Abridged report

A.   FOREWORD

The European Commission for the Efficiency of Justice (CEPEJ) held its 24th plenary meeting in Strasbourg on 11 – 12 December 2014. The meeting was chaired by Mr John STACEY (United Kingdom).

The agenda appears in Appendix.

B.   LIST OF ITEMS DISCUSSED AND DECISIONS TAKEN BY THE CEPEJ

The CEPEJ:

  1. Information by the President of the CEPEJ, CPEJ members and the Secretariat

§  took note of the information given by its President, its members and its Secretariat who had participated in various fora where the work of the CEPEJ was presented and discussed; welcomed the active participation of CEPEJ in 2014 in 43 fora (in 23 states) dealing with issues of direct relevance to the functioning of justice;

  1. Recent developments in the judicial field in the Council of Europe member states

§  took note of the information given by representatives of Azerbaijan, Croatia, Germany, Ireland, Italy, Malta, Republic of Moldova, the Netherlands, Serbia, “the former Yugoslav Republic of Macedonia”, Turkey, Ukraine, the United Kingdom, Morocco, Jordan, on recent domestic developments in the judicial field and invited its members to forward to the Secretariat written information and useful references which could be included in the area "country profiles" of its web site;

  1. CEPEJ co-operation programmes

§  welcomed the ongoing and future cooperation programmes, which allow the practical implementation of the methodology and tools of the CEPEJ and thus provide a strong added value to the work of the Council of Europe in the beneficiary states, in particular:

-     in Albania, in the framework of the ongoing Joint Programme with the European Union for the "Support to the Efficiency of Justice" (SEJ),

-     in Croatia, in the framework of the programme funded by the EEA/Norway Grant for improving the quality and efficiency of the judicial system,

-     in Azerbaijan, Republic of Moldova and Ukraine, as part of the new Joint Programme with the European Union, following the regional programme for the Eastern Partnership countries, aimed to continue cooperation for the efficiency of judicial systems,

-     in Turkey, as part of the new cooperation programme with the Swedish authorities (SIDA) to promote mediation on the basis of the CEPEJ Guidelines,

-     in Morocco, Tunisia and Jordan, as part of the neighbourhood policy and the ongoing Joint Programmes with the European Union for the reforms of the judicial systems;

§  noted that these programmes could be complemented during the year 2015 by a new Joint Programme with the European Union for the countries of South East Europe;

§  underlined that the implementation of these numerous programmes by the CEPEJ requires the availability of members and experts of the CEPEJ and called upon its members and experts to inform the Secretariat of their willingness to participate in these programmes;

  1. Evaluation of judicial systems

§  noted with great satisfaction the excellent reception by the Committee of Ministers of the Report, as well as the positive responses received as regards this Report in many member states, from policy makers, justice practitioners and the media;

 

§  invited its members to disseminate the Report to the competent authorities and judicial professionals of their country, in particular by facilitating its translation (at least the translation of its overview), where appropriate, and to forward as soon as possible to the Secretariat information on the way the Report is used by the state authorities and any press articles, written on a national level, that concern the Report;

§  decided to launch the next evaluation process in 2015 on the basis of data of the year 2014, with a view to publishing a new evaluation report in 2016; instructed the Secretariat, under the authority of its Bureau and the CEPEJ-GT-EVAL, and subject to available funding, to develop further the techniques for collecting, processing and analysing data, and instructed the CEPEJ-GT-EVAL to propose subsequently a new form for presenting and analysing data resulting from this work;

§  instructed the CEPEJ-GT-EVALto review the Evaluation Scheme and its subsequent explanatory note, without increasing the workload of the national correspondents and having in mind the stabilization of the questionnaire, and agreed to adopt these documents through a written procedure before 1 May 2015;

§  agreed that the electronic Scheme should be opened for reply by national correspondents as from 15 May 2015 until 31 December 2015 and urged the national correspondents to comply with such a timeframe, in order for the data to be processed from January 2016;

stressed that part of the Scheme would also be used within the framework of the cooperation with the European Commission (see next item), which implied that, for this part of the Scheme, the national correspondents concerned were urged to respond already by 1 October 2015;  

§  welcomed the ongoing cooperation with the European Commission in the evaluation of judicial systems and noted that a Study on judicial systems in the member states of the European Union was being prepared, based on the methodology developed by the CEPEJ, from the 2013 data, aimed to provide information allowing the European Commission to prepare its "EU Justice Scoreboard”;

§  confirmed its willingness to pursue its cooperation with OECD as regards the evaluation of the functioning of judicial systems;

§  instructed the CEPEJ-GT-EVAL to launch calls to external researchers for projects that might benefit from a CEPEJ label on the basis of a specific protocol and to manage this process, under the authority of the Bureau, while ensuring proper coordination with the other working groups; instructed it in particular to work, including through possible new questions, on the consequences of the use of ITC on the human resources of courts;

§  took note of the reports of the peer evaluation visits in Israel (23-24 March 2014), Estonia (14-15 April 2014) and Switzerland (4-5 September 2014), agreed to pursue the cycle of peer evaluation visits on judicial statistics in 2015, andinvited the member states to confirm at the beginning of 2015 their willingness to organise such visits;

  1. Quality of justice

§  adopted its Guidelines on the organisation and accessibility of court premises (CEPEJ(2014)15) and decided to forward them to the Committee of Ministers so that it may take note of them, as well as to the relevant Committees and bodies of the Council of Europe so that they can make use of them when appropriate; invited its members to organise the translation of these Guidelines into non-official languages and to ensure a wide dissemination among the relevant political and judicial authorities in their countries;

invited its members to bring to the attention of the CEPEJ plans for new constructions or recently built buildings, so as to facilitate the exchange of experiences on architectural projects;

§  adopted its Guidelines on the role of technical experts in the judicial proceedings (CEPEJ(2014)14) and decided to forward them to the Committee of Ministers so that it may take note of them, as well as to the relevant Committees and bodies of the Council of Europe so that they can make use of them when appropriate; invited its members to organise the translation of these Guidelines into non-official languages and to ensure a wide dissemination among the relevant political and judicial authorities in their countries;

§  welcomed the ongoing cooperation with the EU Agency for Fundamental Rights (FRA) aimed to prepare jointly a “Handbook on access to justice in Europe”;

§  instructed the CEPEJ-GT-QUAL to pursue its work on the definition of indicators for the quality of justice and for promoting the Guidelines for a better implementation of the existing Council of Europe’s Recommendation on enforcement, as well as in the field of effective remedies as safeguarded by ECHR Article 13; it also instructed it to reflect on the issue of “virtual judicial offices” and that of public access to legislation and court case-law "; 

  1. SATURN Centre for judicial time management

§  adopted its revised Guidelines on judicial time management(CEPEJ(2014)16), including guidelines aimed at prosecutors, and decided to forward them to the Committee of Ministers so that it can take note of them, as well as to the relevant Committees and bodies of the Council of Europe so that they can make use of them when appropriate; invited its members to organise the translation of these Guidelines into non-official languages and to ensure a wide dissemination among the relevant political and judicial authorities in their countries;

§  approved an opinion (CEPEJ(2014)19) prepared by the CEPEJ-SATURN, in cooperation with the European Union of Rechtspfleger (EUR), aimed at proposing to the European Committee for Legal Cooperation (CDCJ) to update Recommendation Rec(86)12 concerning measures to prevent and reduce the excessive workload in the courts and decided to forward it to the CDCJ for consideration;

§  reiterated its invitation to the volunteer courts in the member states to indicate to the Secretariat their candidature for organising within their courts a coaching programme aimed at implementing the SATURN tools for judicial time management based on the CEPEJ Guide and invited its members to inform widely the courts in their states of this opportunity;

  1. Relations between the CEPEJ and other bodies of the Council of Europe

§  took note of the information provided about the activities of the Consultative Council of European Judges (CCJE), the Consultative Council of European Prosecutors (CCPE), the European Committee for Legal Cooperation (CDCJ) and the Steering Committee on Crime Problems (CDPC), and confirmed its availability to pursue cooperation with them within the framework of their work;

 

§  agreed in particular to strengthen exchanges with the CCJE and CCPE within the framework of the process for evaluating judicial systems;

§  noted with interest the proposal by the representative of the CDPC to organise a joint meeting of the Bureaus of the above mentioned committees;

  1. Information regarding the European Union

§  took note of the information provided by the representatives Italy and Latvia, speaking on behalf of the outgoing and incoming presidencies of the European Union, about the recent and planned developments within the Union in the field of justice;

  1. European Day of Justice and Crystal Scales of Justice

§  thanked the Portuguese authorities for having organised the  main event of the 2014 European Day of Justice in Aveiro around the issue of judicial mediation, including an interesting film festival on mediation, as well as the judicial authorities in 12 member states which organised specific events within the framework of this Day;

§  welcomed the success of the European Prize: "the Crystal Scales of Justice" and congratulated the winner:the General Council of the Spanish Bar, for its initiative “ Online legal aid: Better solutions for people’s rights”, as well as the three institutions which were granted a special mention by the jury: the Estonian Ministry of Justice for “A central Database for Justice (E-File)”, the courts for family affairs and the Bar of Berlin (Germany) for: “An accelerated family procedure” and the Amsterdam Court of Appeal (Netherlands) for its “European Courts weblog and European law newsletters”;

 

invited its members to promote candidacies for the next edition of the "Crystal Scales of Justice";

  1. Observers to the CEPEJ

§  took note of the information provided by its Observers, and in particular the European Association of Judges, the International Union of Bailiffs and Judicial Officers (UIHJ), the Council of European Bars and Law Society (CCBE), the European Union of Rechtspfleger (EUR), thanked themfor their concrete contribution to its activities, notably in the drafting of the report evaluating judicial systems, and invited them to contribute further to the implementation of its activity programme;

  1. Working methods of the CEPEJ

§  to ensure better continuity in the work of the CEPEJ, and strengthen the network of the CEPEJ, considering  the increasing number of tasks assigned to it, decided that each member state would be invited to appoint, in addition to the member CEPEJ a substitute member;


therefore decided to amend Article 1 of its Rules of procedure (CEPEJ/GENERAL(2003)3) as follows: "Each member State shall appoint its delegation under Article 5 of the Statute of the CEPEJ. It is invited to appoint in particular a member and a substitute member, notwithstanding that the travel and subsistence expenses of only one expert are covered by the budget of the Council of Europe";

§  in order to cope with the growing demand for CEPEJ experts, particularly in the framework of the implementation of cooperation programmes, called on its members to appoint experts willing to participate in the work of the CEPEJ, possibly before 15 January 2015, instructed the Secretariat to organise training sessions for these experts, in order that they may contribute to promoting the CEPEJ tools within the framework of these programmes and noted that a first training session would take place in Paris on 30 January 2015;

 

  1. Election of the Bureau

§  elected for a two year period Georg STAWA (Austria) as President of the CEPEJ, Irakli ADEISHVILI (Georgia) as Vice-President of the CEPEJ, elected Ivana BORZOVA (Czech Republic) and Ramin GURBANOV (Azerbaijan), as members of the Bureau for a two year period;

§  expressed its warm thanks to Mr John STACEY for his four years as President of the CEPEJ and for his leading action towards further developing the Commission and endowing it with a preeminent role within the Council of Europe;

§  took note of the 2015 provisional working agenda which appears in Appendix 3 to this report and noted in particular that the next plenary meetings of the CEPEJ could take place on 17-19 June or 1 - 3 July 2015 in Croatia, and on 10 - 11 December 2015 in Strasbourg;thanked the Croatian authorities for their invitation to possibly hold the plenary meeting in their country in 2015 and the Greek authorities for their invitation to hold a plenary meeting in Thessaloniki in 2016.
