A.   FOREWORD

1.     The Consultative Council of European Prosecutors (CCPE) met in Yerevan (Armenia) on 8-9 October 2013 with Mr Antonio MURA (Italy) in the chair. The agenda is appended and the list of participants is available from the Secretariat.

B.   ITEMS SUBMITTED TO THE COMMITTEE OF MINISTERS FOR DECISION

2.     The CCPE invited the Committee of Ministers:

to take note of its Opinion No. 8 (2013) on relations between prosecutors and the media, that it adopted during this meeting;

and of the fact that this document would be forwarded to the relevant bodies in the member States, who would be encouraged to translate it into their respective languages in the case of need, and to the relevant bodies of the Council of Europe in order that they may take this into account in the framework of their own work.

C.   ITEMS SUBMITTED TO THE COMMITTEE OF MINISTERS FOR INFORMATION

The CCPE:

3.      represented by Mr Philippe BOILLAT, Director General of Human Rights and Rule of Law of the Council of Europe, strongly thanked the Armenian authorities and particularly Mr Gevorg KOSTANYAN, the current Prosecutor General of Armenia, and Mr Aghvan HOVSEPYAN, the former Prosecutor General of Armenia, for their kind invitation to hold this meeting in Yerevan within the framework of the Armenian Chairmanship of the Committee of Ministers of the Council of Europe, and for the warm welcome reserved to the members of the CCPE, as well as for the excellent organisation of the meeting;

4.      re-elected Mr Antonio MURA (Italy) as the President and Ms Raija TOIVIANEN (Finland) as the Vice-President of the CCPE for 2014, re-elected Mr Cédric VISART de BOCARME (Belgium) as the member of the Bureau for two years (2014 and 2015), together with Ms Alessandra GIRALDI (Denmark) elected member of the Bureau for 2013 and 2014;

5.      following an exchange of views concerning an opportunity to propose an updating of the Recommendation CM/Rec(2000)19 of the Committee of Ministers to the member States on the role of public prosecution in the criminal justice system, according to the Terms of Reference of the CCPE, decided to limit itself, at this stage, to the adoption of a reference document on European norms and principles concerning prosecutors which would allow, in an indirect way, an update and a synthesis of the principles contained in the Recommendation;

6.      adopted the draft Terms of Reference of the CCPE for 2014 and 2015, which provided that the CCPE devotes its next two Opinions to the following topics: (i) a reference document on European norms and principles concerning prosecutors and (ii) prosecutors and investigation; and decided, subject to the adoption of this draft by the Committee of Ministers, to work on the reference document in 2014;

7.      appointed Ms Gordana BOSILJČIĆ (Bosnia and Herzegovina), Mr João Manuel DA SILVA MIGUEL (Portugal), Mr. Hasan DURSUN (Turkey), Mr Jean-Pierre DRENO (Monaco), Mr Peter McCORMICK (Ireland), Mr Harald RANGE (Germany), Ms Elizabeth SIDWA (Poland), Mr Antonio VERCHER NOGUERA (Spain), Mr Alexander ZVYAGINTSEV and Mr Vladimir ZIMIN (Russian Federation) as members and Mr Olivier de BAYNAST (France) and Ms Nelly HARUTYUNYAN (Armenia) as substitute members to the select group responsible for preparing the draft Opinion for 2014 to be submitted to the 9th plenary meeting of the CCPE;

 

8.      examined the request for targeted co-operation by prosecutors of Montenegro concerning the general re-election of the state prosecutors, noted that it was within its competence according to the point (iii)  "Main tasks" of the Terms of Reference of the CCPE, instructed its Bureau to deal with various similar requests that may be submitted to the CCPE until its next plenary meeting and to consult it by electronic means as regards the replies to be given to such requests;

9.      took note of the latest draft of the international Convention to combat the manipulation of sports results prepared by the drafting Group of the Enlarged Partial Agreement on Sport (EPAS), and the explanations given by Mr Cédric VISART de BOCARME (Belgium) on the work already carried out within this framework, confirmed the importance of the CCPE’s involvement in the criminal aspects that may be contained in this Convention; instructed Mr Cédric VISART de BOCARME and Mr Olivier de BAYNAST (France) to continue participating in the relevant meetings of the drafting Group of the EPAS;

10.    expressed the wish to be able to closely follow the work concerning the future European Public Prosecutor;

11.    recalled the importance for its members to ensure that the CCPE’s website becomes a real tool to make the work of the CCPE more visible;

12.    took note of the information provided by Ms Raija TOIVIANEN (Finland) as the Vice-President of the International Association of Prosecutors (IAP), particularly regarding its ongoing work, as well as the importance of IAP as the observer to the CCPE;

13.    welcomed the formal appointment by EUROJUST of Mr João Manuel DA SILVA MIGUEL (Portugal) as the representative to attend the meetings of the CCPE;

14.    took note of the information provided by the representative of the Association "Magistrats européens pour la démocratie et les libertés" (MEDEL), particularly regarding its ongoing work for defining the common standards for European prosecutors and the organisation of an international conference in early 2014 on the establishment of the European Public Prosecutor, to which the CCPE would be invited;

15.    proposed to hold the 9th plenary meeting of the CCPE on 4-5 December 2014 in Paris (subject to the confirmation) and the meetings of the CCPE-GT on 27-28 March and 19-20 June 2014; instructed the Bureau to prepare the structure of the future Opinion during a meeting to be held in Rome in February 2014 upon invitation by the CCPE's President, in the premises of the General Prosecution Office at the Italian Court of Cassation.
