocumented Migrants (PICUM).
The travel and subsistence expenses of four persons will be borne by the Council of Europe.
The hearing will take place in the afternoon of the first day and in the morning of the second day of the meeting.
These terms of reference will expire on 31 December 2005.
