(CDLR)

ABRIDGED REPORT OF THE 48th MEETING

19 – 21 September 2011

1.        Opening of the meeting

The CDLR met in Strasbourg from 19-21 September 2011, with Mr Andriy GUK, (Ukraine) in the Chair. The list of participants appears at Appendix 1.

2.        Adoption of the agenda

The agenda as adopted appears at Appendix 2. A proposal by Mr Robert Baumann (Switzerland) not to include item C.3 Partnership between the Committee of Ministers and the Ministerial Conference did not receive support.

A.           RECENT DEVELOPMENTS

1.            Report of the Bureau meeting on 29 June 2011

The Vice-Chair of the Committee, Mr Auke van der Goot (Netherlands), presented the results of the Bureau meeting of 29 June 2011 on the basis of the meeting report (CDLR-Bu(2011)19).

2.            Decisions of the Committee of Ministers concerning the CDLR

The CDLR took note of the decisions of the Committee of Ministers as they appear in document CDLR(2011)26.

3.            Information on other Council of Europe bodies

The Committee took note of the information provided in document CDLR(2011)27.


4.            Forum for the Future of Democracy

The Committee took note of the information contained in document CDLR(2011)28. It agreed with the proposal that Prof. Ken Davey at the Forum on 13-14 October 2011 in Cyprus make a presentation drawing on the information gathered in the preparation of the Report “Local government in ciritical times: policies for crisis, recovery and sustainable future”.

5.            Recent developments in member States

Mrs Nina Britt Berge (Norway) informed the committee about the recent local elections held in Norway and the pilot projects organised in a limited number of local authorities with internet voting and in others with lowering the age for voting to 16.

B.           FOLLOW-UP TO UTRECHT DECLARATION

1.            Overview of activities

The Committee took note of the state of implementation of the activities under the Utrecht Agenda.

2.            Sub-committee meeting reports

Mr Auke van der Goot (the Netherlands), Mr Markku Mölläri and the Secretariat introduced the reports and work respectively of the LR-IC, the LR-FS and LR-GG Committees [documents LR-IC(2011)8, LR-GG(2011)10]. The CDLR took note.

3.         Council of Europe Reform and Programme of activities 2012-2013

The Secretariat presented the most recent decisions on the reform of the Council of Europe (adoption of CM Resolution Res(2011)7, draft terms of reference of the CDLR, creation of new Directorate General Democracy). Mrs Gabriella Battaini-Dragoni, current Director General of DGIV and appointed Director General of Programmes (as from 1 October 2011) provided further insight on the central place of local and regional democracy in the new structure, the extended opportunities for synergies and co-operation across departments and in member states, and the role of the new DG in enhancing flexibility, efficiency and accountability in the work of the Council of Europe.

4.            Report on the impact of the Lisbon Treaty on the ECLSG

The two consultant experts, Professor Gérard Marcou and Professor Jean-François Akandji-Kombe, designated by the CDLR Secretariat and the Congress Secretariat respectively, presented their report on the impact of the Lisbon Treaty on the ECLSG.


The Committee expressed its thanks to the authors. It agreed to study its content and proposals further. It agreed that the report should be sent to Minister Chaves and be included in the documents to be made availabe to Ministers at the 17th session of the Ministerial Conference in Kyiv. The CDLR also instructed the CDLR Bureau to consider the report and to make suggestions as to the follow-up to be given to it. Finally it was noted that this report might also be of interest to the High Level Group on Governance of EU member States and agreed that the latter be contacted to see about a possible presentation of the report at one of its next meetings.

It was also agreed that the report should be brought to the attention of the Ministers’ Deputies and that, to that end, it be appended to this meeting report (Addendum).

5.            Draft report on the CDLR survey of Participatory budgeting at local level

The draft report on the CDLR survey of the role of the central/regional government in the participatory budgeting at local level was presented to the CDLR by the rapporteur, Mrs Neza Vodusek (Slovenia). The document addressed the legal framework and current practice in member States in participatory budgeting at local level, based on the data obtained from the replies on the questionnaire sent to the member States, as well as input from the participants at the workshop on Participatory Budgeting held in Strasbourg on 9 May 2011.

The CDLR thanked Mrs Vodusek for her comprehensive report and adopted it. It also agreed to publish it as a booklet available for the Ministerial Conference in Kyiv.

6.            Workshop on Democratic Participation by certain groups in society

Further to the Report on the low democratic participation by certain groups in society and taking stock of the member States’ policies adopted by the CDLR at its meeting in March 2011 and the agreement of the LR-GG Committee at its meeting on 9 May 2011 that the issue of low democratic participation by certain groups in society should be given additional consideration, the Rapporteur, Mr Edwin Lefebre (Belgium), presented a draft proposal on a workshop that could be organised after the Ministerial Conference in Kyiv, with a clear focus on concrete experience, successful and not-so-successful, of member States.

The CDLR agreed that it would be desirable to hold this workshop in conjuction with the CDLR meeting in spring 2012 in Strasbourg. The Secretariat indicated it would seek the input from other parts of the Council of Europe in order to ensure optimum synergy and results.


7.            Publication of SWOT report

The Committee agreed on the publication by the Council of Europe of the SWOT report entitled “Crossborder Co-operation in Europe: a comprehensive overview” and the contribution by the CDLR to a possible event to be organised by the Institute of International Sociology of Gorizia (ISIG) around the report. The Bureau was tasked with deciding the modalities of this contribution.

8.            Communication relating to the CDLR and local and regional democracy

The Secretariat gave a resumé of some of the main communication activities for 2011 which included the Strasbourg Colloquy on Transparency and Public Ethics, the drawing up of a list of external contacts (local associations, local press, news agencies) and the launch of the Communication Correspondents Network.  An outline was also given of the communications activities proposed for the remainder of year, notably the preparation of a promotional video using interviews carried out at the above-mentioned Colloquy, awareness-raising of the Ministerial Conference, during, before and after the conference, and continuation of expanding the list of external contacts.

The CDLR agreed that a document be prepared in time for the Kyiv Conference drawing on the replies to the questionnaire to the Bulgarian municipalities that received the Label of Good Democratic Governance (EloGE).

The Secretariat was also invited to improve the access to the local democracy pages of the new Council of Europe’s website.

Following a presentation on the efficacy of Twitter as a communication tool, the Committee agreed to the opening of a CDLR Twitter account.

9.            Centre of Expertise on Local Government Reform and Co-operation programmes

The Committee took note of the information contained in document CDLR(2011)36 and expressed its satisfaction with the high volume and quality of work carried out with limited resources. It considered that in many respects, this work is exemplary and a model for the future.

10.         Strategy for Innovation and Good Governance at Local Level

Further to an invitation by the GR-DEM, the Committee held a discussion on the implementation of the Strategy on the basis of document CDLR(2011)37.

The Committee agreed that its input should be channeled through the Stakeholders’ Platform so that the latter could take account of the views of all stakeholders in its response to the GR-DEM. The CDLR gave guidance to its representatives on the Stakeholders’ Platform.

11.         European Local Democracy Week

The Committee took note of the information contained in document CDLR(2011)38.

C.           MINISTERIAL CONFERENCE

1.            Preparation of the 17th session of the Ministerial Conference (Kyiv, November 2011) – Practical information

The Committee took note of the document and in particular the modalities for the organisation of the debates, the tabling of amendments and the adoption of the Kyiv Declaration.

It was noted that the Chair of the CDLR will write to the Presidents of both the Parliamentary Assembly and the Congress inviting suggestions as to the topics to be discussed at the exchange of views between the ministers and PACE and Congress representatives on 3 November 2011.

2.            Draft agenda and draft programme

Mrs Olga Romanyuk, Deputy Minister of Regional Development and Housing of Ukraine presented the Committee with the draft programme for the Ministerial Session as well as with all information of a practical nature necessary for ministers and their delegations. The Conference web-site address is : http://17-session.kiev.ua.

The Committee welcomed the presentation and congratulated Mrs Romanyuk with the efforts Ukraine is making to prepare the Ministerial Session. It approved the draft programme.

The Committee also approved the draft agenda as it appears in document CDLR(2001)40.

3.            Partnership between the Committee of Ministers and the Ministerial Conference

The Committee noted that so far no reply had been sent to the proposal for a partnership  between the Committee of Ministers and the Ministerial conference put forward on behalf of the conference by Minister Tapani Tölli of Finland. The Committee was informed that a draft for the reply has been prepared by the GR-DEM, which, given the restricted nature of the document, could not be made available to the CDLR.

Mr Arto Luhtala (Finland) said that although his authorities were somewhat disappointed with results so far, improvement of the coherence of working arrangements in the democracy pillar of the Council of Europe was necessary and must be pursued. Other delegations also emphasized the need for close cooperation between the Committee of Ministers and the ministers with domestic responsibility for local and regional government.

The CDLR instructed the Bureau to prepare elements for possible inclusion in the Kyiv Declaration at its meeting on 7 October 2011 and agreed to proceed with the further preparation in the same way as agreed in respect of the draft Kyiv guidelines (see item C.5. below).


4.            Utrecht Reviews

Ms Paqui Santonja (Spain) presented to the Committee the draft report prepared by Minister Manuel Chaves.

5.            Local Government: Responses to recession across Europe

The Committee was given presentations on the draft Report “Local government in critical times: policies for crisis, recovery and sustainable future” by three members of the editorial team: Mr Gabor Peteri, Mr Sorin Ionita and Professor Ken Davey.

Following the presentations the CDLR examined and, agreeing on a number of final changes, approved the draft report for sending to the Ministerial Conference.

The Committee examined the draft for the Kyiv guidelines as contained in document CDLR(2011)44. Delegations made a number of proposals for changes to the guidelines and instructed the Bureau of the CDLR to prepare revised version at its meeting on 7 October. Following this meeting the revised version will be sent to delegations who will have one week for written comments. In the light of these comments a draft will be prepared by the Bureau. Any changes after that will have to be proposed and decided upon in accordance with the rules agreed for the conference session (see document CDLR(2011)39).

The CDLR examined the relevant part of the Kyiv Declaration on the basis of document CDLR(2011)45. The Committee made some proposals for changes to the text and agreed to proceed with the further preparation in the same way as agreed in respect of the draft Kyiv guidelines.

The Committee thanked the Editorial Group for the valuable work in had carried out and the quality of the resulting report.

6.            Overcoming obstacles to transfrontier co-operation

The CDLR reviewed and slightly modified the draft declaration on removing obstacles to transfrontier co-operation as revised following the consultation held in Strasbourg on 12 September 2011.

7.            Human rights at local level

The item was introduced by Mr Auke van der Goot (the Netherlands), one of the two co-rapporteurs. He explained that for health reasons the other co-rapporteur, Mr Paul-Henri Philips had unfortunately not been able to take part in the preparation of the report (CDLR(2011)47) beyond the initial stages. Mr van der Goot suggested that this experience should lead the CDLR to appoint two co-rapporteurs in all cases.


The Committee thanked Mr van der Goot for the thoughtful report and approved the proposals it contained for the preparation of the item. The Committee underlined the importance of Congress presenting at the Ministerial session its views on the question of and approach to human rights at local level. The Congress representative assured the Committee that Congress members would be pleased to do so.

The CDLR instructed the Bureau to take forward the preparation of the item at the session along the lines above, to prepare the documentation for Ministers and to prepare draft elements for inclusion in the relevant section of the draft Kyiv Declaration

8.            Progress report on the implementation of the Utrecht Agenda

The CDLR approved the proposal for the review report on the implementation of the Utrecht Agenda by the Council of Europe as set out in document CDLR(2011)48. The Committee agreed that Table D without column 10 from the document will be used as an addendum.

9.            Draft Kyiv Declaration

The Committee agreed on the proposed format of the Kyiv Declaration, consisting of an introduction and four separate statements covering the main four themes of the Conference.

The CEMR informed the Committee that it is celebrating its 60th Anniversary on 12 December 2011 in Brussels and that the CDLR will be invited to attend. Also all CDLR members will be invited. It was agreed that forthcoming information will be sent to members by the CDLR Secretariat.


3.        Date of the next meeting

The CDLR decided not to fix a precise date at this stage because the holding of the next CDLR meeting will need to be decided in the light of the results of the Ministerial Session in Kyiv. The CDLR therefore entrusted the Bureau of the CDLR with making proposals for dates.

4.        Adoption of the abridged meeting report

The Committee adopted its meeting report.
