Introduction

The CDLR requested during its meeting of 2-3 April 2012 a draft report on the state of ratification and implementation of the Additional Protocol. 25 Member States responded on the questionnaire. 10 Member States who responded have ratified the protocol. The responses were analysed by the Secretariat and resulted in a table listing the responses with a cross-reference to the countries concerned.

Although the responses were extensive, they do vary in substance thus making it difficult to assess them in-depth. Nonetheless, some first comparisons of the responses show that the existing legal framework of the respondents was already in line with the provisions of the Additional Protocol.

The Secretariat believes based on the analysis of the response that more information is needed to establish a satisfactory overview of each state’s ratification in order to provide a useful contribution for reflection in the CDLR.

The Bureau could therefore consider instructing the Secretariat to undertake one or more of the following actions:

-       to have an in-depth exchange of views with the representatives of a selected group of countries. This exchange could lead to a broader understanding of the received responses and to the possible identification of previous actions which were undertaken by the Member States to bring the domestic legal framework in line with the provisions of the protocol;

-       to send an additional questionnaire to the respondents in order to have a better understanding of the original responses;

-       to take note of the responses and to conclude that there is no need for further analysis.

Action required
