Abridged report

A.   FOREWORD

The European Commission for the Efficiency of Justice (CEPEJ) held its 20th plenary meeting in Strasbourg on 6 – 7 December 2012. The meeting was chaired by Mr John STACEY (United Kingdom).

The agenda appears in Appendix.

B.   LIST OF ITEMS DISCUSSED AND DECISIONS TAKEN BY THE CEPEJ

The CEPEJ:

1.   Celebration of the 10th anniversary of the CEPEJ

§  warmly thanked the Deputy Secretary General of the Council of Europe, the President of the Ministers’ Delegates, the President of the European Court of Human Rights, the Commissioner for Human Rights, as well as the ambassadors and justice professionals who had kindly accepted to participate in its special session to mark its 10th anniversary;

§  entrusted its Bureau to duly take into account the discussions and proposals made during this session when drawing up the next activity programmes;

§  instructed the Secretariat to report publicly on these discussions, in particular through its web site;

2.   Information by the President of the CEPEJ and the Secretariat

§  took note of the information given by its President, its members and its Secretariat who had participated in various fora where the work of the CEPEJ was presented and discussed; welcomed the active participation of CEPEJ in 2012 in 31 fora (in 20 states) dealing with issues of direct relevance to the functioning of justice;

3.   Evaluating of the judicial systems

§  noted with great satisfactionthe excellent welcome by the Committee of Ministers of the Report, as well as the positive responses received as regards this Report in many member states, from policy makers, justice practitioners and the media;

§  invited its members to disseminate the Report to the competent authorities and judicial professionals of their country, in particular by facilitating its translation, where appropriate, and to forward as soon as possible to the Secretariat information on the way the Report is used by the state authorities and any press articles, written on a national level, that concern the Report;

§  instructed the CEPEJ-GT-EVAL to launch calls to external researchers for projects that might benefit from a CEPEJ label on the basis of a specific protocol and to manage this process, under the authority of the Bureau, while ensuring proper coordination with the other working groups;

§  entrusted the CEPEJ-GT-EVAL, where appropriate in cooperation with the CEPEJ-GT-QUAL, to further work on the role of the judicial systems in the current economic environment and to study “how to spend better” the budgetary means made available to the judicial systems;    

§  decided to launch the next evaluation process in 2013 on the basis of data of the year 2012, with a view to publishing a new evaluation report during 2014;

§  adopted the revised version of the Evaluation Scheme (CEPEJ(2012)12) and its subsequent explanatory note (CEPEJ(2012)13), subject to possible changes to be proposed by the CEPEJ-GT-EVAL following the discussions during this meeting; the CEPEJ members will be invited to give their final approval through a written procedure before 1 May 2013;

agreed that the electronic Scheme should be opened for reply by national correspondents as from 15 May 2013 until 31 December 2013 and urged the national correspondents to comply with such a timeframe, in order for the data to be processed from January 2014;

instructed the Secretariat to bring the necessary improvements to the electronic version of the questionnaire and to organise appropriate modalities for the implementation of this new assessment cycle;

§  invited the Committee of Ministers to grant the CEPEJ appropriate means, in particular a permanent statistician, to enable this evaluation cycle to rely on proper expertise in matters of statistical data processing and analysis, and noted that such a scientific expertise could also guarantee statistical analysis within the framework of the SATURN Centre if this expertise was provided on a permanent basis;

 

§  agreed to pursue the cycle of peer evaluation visits on judicial statistics in 2013, took note of the interest expressed by Belgium, Estonia, Latvia,Lithuania and the United Kingdom and invited them to confirm this possibility to the Secretariat at the beginning of 2013;

§  confirmed its willingness to cooperate with OECD as regards the evaluation of the functioning of judicial systems;

§  instructed the CEPEJ-GT-EVAL, under the authority of the Bureau, to propose appropriate modalities for cooperation with non-member states of the Council of Europe;

4.   Report for the European Commission on the impact of the functioning of judicial systems on the economy

§  took note of the report prepared by the experts appointed by the Bureau of the CEPEJ on “The functioning of judicial systems and the situation of the economy in the European Union member states” and entrusted the experts to further work on the executive summary of this report;

§  confirmed its willingness to further cooperate with the bodies of the European Union to evaluate the functioning of judicial systems, according to modalities to be clearly defined to ensure the proper implementation of the CEPEJ’s principles and methodology;

5.     Report prepared by the CCBE on the role of lawyers in judicial proceedings

§  warmly thanked the CCBE, the Université Libre of Brussels and the scientific expert Isabelle ANDOULSI for the report on “The role of lawyers in judicial proceedings in Europe” and instructed the CEPEJ-GT-EVAL and the Secretariat to organise its publication on the CEPEJ’s web site as a public working document;

6.     CEPEJ cooperation programmes

§  welcomed the on-going Joint Programmes with the European Union carried out by the CEPEJ for evaluating and supporting the reform of the judicial systems in Morocco and Tunisia, and possibly soon in Jordan, on the basis of the CEPEJ tools and methodology; in this framework, welcomed the active participation of the delegations from Morocco and Tunisia in its work and expressed the wish to find by the beginning of the year 2013 an agreement with the authorities on concrete activities to be implemented within the Moroccan and Tunisian courts to improve the efficiency and quality of their operation;

 

§  welcomed the report prepared by the experts of the CEPEJ-GT-EVAL on "the efficiency of justice"within the Joint Programme with theEuropean Union forthe Eastern Partnership countries(Armenia, Azerbaijan, Georgia, Moldova, Ukraine), based on the report "European judicial systems - Edition 2012", and highlighted the excellent synergies developed between its intergovernmental work andthe direct andin-depth use of this work to support judicial reforms in several member states;

7.   Quality of justice

§  took note of the on-going work of the CEPEJ-GT-QUAL as regards the organisation of judicial maps, the role of judicial experts and the organisation of court premises; instructed the CEPEJ-GT-QUAL and the CEPEJ-GT-EVAL to work together on the definition of indicators for the quality of justice;

§  reiterated its invitation to the volunteer courts in the member states to indicate to the Secretariat their candidature for organising a coaching programme aimed at organising user satisfaction surveys based on the CEPEJ Handbook and invited its members to inform widely the courts in their states of this opportunity;

       8.  Judicial time management

§   took note of the work carried out by the Steering group of the SATURN Centre, in particular in order to facilitate the concrete use of the Guidelines on judicial time management, and instructed it to pursue its work according to its strategic action plan; encouraged in particular the member states to indicate to the Secretariat elements regarding best practices of judicial time management to complement and update the existing documents;

§   approved the revised version of the report on “Length of court proceedings in the member states of the Council of Europe based on the case law of the European Court of Human Rights” prepared by the scientific experts Françoise CALVEZ and Nicolas RÉGIS (CEPEJ(2012)16) and decided to publish it in the Series of the “CEPEJ Studies”;

§   reiterated its invitation to the volunteer courts in the member states to indicate to the Secretariat their candidature for organising within the court a coaching programme aimed at implementing the SATURN tools for judicial time management based on the CEPEJ Guide and invited its members to inform widely the courts in their states of this opportunity;

9.   CEPEJ Network of Pilot Courts

§   warmly thanked the authorities of Malta for having invited the Network of pilot courts to meet in Gozo on 27 September and welcomed the efficient contribution of the pilot courts to the implementation of the CEPEJ activity programme, in particular on lengths of proceedings and on the quality of justice;

10.  Targeted cooperation with the member states

§  invited the member states which would like to benefit from the cooperation of the CEPEJ to forward their proposals to the Secretariat, so that they can be considered by the Bureau, subject to the available budget;

 11.  Other cooperation with the European Union

§  took note of the information given by the representatives Cyprus and Ireland, speaking on behalf of the outgoing and incoming presidencies of the European Union, on the recent and foreseen developments within the Union in the field of justice;

§  thanked the Lithuanian authorities for having organised the 2012 main event of the European Day of Justice in Vilnius around the issue of judicial mediation, including an interesting film festival on mediation, as well as the judicial authorities in 13 member states which organised specific events within the framework of this Day;

§  welcomed the success of the European Prize: "the Crystal Scales of Justice" and congratulated the winner: the Regional Court of Antwerp (Belgium), for its initiative for the follow-up of judicial expertises, as well as the three institutions which were granted a special mention by the jury:  the Regional Court of Tarascon (France) for “The co-hearing of the judge in family affairs – Auditor of children”; the Supreme Court of Slovenia for the “Judicial data warehouse and performance dashboards” and the General Secretariat of justice administration (Spain) for the project “Lexnet”;

invited its members to promote candidacies for the next edition of the "Crystal Scales of Justice";

12.  Gender issues within CEPEJ activity

§  took note of the oral report by its special rapporteur for gender issues in the activities of the CEPEJ, Gábor SZÉPLAKI-NAGY (Hungary), and entrusted its Bureau and working groups to remain particularly attentive to this issue in the implementation of the activity programme;

13.  Election of the Bureau

§  re-elected for a two year period John STACEY (United Kingdom) as President of the CEPEJ, Georg STAWA (Austria) as Vice-President of the CEPEJ, and Irakli ADEISHVILI (Georgia) and Audun BERG (Norway), as members of the Bureau.
