Context

The Council of Europe transversal programme “Building a Europe for and with children” was launched in 2006 and has completed two policy cycles.  In light of the stocktaking of the first two policy cycles, and following extensive consultations, the Committee of Minister’s adopted the Council of Europe Strategy for the Rights of the Child (2012-2015) on 15 February 2012

At the 49th Meeting of the CDLR, 2-3 April 2012, Ms Regina Jensdottir, Head of the Unit “Building a Europe for and with children”, gave a presentation of the Strategy and the unit’s activities. She emphasised that the CDLR is seen as an essential partner in promoting the Strategy on account of its important work at intergovernmental level.  The CDLR agreed to appoint a Rapporteur on children’s rights and should do so at the present meeting.

Recent Activities:

Congress of Local and Regional Authorities

In advance of the 23rd Session of the Congress 16-18 October 2012, the Congress Bureau endorsed a “Pact of Towns and Regions to Stop Sexual Violence against Children” and adopted a declaration encouraging municipalities and regions to sign up for it.  The Pact, which was formally launched during the Congress session, is based on a four-pronged approach of Precention, Protection, Prosecution and Participation and proposes a list of activities and initiatives that local and regional authorities may take towards the ultimate aim of preventing the exploitation of children.

As part of the Congress’s contribution to the ONE in FIVE campaign to stop sexual violence against children, the Congress Chamber of Regions adopted a resolution and a recommendation which call on regional authorities and parliaments to implement the Council of Europe Convention on the Protection of Children against Sexual Exploitation and Sexual Abuse in the organisation of their welfare, social and health services, as well as by integrating its provisions into regional legislation where possible.

Lanzarote Committee

The Lanzarote Committee, the monitoring body for the Council of Europe Convention on the Protection of Children against Sexual Exploitation and Sexual Abuse (‘the Lanzarote Convention’) met for the 3rd time in Strasbourg 15-16 October 2012.

45 Council of Europe member states have signed the Lanzarote Convention, including most recently Andorra on 29 June 2012 and the Russian Federation on 1 October 2012.  It has been ratified by 23 member states, including in 2012 by Iceland, Moldova, Portugal, “the former Yugoslav Republic of Macedonia”, and Ukraine.  Italy and Lithuania informed the Committee that they expect to complete ratification by the end of 2012.


In light of the recent ratifications, the Committee agreed to postpone appointment of a Chair and Bureau until the next meeting.  They settled on working methods going forward and agreed that they would attempt to follow the GRETA model in their approach to monitoring.  Monitoring rounds will focus on a specific theme beginning with sexual abuse in the circle of trust.  Following the succesful study visit to Iceland to learn about the Barnahaus model, further study visits to share best practice will form an important aspect of the work of the Committee.

Inter-Secretariat Task Force

The inter-Secretariat Task Force met on 25 October 2012 for the first time since adoption of the Strategy on the Rights of the Child.  The purpose of the task force is to foster cooperation and coordination across the Council of Europe in order to facilitate implementation of the Strategy.

Upcoming Activities:

The Thematic Coordinator Group on Children of the Committee of Ministers will meet on 15 November 2012 to discuss ways and means to reinforce Council of Europe capacity to support implementation of standards in relation to rights of the child and to hear a progress report on implementation of the Strategy and of the ONE in FIVE campaign.

As part of Council of Europe initiatives to encourage ratification of the Lanzarote Convention, a conference will be held in Italy on 29-30 November 2012.  The conference will focus on article 39 of the Convention dealing with principles and measures for international cooperation.  The aim of the conference will be to share positive experiences promoted and carried out in the context of international cooperation with a view to developing recommendations.

The “Building a Europe for and with children”  unit has compiled a non-exhaustive activity sheet giving a more detailed overview of upcoming Council of Europe activities on the rights of the child which is included as an annexe to this document.

Implementation of the Strategic Objectives on the

Rights of the Child

Strategy for 2012-2015

First Biennium 2012-2013

Introduction to the activity sheet:

The Council of Europe Inter-Secretariat Task Force (Task Force) on Children’s Rights is an internal body charged with the mission to develop and implement a strategy to improve the transversal nature of CoE activities relative to children’s rights. Under the coordination of the Children’s Rights Division, headed by Ms. Regina Jensdottir, it establishes a set of joint working methods and a system of information sharing.

This document provides an overview of the Council of Europe activities on the rights of the child during the biennium 2012-2013. It gathers both activities implemented/planned by the Children’s Rights Division, joint activities with other entities within the CoE or activities implemented by various sectors of the organisation. In some of the joint activities, the Children’s Rights Division has a mere role of coordination, in others it is actively involved with the cooperating entity in the implementation of activities. This document illustrates, in a brief but clear way, which activities on children’s rights are currently being implemented or planned within the CoE and shows who is responsible for which activity.

The document is based on the four strategic objectives set forth by the 2012-2015 Strategy for the Rights of the Child. Under each strategic objective, a series of activities pertaining to that particular objective are listed. The activities are divided into two columns, referring to 2012 and 2013 respectively. Next to the columns of activities, the cooperating entity, if any, is listed along with the name(s) of the person(s) with whom the Children’s Rights Division has been in contact for the implementation of the activities. Lastly, the fourth column provides information on who, within the Children’s Rights Division and under the over-all coordination of Ms. Regina Jensdottir, is responsible for each area of activities.

The activity sheet is by no means a final document; its purpose is to serve as a working document that favours information sharing and that offers a clear overview of which actors are involved in which activities.



OVERALL STRATEGIC OBJECTIVE 1: PROMOTING CHILD-FRIENDLY SERVICES AND SYSTEMS

Children and young people have the legal right to equal access to and adequate treatment in healthcare, social, justice, family, education systems and services as well as sport, culture, youth work and other recreational activities aimed at young people under the age of 18. The Council of Europe will support the development of child-friendly services and systems that are respectful, responsive, reliable and responsible, with a particular focus on children in vulnerable situations. To ensure a holistic approach to the protection of children’s rights, the Council of Europe will foster exchange of good practices as regards local, regional and national procedures and institutions dealing with children’s rights.

OVERALL STRATEGIC OBJECTIVE 2: ELIMINATING ALL FORMS OF VIOLENCE AGAINST CHILDREN

Children and young people are legally entitled to be protected from all forms of violence. But despite positive steps in this direction, children continue to suffer violence in all spheres of life – in their home, in school, while practising their activities, in residential institutions and detention, in the community, and in the media.

The Council of Europe will continue to act as a regional initiator and co-ordinator of initiatives to eliminate all violence against children in Europe. As the European forum for follow-up to the recommendations of the UN Secretary General’s Study on Violence against Children (2006), it will continue to support the mandate of the Special Representative of the UN Secretary General on Violence against Children as well as the United Nations Special Rapporteur on the sale of children, child prostitution and child pornography. To this end, the Organisation will adopt a two-pronged approach to:

Support the adoption and implementation of integrated national strategies to protect children from violence. These will include legislative, policy and institutional reforms and a focus on prevention.[2]

Promote zero tolerance for all forms of violence by raising awareness and taking action

  To address specific types of violence and focus on settings in which violence occurs.

OVERALL STRATEGIC OBJECTIVE 3: GUARANTEEING THE RIGHTS OF CHILDREN IN VULNERABLE SITUATIONS

Children are legally entitled to equal enjoyment of their rights, yet in practice, some children are particularly exposed to rights violations, and need special attention and measures to protect them as well as measures to empower them, in particular through access to citizenship and human rights education. The Council of Europe is committed to eliminating discrimination against children in vulnerable situations, through stepped up cooperation with UNICEF, the EU and civil society. Besides the groups of children mentioned below, the Council of Europe will continue to protect the rights of other children in vulnerable situations, such as those from national minorities; living in poverty; children raised in social isolation; child victims of discrimination based on race, ethnicity, colour, sex, language, religion, political or other opinion, national or social origin, property, disability, birth or other status such as sexual orientation or gender identity. While implementing this objective, the Council of Europe will take into account that children are often exposed to multiple forms of discrimination.

·         Encourage and support member states to develop and implement methods guaranteeing access to education to Roma children, including educating and informing teachers on Roma culture and anti-discrimination work and parental education of Roma parents aiming at reinforcing the need and necessity of education of their children. Particular attention will be paid to the rights of Roma girls and the need to combat early marriages.

·         Prepare a feasibility study on Roma children and their rights.

·     Follow-up on the feasibility study: Organise study groups in 2-3 member states, which, based upon child participation methodology, will interview Roma children.

OVERALL STRATEGIC OBJECTIVE 4: PROMOTING CHILD PARTICIPATION

All children have the legal right to be heard and taken seriously in all matters affecting them, whether in the family or alternative care environments; day-care; schools; local communities; health care, justice and social services; sport, culture, youth work and other recreational activities aimed at young people under the age of 18; and policy-making at domestic, European and international levels. A major obstacle to effective child participation can be attributed to adult attitudes. The Council of Europe and its member states are responsible for reversing this situation and establishing a culture of respect for children’s views.

Children’s participation is a cross-cutting approach throughout the whole strategy. The Organisation will continue to mainstream child participation as a working method and an attitude into its own standard-setting, monitoring and co-operation activities. This objective will be mainstreamed in particular in the Council of Europe sectors working on youth, on education and on media and information society.

·     Self- assessment tool will be designed, published and tested in 2 countries.

·     Cooperation with the EU, FRA, UNICEF and UNCRC should be ensured for the launching of the self-assessment tool and its future use in their own work.

·     Promotion of the Award “City for Children” on various aspects of building a child-friendly environment at local level, including on increasing child participation.

·     Promote the Convention for the Protection of Individuals with regard to the processing of personal data (CETS No. 108) to ensure better protection of children’s privacy resulting from the use of information and communication technologies.

·     Support the conduct of a youth consultation on the protection of privacy in the new media environment with School net (tbc).

·     Promote children’s right to privacy and empower them in the new media environment.

·     Raise awareness of Internet service providers, social networks and the media in their practical understanding of and compliance with the rights of the child.

·     Develop and publish a report on best practices concerning cyber bullying and violence in schools.
