Introduction

As part of its terms of reference the CDLR is expected to draft norms suitable for inclusion in the Appendix to Protocol No 3 to the Madrid Outline Convention.

This convention was opened for signature on 16 November 2009, at Utrecht, on the occasion of the 16th session of the Council of Europe Conference of Ministers responsible for Local and Regional Government. 

The Protocol was the culmination of the work undertaken in the CDLR, in order to provide member states and their local and regional authorities with an additional tool – the Euroregional Co-operation Grouping – for the promotion of effective cross-border and inter-territorial co-operation.

In the light of the terms of reference the Secretariat asked Professor Lejeune to prepare a draft appendix to Protocol N° 3 to the Madrid outline Convention.

At its meeting of 5 July 2012 the open-ended working party reviewed and debated the first draft prepared by professor Lejeune.

Action required

The CDLR is invited to take note of the meeting report of the open-ended working party on the preparation of an Appendix to Protocol N° 3 to the Madrid Outline Convention.

CDLR members are invited to attend (at their own expenses) the second meeting of the open-ended working party to be held in Strasbourg on 21 November 2012 in order to consider a second series of provisions drafted by the consultant.

OPEN-ENDED WORKING PARTY ON THE

PREPARATION OF AN APPENDIX TO PROTOCOL No. 3

TO THE MADRID OUTLINE CONVENTION

MEETING REPORT[1]

1.         Opening of the meeting

The Secretariat opened the meeting and welcomed the participants. The list of participants appears at Appendix 1.

2.         Election of the chair

The representative of the Netherlands, Mr Auke van der Goot was elected as the chair of the meeting.

3.         Adoption of the agenda

The agenda of the meeting was adopted (see Appendix 2).

4.        Examination of the proposals of the provisions prepared by the consultant

The Working Party agreed with the structure of the working document and the template proposed by the expert. 

The Working Party suggested presenting a final document for adoption at the second CDLR meeting in 2013 and recommended that the CDLR be briefly informed about the proceedings of the Working Party at its next meeting.

Regarding the revision of EGTC Regulation No 1082/2006 the expert was advised by the Working Party to take into account that not much progress is expected on the revision of the guidelines in the coming six months. The Working Party agreed that the work on the appendix should not become depended on the revision of EGTC Regulation No 1082/2006.

As regards individual proposals, the Group agreed the following.

Section I

The Working Party agreed to add a template to the explanatory note presenting the legal aspects regarding dualistic or monistic systems as indentified in the explanatory note. 

Section II

The Working Party agreed with section II. The expert was requested to provide some additional practical information on possible cross border cooperation between public entities and private parties which execute a public task based on a concession.  

Section III

The Working Party agreed with the section.

Section IV

It was agreed by the Working Party to remove the list with examples of legal persons in paragraph 3a. and 3b of section IV. The text of section IV will be redrafted in the light of this request. Examples of legal persons will be added to the explanatory note.

 

Section V

The Working Party agreed with the proposed text.

Section XXV

The Working Party agreed that the section XXV should make clearer that there are other possibilities besides infrastructure. Examples will be described in the explanatory note.

Section XXXVII

It was agreed by the Working Party to remove the list of categories in section XXXVII to the explanatory note.

Section XXXVIII

The Working Party agreed with the proposed text.


5.         Continuation of the work

 

The Working Party agreed to have a second meting before the end of this year, preferably following the CDLR meeting in November.

The third meeting of the Working Party is foreseen before the first CDLR meeting in 2013.

                                                    

6.         Close of the meeting

The Working Party agreed that the draft meeting report be sent for information and possible comments to CDLR members and former LR-IC members.
