MEETING REPORT


A.   FOREWORD          

1.     The Consultative Council of European Prosecutors (CCPE) met at the Council of Europe headquarters in Strasbourg, France, on 26 and 27 November 2012 with Mr João Manuel DA SILVA MIGUEL (Portugal) in the chair. The agenda is appended and the list of participants is available from the Secretariat.

B.   ITEMS SUBMITTED TO THE COMMITTEE OF MINISTERS FOR DECISION

2.     The CCPE invited the Committee of Ministers:

a.     to take note of Opinion No. 7 (2012) on “The management of the means of prosecution services”,

and of the fact that this document would be forwarded to the relevant bodies in the member states, who would be encouraged to translate it into appropriate languages if need be, and to the relevant bodies of the Council of Europe in order that they can have account of it in their own work;

b.    take note of the present report as a whole.

C.   ITEMS SUBMITTED TO THE COMMITTEE OF MINISTERS FOR INFORMATION

The CCPE:

3.     confirmed that the Opinion of the CCPE in 2013 would be on the subject of the relations between prosecutors and the media, in accordance with its terms of Reference as adopted by the Committee of Ministers;

4.     appointed Ms Nelly HARUTYUNYAN (Armenia), Mr Olivier de BAYNAST (France), Mr Peter POLT (Hungary), Mr Peter McCORMICK (Ireland), Mr Jean-Pierre DRENO (Monaco), Mr João Manuel DA SILVA MIGUEL (Portugal), Mr Alexander ZVYAGINTSEV and Mr Vladimir ZIMIN (Russian Federation), Mr Antonio VERCHER NOGUERA (Spain), Mr Hasan Dursun (Turkey) as members and Mr Harald RANGE (Germany) and Ms Gabriela SCUTEA (Romania) as substitute members, to the select group responsible for preparing the draft Opinion on relations between prosecutors and the media (CCPE-GT) to be submitted to the 8th plenary meeting of the CCPE;

5.     agreed that the Opinion to be prepared in 2013 should be preceded by a questionnaire on relevant aspects concerning the current situation but also on how the organisation should be concerning the relationship between prosecutors and the media in the member states; took note of the preliminary version of the questionnaire prepared by the Secretariat; thanked Mr Cédric VISART DE BOCARME (Belgium), Ms Alessandra GIRALDI (Denmark) and Ms Raija TOIVIAINEN (Finland) for taking the initiative to complete the questionnaire for the 21st January 2013; entrusted the Secretariat to send the questionnaire to all members of the CCPE in February 2013; invited all members of the CCPE to submit their replies to the questionnaire by 4 March 2013, as well as to address to the Secretariat any information at their disposal relevant to the Opinion;

6.     elected Mr Antonio MURA (Italy) President and Ms Raija TOIVIAINEN (Finland) Vice-President of the CCPE for 2013; elected Ms Alessandra GIRALDI (Denmark) as member of the CCPE Bureau for two years (2013 and 2014);

7.     took note of the adoption on 19 September 2012 by the Committee of Ministers of the Recommendation (CM/Rec(2012)11) to member states on the role of public prosecutors outside the criminal justice system; expressed their appreciation to Mr João Manuel DA SILVA MIGUEL (Portugal), President of the CCPE, who acted as scientific expert in the preparation of the draft Recommendation; and underlined the excellent cooperation with the European Committee on Legal Co-operation (CDCJ);

8.     took note of the work carried out within the framework of the CoE Enlarged Partial Agreement on Sport (EPAS) for preparing a draft International convention to combat the manipulation of sports results as presented by its Executive Secretary, as well as the invitation to the CCPE to take part in the meetings of the drafting Group, expressed the opinion that, taking into account the scale of increasing criminal activities related to match fixing (particularly in football) and the increase of organised crime and corruption practices in sport, the CCPE should pay particular attention to this work; appointed Mr Olivier de BAYNAST (France) as the CCPE representative to attend relevant meetings of the EPAS;

9.     proposed to hold the 8th plenary meeting of the CCPE on 28-29 November 2013 and the meetings of the CCPE-GT on 21-22 March and 24-25 June 2013.
